CHAPTER ______ AN ACT concerning 1 Motor Vehicles – Speed Monitoring Systems – Penalties 2 FOR the purpose of altering the penalties for a civil citation issued as a result of a recorded 3 image produced by a speed monitoring system; requiring the State Highway 4 Administration to convene a certain workgroup to study best practices regarding 5 speed monitoring systems in school zones; and generally relating to speed monitoring 6 systems. 7 BY repealing and reenacting, without amendments, 8 Article – Transportation 9 Section 21–809(a)(1) and (8) and (b)(1)(i) and (vi) 10 Annotated Code of Maryland 11 (2020 Replacement Volume and 2024 Supplement) 12 2 HOUSE BILL 182 BY repealing and reenacting, with amendments, 1 Article – Transportation 2 Section 21–809(c) 3 Annotated Code of Maryland 4 (2020 Replacement Volume and 2024 Supplement) 5 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 6 That the Laws of Maryland read as follows: 7 Article – Transportation 8 21–809. 9 (a) (1) In this section the following words have the meanings indicated. 10 (8) “Speed monitoring system” means a device with one or more motor 11 vehicle sensors producing recorded images of motor vehicles traveling at speeds at least 12 12 miles per hour above the posted speed limit. 13 (b) (1) (i) A speed monitoring system may not be used in a local jurisdiction 14 under this section unless its use is authorized by the governing body of the local jurisdiction 15 by local law enacted after reasonable notice and a public hearing. 16 (vi) This section applies to a violation of this subtitle recorded by a 17 speed monitoring system that meets the requirements of this subsection and has been 18 placed: 19 1. In Anne Arundel County, Montgomery County, or Prince 20 George’s County, on a highway in a residential district, as defined in § 21–101 of this title, 21 with a maximum posted speed limit of 35 miles per hour, which speed limit was established 22 using generally accepted traffic engineering practices; 23 2. In a school zone with a posted speed limit of at least 20 24 miles per hour; 25 3. In Prince George’s County: 26 A. Subject to subparagraph (vii)1 of this paragraph, on 27 Maryland Route 210 (Indian Head Highway); or 28 B. On that part of a highway located within the grounds of 29 an institution of higher education as defined in § 10–101(h) of the Education Article, or 30 within one–half mile of the grounds of a building or property used by the institution of 31 higher education where generally accepted traffic and engineering practices indicate that 32 motor vehicle, pedestrian, or bicycle traffic is substantially generated or influenced by the 33 institution of higher education; 34 HOUSE BILL 182 3 4. Subject to subparagraph (vii)2 of this paragraph, on 1 Interstate 83 in Baltimore City; 2 5. In Anne Arundel County, on Maryland Route 175 (Jessup 3 Road) between the Maryland Route 175/295 interchange and the Anne Arundel 4 County–Howard County line; or 5 6. Subject to subparagraph (vii)3 of this paragraph, at the 6 intersection of Maryland Route 333 (Oxford Road) and Bonfield Avenue in Talbot County. 7 (c) (1) Unless the driver of the motor vehicle received a citation from a police 8 officer at the time of the violation, the owner or, in accordance with subsection (f)(4) of this 9 section, the driver of a motor vehicle is subject to a civil penalty if the motor vehicle is 10 recorded by a speed monitoring system while being operated in violation of this subtitle. 11 (2) A civil penalty under this subsection [may not exceed $40] IS: 12 (I) IF THE CITATION ALLEG ES THAT THE DRIVER O F THE 13 MOTOR VEHICLE EXCEED ED THE SPEED LIMIT B Y BETWEEN 12 AND 15, INCLUSIVE, 14 MILES PER HOUR , $40 $50 $40; 15 (II) IF THE CITATION ALLEG ES THAT THE DRIVER O F THE 16 MOTOR VEHICLE EXCEED ED THE SPEED LIMIT B Y BETWEEN 16 AND 19, INCLUSIVE, 17 MILES PER HOUR , $55 $70; 18 (III) IF THE CITATION ALLEG ES THAT THE DRIVER O F THE 19 MOTOR VEHICLE EXCEED ED THE SPEED LIMIT B Y BETWEEN 20 AND 29, INCLUSIVE, 20 MILES PER HOUR , $95 $120; 21 (IV) IF THE CITATION ALLEG ES THAT THE DRIVER O F THE 22 MOTOR VEHICLE EXCEED ED THE SPEED LIMIT B Y BETWEEN 30 AND 39, INCLUSIVE, 23 MILES PER HOUR , $180 $230; AND 24 (V) IF THE CITATION ALLEG ES THAT THE DRIVER O F THE 25 MOTOR VEHICLE EXCEED ED THE SPEED LIMIT B Y 40 MILES PER HOUR OR MORE , 26 $350 $425. 27 (3) For purposes of this section, the District Court shall prescribe[: 28 (i) A] A uniform citation form consistent with subsection (d)(1) of 29 this section and § 7–302 of the Courts Article[; and 30 (ii) A civil penalty, which shall be indicated on the citation, to be paid 31 by persons who choose to prepay the civil penalty without appearing in District Court]. 32 4 HOUSE BILL 182 SECTION 2. AND BE IT FURTHER ENACTED, That: 1 (a) The State Highway Administration shall convene a workgroup to study best 2 practices regarding speed monitoring systems in school zones. 3 (b) The study of the workgroup shall: 4 (1) include relevant local education stakeholders, including local 5 governments, local law enforcement, and any other participants necessary to fully 6 represent the interests of student pedestrians in school zones; 7 (2) assess: 8 (i) the existing policies regarding speed monitoring systems in 9 school zones; 10 (ii) whether the current radius in which speed monitoring systems 11 are allowed in school zones is consistent with best practices; 12 (iii) the annual number of serious traffic incidents that occur within 13 the current radius in which speed monitoring systems are allowed in school zones, by 14 jurisdiction; 15 (iv) the number of speed monitoring systems currently located within 16 the current radius in which speed monitoring systems are allowed in school zones, by 17 jurisdiction; 18 (v) the average distance that each speed monitoring system within 19 a school zone is located from the property line of the school with which it is associated, by 20 county; and 21 (vi) any other best practices regarding the use of speed monitoring 22 systems in school zones. 23 (c) On or before December 1, 2025, the State Highway Administration shall 24 submit the findings and any recommendations of the study to the Governor and, in 25 accordance with § 2–1257 of the State Government Article, the General Assembly. 26 SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect 27 October 1, 2025. 28
