BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 2 That the Laws of Maryland read as follows: 3 Article – Transportation 4 21–101. 5 (a) In this title and Title 25 of this article the following words have the meanings 6 indicated. 7 (c) “Bicycle path” means any travelway designed and designated by signing or 8 signing and marking for bicycle use, located within its own right–of–way or in a shared 9 right–of–way, and physically separated from motor vehicle traffic by berm, shoulder, curb, 10 or other similar device. 11 (e) “Bike lane” means any portion of a roadway or shoulder designated for single 12 directional bicycle flow. 13 21–1003. 14 (a) The provisions of this section apply except as necessary to avoid conflict with 15 other traffic or in compliance with law or the directions of a police officer or traffic control 16 device. 17 (ff) (1) A person convicted of a violation of subsection (j) of this section while 18 operating a commercial motor vehicle in Anne Arundel County is subject to: 19 (i) For a first offense, a fine of $100; 20 (ii) For a second offense, a fine of $250; and 21 (iii) For a third or subsequent offense, a fine of $500. 22 (2) A person convicted of a violation of subsection (u) or (dd) of this section 23 is subject to a fine of $25. 24 (3) A DRIVER OF A MOTOR VE HICLE IS SUBJECT TO A CIVIL PENALTY 25 NOT EXCEEDING $500 FOR A VIOLATION OF S UBSECTION (GG) OF THIS SECTION. 26 (GG) (1) THIS SUBSECTION DOES NOT APPLY TO: 27 (I) AN AUTHORIZED EMERGEN CY VEHICLE; 28 (II) A TRANSIT VEHICLE ; 29 HOUSE BILL 178 3 (III) A VEHICLE PICKING UP O R DISCHARGING INDIVI DUALS 1 WITH DISABILITIES; 2 (IV) A VEHICLE THAT HAS BEC OME UNINTENTIONALLY SO 3 DISABLED WHILE ON TH E HIGHWAY THAT THE D RIVER CANNOT AVOID S TOPPING 4 AND TEMPORARILY STAN DING OR PARKI NG THE VEHICLE ; OR 5 (V) A VEHICLE WHILE LOADIN G OR UNLOADING GOODS FOR 6 PICK–UP OR DELIVERY : 7 1. A. UNLESS A SHORTER PERI OD OF TIME IS 8 IMPOSED UNDER A LOCA L LAW, FOR A PERIOD OF TIME NOT EXCEEDING 30 9 MINUTES; AND 10 B. THAT IS DISPLAYING FL ASHING HAZARD WARNING 11 LIGHTS; OR 12 2. UNDER A LOCAL CURBSID E PARKING PERMIT . 13 (2) A PERSON MAY NOT STOP , STAND, OR PARK A VEHICLE IN A BIKE 14 LANE OR BICYCLE PATH . 15 SECTION 2.
