BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 12 That the Laws of Maryland read as follows: 13 Article – Education 14 3–902. 15 (a) An elected member of the county board is entitled to reimbursement for travel 16 and other expenses as provided by the Montgomery County Council. 17 (b) (1) An elected member of the county board is entitled to receive[: 18 2 HOUSE BILL 1207 (i) $25,000 annually as compensation; or ] ANNUALLY AS 1 COMPENSATION : 2 (I) 1. $25,000, ENDING NOVEMBER 30, 2025; 3 2. $62,000, BEGINNING DECEMBER 1, 2025; AND 4 3. $124,000, BEGINNING DECEMBER 1, 2026; OR 5 (ii) An annual salary set through legislation based on the 6 recommendations of the Montgomery County Board of Education Compensation 7 Commission in accordance with Title 28, Subtitle 1A of the Local Government Article. 8 (2) The president of the county board is entitled to receive[: 9 (i) $29,000 annually as compensation; or ] ANNUALLY AS 10 COMPENSATION : 11 (I) 1. $29,000, ENDING NOVEMBER 30, 2025; 12 2. $67,000, BEGINNING DECEMBER 1, 2025; AND 13 3. $134,000, BEGINNING DECEMBER 1, 2026; OR 14 (ii) An annual salary set through legislation based on the 15 recommendations of the Montgomery County Board of Education Compensation 16 Commission in accordance with Title 28, Subtitle 1A of the Local Government Article. 17 (3) An elected member is entitled to health insurance and to other fringe 18 benefits regularly provided to employees of the board of education under the same terms 19 and conditions extended to other employees of the board of education. 20 (4) A SALARY INCREASE FOR AN ELECTED MEMBER UN DER THIS 21 SUBSECTION SHALL TAK E EFFECT AT THE BEGINNING OF THE TERM OF OFFICE AND 22 MAY NOT INCREASE DUR ING THE TERM OF OFFI CE. 23 (c) (1) The student member [may not receive compensation but, after 24 submitting expense vouchers,] may be reimbursed for out–of–pocket expenses incurred in 25 connection with official duties. 26 (2) [(i)] A student member who completes a full term on the county board 27 shall [be granted a scholarship to be applied toward the student’s higher education costs. 28 HOUSE BILL 1207 3 (ii) 1. Except as provided in subsubparagraph 2 of this 1 subparagraph, the scholarship amount is equal to the highest annual resident 2 undergraduate tuition, mandatory fees, and room and board that is charged at a 4–year 3 public institution of higher education within the University System of Maryland, other than 4 the University of Maryland Global Campus and University of Maryland, Baltimore 5 Campus, for the academic year in which the student member serves on the county board: 6 (I) MAY BE REIMBURSED FOR OUT–OF–POCKET EXPENSES 7 INCURRED IN CONNECTI ON WITH OFFICIAL DUT IES; AND 8 (II) SHALL BE GRANTED COMP ENSATION IN ACCORDAN CE WITH 9 PARAGRAPH (2) OF THIS SUBSECTION . 10 (2) (I) SUBJECT TO SUBPARAGRA PH (II) OF THIS PARAGRAPH , THE 11 COMPENSATION AMOUNT OF THE STUDENT MEMBE R IS EQUAL TO THE HI GHEST 12 ANNUAL RESIDENT UNDE RGRADUATE TUITIO N, MANDATORY FEES , AND ROOM AND 13 BOARD THAT IS CHARGE D AT A 4–YEAR PUBLIC INSTITUT ION OF HIGHER EDUCAT ION 14 WITHIN THE UNIVERSITY SYSTEM OF MARYLAND, OTHER THAN THE UNIVERSITY OF 15 MARYLAND GLOBAL CAMPUS AND UNIVERSITY OF MARYLAND, BALTIMORE 16 CAMPUS, FOR THE ACA DEMIC YEAR IN WHICH THE STUDENT MEMBER S ERVES ON 17 THE COUNTY BOARD . 18 (II) 1. SUBJECT TO SUBSUBPARA GRAPH 2 OF THIS 19 SUBPARAGRAPH , THE STUDENT MEMBER M AY ELECT TO RECEIVE COMPENSATION 20 GRANTED UNDER THIS S UBSECTION IN MONTHLY INSTALLMENTS AS A ST IPEND 21 DURING THE STUDENT MEMBER ’S TERM AND RECEIVE A NY REMAINING AMOUNT AS 22 A SCHOLARSHIP AFTER THE END OF THE TERM . 23 2. The amount of a scholarship COMPENSATION granted 24 under this subsection in any year may not exceed the amount that an elected member of 25 the county board is entitled to receive under subsection (b) of this section in that year.] 26 RECEIVE AS FOLLOWS : 27 (I) THROUGH THE TERM THAT ENDS IN 2026, A SCHOLARSHIP 28 EQUAL TO 40% OF THE ANNUAL COMPEN SATION OF AN ELECTED MEMBER OF THE 29 COUNTY BOARD FOR THA T YEAR TO BE APPLIED TOWARD THE STUDENT ’S HIGHER 30 EDUCATION COSTS AND A ONE–TIME STIPEND EQUAL T O 10% OF THE ANNUAL 31 COMPENSATION OF AN E LECTED MEMBER OF THE COUNTY BOARD ; AND 32 (II) BEGINNING WITH THE TE RM THAT STARTS IN 2026, A 33 SCHOLARSHIP EQUAL TO 80% OF THE ANNUAL COMPENSATION O F AN ELECTED 34 MEMBER OF THE COUNTY BOARD FOR THAT YEAR TO BE APPLIED TOWARD THE 35 STUDENT’S HIGHER EDUCATION C OSTS AND A ONE–TIME STIPEND EQUAL T O 20% OF 36 THE ANNUAL COMPENSAT ION OF AN ELECTED ME MBER OF THE COUNTY B OARD. 37 4 HOUSE BILL 1207 SECTION 2. AND BE IT FURTHER ENACTED, That, in accordance with Article 1 III, § 35 of the Maryland Constitution, this Act may not be construed to extend or apply to 2 the salary or compensation of the president and members of the Montgomery County Board 3 of Education while serving in a term of office beginning before the effective date of this Act, 4 but the provisions of this Act concerning the salary or compensation of the president and 5 members of the Montgomery County Board of Education shall take effect at the beginning 6 of the next following term of office. This limitation does not apply to an individual appointed 7 or elected after the effective date of this Act to fill out an unexpired term. 8 SECTION 3. 2.
