AN ACT concerning 1 
 
State Procurement – Prohibited Certifications – Boycotts of Foreign Countries 2 
 
FOR the purpose of prohibiting a procurement officer from requiring a certain certification 3 
from a bidder or offeror or including a certain clause in a State procurement contract 4 
or contract renewal relating to boycotts of foreign countries; and generally relating 5 
to prohibited certifications and State procurement. 6

 Article – State Finance and Procurement 8 
Section 13–212.2 and 13–228 9 
 Annotated Code of Maryland 10 
 (2021 Replacement Volume and 2024 Supplement) 11 
 
 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 12 
That the Laws of Maryland read as follows: 13 
 
Article – State Finance and Procurement 14 
 
13–212.2. 15 
 
 A PROCUREMENT OFFICER MAY NOT REQUIRE A BI DDER OR OFFEROR , AS A 16 
CONDITION TO SUBMITT ING A BID OR PROPOSA L ON A STATE PROCUREMENT , TO 17 
CERTIFY THAT THE BID DER OR OFFEROR , EXCEPT AS REQUIRED U NDER THIS 18 
ARTICLE OR UNDER FED ERAL LAW: 19 
 
 (1) IS NOT ENGAGING IN A BOYCOTT OF A FOREIGN COUNTRY ; OR  20 
 
 (2) WILL REFRAIN FROM A BOYCOTT OF A FOREIGN COUNTRY FOR 21 
THE DURATION OF THE CONTRACTUAL OB LIGATIONS.  22

 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 9 
October 1, 2025. 10
