AN ACT concerning 1 
 
Department of Human Services – Federal Commodity Supplemental Food 2 
Program – Administration 3 
 
FOR the purpose of requiring the Family Investment Administration in the Department of 4 
Human Services to be the central coordinating and directing agency of the federal 5 
Commodity Supplemental Food Program using certain funds and resources; 6 
repealing the requirement that the Secretary of Aging administer the Program; and 7 
generally relating to the federal Commodity Supplemental Food Program. 8 
 
BY repealing and reenacting, with amendments, 9 
 Article – Human Services 10 
Section 5–205(a) and 10–204(a) 11 
 Annotated Code of Maryland 12 
 (2019 Replacement Volume and 2024 Supplement) 13 
 
 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 14 
That the Laws of Maryland read as follows: 15 
 
Article – Human Services 16 
 
5–205. 17 
 
 (a) The Administration shall be the central coordinating and directing agency of 18 
all public assistance programs in the State, including: 19  2 	HOUSE BILL 538  
 
 
 
 (1) the Family Investment Program and related cash benefit programs; 1 
 
 (2) public assistance to adults; 2 
 
 (3) emergency assistance; 3 
 
 (4) food stamps; 4 
 
 (5) medical assistance eligibility determinations; 5 
 
 (6) the Energy Assistance Program; 6 
 
 (7) the Temporary Disability Assistance Program; [and] 7 
 
 (8) THE FEDERAL COMMODITY SUPPLEMENTAL FOOD PROGRAM 8 
WITH FUNDS AND RESOU RCES RECEIVED FROM T HE UNITED STATES DEPARTMENT 9 
OF AGRICULTURE UNDER 7 C.F.R. 247; AND 10 
 
 [(8)] (9) any other public assistance activities financed wholly or partly 11 
by the Administration. 12

 (a) The Secretary shall administer[: 14 
 
 (1)] the programs and activities that the federal government delegates to 15 
the State under the Older Americans Act of 1965 that are not otherwise committed by law 16 
to another unit of State government[; and 17 
 
 (2) the federal Commodity Supplemental Food Program with funds and 18 
resources received from the United States Department of Agriculture under 7 C.F.R. 247]. 19 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 20 
October 1, 2025. 21
