AN ACT concerning 1 
 
Frederick County – County Employees and Volunteers – Criminal History 2 
Records Check 3 
 
FOR the purpose of authorizing the Director of Human Resources of Frederick County to 4 
request in a certain manner a State and national criminal history records check for 5 
a prospective or current county employee or county volunteer; requiring the Central 6 
Repository to forward certain information to certain persons; specifying that 7 
information obtained from the Central Repository under this Act is confidential, may 8 
not be redisseminated, and may be used only for certain purposes; authorizing the 9 
subject of a criminal history records check to contest the contents of a certain 10 
statement in a certain manner; and generally relating to criminal history records 11 
checks for current or prospective county employees and county volunteers of 12 
Frederick County. 13

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 19 
That the Laws of Maryland read as follows: 20

 (A) IN THIS SECTION , “CENTRAL REPOSITORY” MEANS THE CRIMINAL 23 
JUSTICE INFORMATION SYSTEM CENTRAL REPOSITORY OF THE DEPARTMENT OF 24 
PUBLIC SAFETY AND CORRECTIONAL SERVICES. 25  2 	HOUSE BILL 492  
 
 
 
 (B) THE DIRECTOR OF HUMAN RESOURCES OF FREDERICK COUNTY MAY 1 
REQUEST FROM THE CENTRAL REPOSITORY A STATE AND NATIONAL CR IMINAL 2 
HISTORY RECORDS CHECK FOR A PROSPECTIVE OR CURRE NT EMPLOYEE OR 3 
VOLUNTEER OF FREDERICK COUNTY. 4 
 
 (C) (1) AS PART OF THE APPLIC ATION FOR A CRIMINAL HISTORY 5 
RECORDS CHECK , THE DIRECTOR OF HUMAN RESOURCES OF FREDERICK COUNTY 6 
SHALL SUBMIT TO THE CENTRAL REPOSITORY: 7 
 
 (I) TWO COMPLETE SETS OF THE PROSPECTIVE OR C URRENT 8 
EMPLOYEE’S OR VOLUNTEER ’S LEGIBLE FINGERPRIN TS TAKEN ON FORMS 9 
APPROVED BY THE DIRECTOR OF THE CENTRAL REPOSITORY AND THE DIRECTOR 10 
OF THE FEDERAL BUREAU OF INVESTIGATION ; 11 
 
 (II) THE FEE AUTHORIZED U NDER § 10–221(B)(7) OF THIS 12 
SUBTITLE FOR ACCESS TO MARYLAND CRIMINAL HIS TORY RECORDS ; AND 13 
 
 (III) THE MANDATORY PROCES SING FEE REQUIRED BY THE 14 
FEDERAL BUREAU OF INVESTIGATION FOR A N ATIONAL CRIMINAL HIS TORY 15 
RECORDS CHECK . 16 
 
 (2) IN ACCORDANCE WITH §§ 10–201 THROUGH 10–250 OF THIS 17 
SUBTITLE, THE CENTRAL REPOSITORY SHALL FORW ARD TO THE PROSPECTI VE OR 18 
CURRENT EMPLOYEE OR VOLUNTEER AND THE DIRECTOR OF HUMAN RESOURCES 19 
OF FREDERICK COUNTY THE PROSPECTIVE OR C URRENT EMPLOYEE ’S OR 20 
VOLUNTEER ’S CRIMINAL HISTORY R ECORD INFORMATION . 21 
 
 (3) INFORMATION OBTAINED FROM THE CENTRAL REPOSITORY 22 
UNDER THIS SECTION : 23 
 
 (I) IS CONFIDENTIAL AND MAY NOT BE REDISSEMI NATED; AND 24 
 
 (II) MAY BE USED ONLY FOR A PERSONNEL –RELATED PURPOSE 25 
CONCERNING THE PROSPECTIVE OR CURRE NT EMPLOYEE OR VOLUN TEER OF THE 26 
COUNTY AS AUTHORIZED BY THIS SECTION. 27 
 
 (4) THE SUBJECT OF A CRIM INAL HISTORY RECORDS CHECK UNDER 28 
THIS SECTION MAY CON TEST THE CONTENTS OF THE PRINTED STATEMEN T ISSUED 29 
BY THE CENTRAL REPOSITORY AS PROVI DED IN § 10–223 OF THIS SUBTITLE. 30 
 
 (D) THE GOVERNING BODY OF FREDERICK COUNTY SHALL ADOPT 31 
GUIDELINES TO CARRY OUT THIS SECTION . 32   	HOUSE BILL 492 	3 
 
 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 1 
October 1, 2025. 2
