BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 8 That the Laws of Maryland read as follows: 9 Article – Criminal Law 10 10–110. 11 (a) (1) In this section the following words have the meanings indicated. 12 (4) “Litter” means all rubbish, waste matter, refuse, garbage, trash, debris, 13 dead animals, or other discarded materials of every kind and description. 14 (c) A person may not: 15 (1) dispose of litter on a highway or perform an act that violates the State 16 Vehicle Laws regarding disposal of litter, glass, and other prohibited substances on 17 highways; or 18 (2) dispose or cause or allow the disposal of litter on public or private 19 property unless: 20 (i) the property is designated by the State, a unit of the State, or a 21 political subdivision of the State for the disposal of litter and the person is authorized by 22 the proper public authority to use the property; or 23 (ii) the litter is placed into a litter receptacle or container installed 24 on the property. 25 (f) (1) A person who violates this section is subject to the penalties provided 26 in this subsection. 27 (2) (i) A person who disposes of litter in violation of this section in an 28 amount not exceeding 100 pounds or 27 cubic feet and not for commercial gain is guilty of 29 a misdemeanor and on conviction is subject to imprisonment not exceeding 30 days or a 30 fine not exceeding $1,500 or both. 31 (ii) A person who disposes of litter in violation of this section in an 32 amount exceeding 100 pounds or 27 cubic feet, but not exceeding 500 pounds or 216 cubic 33 HOUSE BILL 1527 3 feet, and not for commercial gain is guilty of a misdemeanor and on conviction is subject to 1 imprisonment not exceeding 1 year or a fine not exceeding $12,500 or both. 2 (iii) A person who disposes of litter in violation of this section in an 3 amount exceeding 500 pounds or 216 cubic feet or in any amount for commercial gain is 4 guilty of a misdemeanor and on conviction is subject to imprisonment not exceeding 5 years 5 or a fine not exceeding $30,000 or both. 6 (h) A unit that supervises State property shall: 7 (1) establish and maintain receptacles for the disposal of litter at 8 appropriate locations where the public frequents the property; 9 (2) post signs directing persons to the receptacles and serving notice of the 10 provisions of this section; and 11 (3) otherwise publicize the availability of litter receptacles and the 12 requirements of this section. 13 (i) (1) Fines collected for violations of this section shall be disbursed: 14 (i) to the county or municipal corporation where the violation 15 occurred; or 16 (ii) if the bi–county unit is the enforcement unit and the violations 17 occurred on property over which the bi–county unit exercises jurisdiction, to the bi–county 18 unit. 19 (2) (I) Fines EXCEPT AS PROVIDED IN SUBPARAGRAPH (II) OF THIS 20 PARAGRAPH , FINES collected shall be used to pay for: 21 (I) litter receptacles and posting signs as required by subsection (h) 22 of this section and for other purposes relating to the removal or control of litter; AND. 23 (II) FINES COLLECTED IN PRINCE GEORGE’S COUNTY SHALL 24 BE USED TO PAY FOR : 25 1. MAINTENANCE COSTS AS SOCIATED WITH THE PI LOT 26 PROGRAM ESTABLISHED UNDER SUBSECTION (K) OF THIS SECTION; 27 2. LITTER RECEPTACLES A ND POSTING SIGNS THA T ARE 28 REQUIRED BY SUBSECTI ON (H) OF THIS SECTION AND FOR OTHER PURPOSES 29 RELATED TO THE REMOV AL OR CONTROL OF LITTER; 30 4 HOUSE BILL 1527 3. THE REMOVAL OR CONTR OL OF LITTER , LITTER 1 REMOVAL PROGRAMS , OVERSIGHT, AND OPERATIONS PERFO RMED BY THE UNIT 2 THAT SUPERVISES STATE PROPERTY ; AND 3 4. REWARDS TO MEMBERS O F THE PUBLIC WHO SUB MIT 4 VIDEO EVIDENCE THROU GH A PROGRAM ESTABLISHED UNDER SU BSECTION (K) OF 5 THIS SECTION. 6 (K) (1) EACH COUNTY SHALL THE GOVERNING BODY FO R PRINCE 7 GEORGE’S COUNTY MAY ESTABLISH A PILOT PROGRAM ALLOWING A M EMBER OF 8 THE PUBLIC TO: 9 (1) (I) SUBMIT VIDEO EVIDENC E OF AN ALLEGED VIOL ATION OF 10 THIS SECTION OCCURRING IN PRINCE GEORGE’S COUNTY TO AN ENFORCEMENT 11 UNIT WITH JURISDICTI ON; AND 12 (2) RECEIVE “HALF THE TOTAL AMOUN T” OF ANY FINES COLLECT ED 13 (II) RECEIVE HALF THE TOT AL AMOUNT OF ANY FINES 14 COLLECTED IN RELATION TO THE V IOLATION IF THE VIDE O EVIDENCE LEADS TO A 15 CONVICTION UNDER THI S SECTION. 16 (2) IF A PERSON FINED UND ER THIS SUBSECTION D OES NOT PAY THE 17 FINE, THE GOVERNING BODY O F PRINCE GEORGE’S COUNTY MAY REFER THE 18 AMOUNT OF THE UNPA ID OUTSTANDING FINE TO THE CENTRAL COLLECTION UNIT 19 OF THE DEPARTMENT OF BUDGET AND MANAGEMENT . 20 [(k)] (L) This section may be cited as the “Illegal Dumping and Litter Control 21 Law”. 22 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 23 October 1, 2025. This Act shall remain effective for a period of 5 years and, at the end of 24 September 30, 2030, this Act, with no further action required by the General Assembly, 25 shall be abrogated and of no further force and effect. 26
