105	105	(b) (1) Subject to paragraph (2) of this subsection and notwithstanding any 5
106	106	other provision of law, a hospital offering bone marrow transplant services shall allow an 6
107	107	individual to donate bone marrow to any individual. 7

109	109	(2) An individual may donate bone marrow to another individual if a 8
110	110	licensed physician determines, based on the physician’s medical judgment, that the 9
111	111	donation of the bone marrow is in the best interests of the donee and there is no substantial 10
112	112	risk of medical injury to the donor. 11

114	114	(C) NOTWITHSTANDING ANY O THER PROVISION OF LA W, A HOSPITAL SHALL 12
115	115	ALLOW AN INDIVIDUAL RECEIVING A MEDICAL PROCEDURE TO PROVIDE AN 13
116	116	AUTOLOGOUS OR DIRECT ED BLOOD DONATION OR DERED BY A PHYSICIAN FOR THE 14
117	117	MEDICAL PROCEDURE IF THE HOSPITAL FACILIT ATES BLOOD DONATIONS . 15

119	119	SECTION 2. AND BE IT FURTHER ENACTED, Th at this Act shall take effect 16
