113113 the limits established for non–Medicare–eligible retirees in § 2–508(d)(2)(iii) of this 11

116116 (ii) The Department may establish an out–of–pocket limit higher 13
117117 than the limits established in subparagraph (i) of this paragraph for a retiree who qualifies 14
118118 for a partial State subsidy. 15

121121 established under paragraph (2) of this subsection may include: 17

229229 (g) (1) Subject to paragraph (2) of this subsection, not later than July 1 of each 23
230230 year, the Secretary shall provide written certified notice of the change in the State 24
231231 prescription drug benefit plan under this section to the individuals who will become eligible 25
232232 in the next calendar year to enroll in the: 26

234234 (i) Maryland State Retiree Prescription Drug Coverage Program; 27

247247 benefit plan, including options that are similar to the prescription drug benefit plan in the 2

251251 promptly choose a Medicare prescription drug benefit plan immediately on termination of 5
252252 the individual’s participation in the State prescription drug benefit plan; 6

254254 (iii) the programs available under subsections (d), (e), and (f) of this 7

260260 (h) (1) The Department shall ensure Medicare–eligible retirees have access to 11
261261 one–on–one counseling services to assist retirees in selecting a Medicare prescription drug 12
262262 benefit plan. 13

264264 (2) The Department shall develop a plan to communicate to 14
265265 Medicare–eligible retirees the availability of: 15

267267 (i) the programs under subsections (d), (e), and (f) of this section; 16

270270 (ii) services and information regarding prescription drug benefit 18
271271 plans under Medicare. 19

273273 (3) On or before December 31, 2019, the Department shall submit a report 20
274274 to the Senate Budget and Taxation Committee and the House Appropriations Committee, 21
275275 in accordance with § 2–1257 of the State Government Article, on the plan developed under 22
276276 paragraph (2) of this subsection. 23

278278 (4) The report required under paragraph (3) of this subsection shall 24

312312 Article, the Department may make an emergency procurement for: 12

314314 (1) staff required to carry out the provisions of this section; and 13

316316 (2) a third party to administer health reimbursement accounts established 14

319319 (j) The Department shall submit quarterly reports to the Governor and, in 16
320320 accordance with § 2–1257 of the State Government Article, the House Appropriations 17
321321 Committee, the Senate Budget and Taxation Committee, and the Joint Committee on 18

324324 (1) the status of establishing the programs under subsections (d), (e), and 20
