CHAPTER ______ AN ACT concerning 1 Therapeutic Child Care Grant Program – Funding – Alterations 2 FOR the purpose of altering the fiscal years during which the Governor is required to 3 include in the annual budget bill a certain appropriation to the Therapeutic Child 4 Care Grant Program; repealing specific distributions to providers under the 5 Program; and generally relating to funding for the Therapeutic Child Care Grant 6 Program. 7 BY repealing and reenacting, without amendments, 8 Article – Education 9 Section 8–420(a) through (c) 10 Annotated Code of Maryland 11 (2022 Replacement Volume and 2024 Supplement) 12 2 HOUSE BILL 185 BY repealing and reenacting, with amendments, 1 Article – Education 2 Section 8–420(d) 3 Annotated Code of Maryland 4 (2022 Replacement Volume and 2024 Supplement) 5 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBL Y OF MARYLAND, 6 That the Laws of Maryland read as follows: 7 Article – Education 8 8–420. 9 (a) (1) In this section the following words have the meanings indicated. 10 (2) “Developmental delays, physical disabilities, or delays in social, 11 emotional, or behavioral functioning” means: 12 (i) A significant developmental delay or atypical development, as 13 identified by a health professional, in: 14 1. Cognitive development; 15 2. Physical development; 16 3. Language and speech development; 17 4. Psychosocial development; or 18 5. Self–help skills; 19 (ii) Psychological trauma, as identified through an evaluation by a 20 mental health professional; or 21 (iii) A diagnosed physical, developmental, or mental health condition 22 that impacts daily living and limits participation in typical early childhood education or 23 child care settings. 24 (3) “Program” means the Therapeutic Child Care Grant Program. 25 (b) There is a Therapeutic Child Care Grant Program in the State. 26 (c) (1) The purpose of the Program is to provide grants to providers that 27 specialize in providing child care and early childhood education to children under the age 28 of 6 years who have developmental delays, physical disabilities, or delays in social, 29 emotional, or behavioral functioning. 30 HOUSE BILL 185 3 (2) The Department shall administer the Program. 1 (3) On or before August 15 each year, the Department shall award grants 2 under this section. 3 (d) (1) For each of fiscal years 2023 through 2025, AND FOR EACH OF FISC AL 4 YEARS 2027 THROUGH 2029, AND FOR FISCAL YEAR 2027 AND EACH FISCAL YEAR 5 THEREAFTER , the Governor shall include in the annual budget bill an appropriation of 6 $3,700,000 to the Program. 7 (2) In awarding grants under the Program, the Department shall 8 distribute: 9 (i) $1,283,000 to existing providers in the same amount as was 10 provided in fiscal year 2022; 11 (ii) $1,917,000 to existing providers in the same proportion as was 12 provided in fiscal year 2022 to provide additional services; and 13 (iii) Except as provided in paragraph (3) of this subsection, $500,000 14 to new providers or existing providers to enroll additional children. 15 (3) If funds are remaining after the distribution required under paragraph 16 (2)(iii) of this subsection, then the remainder shall be distributed as provided under 17 paragraph (2)(ii) of this subsection FOR EACH OF FISCAL YE ARS 2027 THROUGH 2029, 18 THE GOVERNOR SHALL INCLUD E IN THE ANNUAL BUDG ET BILL AN APPROPRIA TION 19 OF $1,500,000 TO THE PROGRAM. 20 (2) In awarding grants under the Program, the Department shall distribute: 21 (i) $1,283,000 to existing providers in the same amount as was 22 provided in fiscal year 2022; 23 (ii) $1,917,000 to existing providers in the same proportion as was 24 provided in fiscal year 2022 to provide additional services; and 25 (iii) Except as provided in paragraph (3) of this subsection, $500,000 26 to new providers or existing providers to enroll additional children. 27 (3) If funds are remaining after the distribution required under paragraph 28 (2)(iii) of this subsection, then the remainder shall be distributed as provided under 29 paragraph (2)(ii) of this subsection. 30 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 31 1, 2025. 32
