5252 (b) The Department shall provide health care services for individuals under the 1

5757 (1) Limit eligibility to receive EID Program services based on: 4

5959 (i) The earned or unearned income of the applicant or the 5

6262 (ii) Any assets or resources of the applicant’s or recipient’s spouse 7

6565 (iii) Any retirement account assets or resources for an applicant or a 9

6969 for a recipient of EID Program services; [or] 12

7171 (2) Establish as a prerequisite for eligibility to receive EID Program 13
7272 services that an applicant apply for Social Security Disability Insurance benefits when the 14
7373 applicant does not receive the benefits and has earnings that are above the substantial 15
7474 gainful activity level established by the Social Security Administration; OR 16
