CHAPTER ______ AN ACT concerning 1 Procurement – Public Work Contracts – Data Dashboard 2 (Maryland Public Works and Apprenticeship Transparency Act) 3 Workgroup on the Creation of a Data Dashboard for Public Work Contracts and 4 Apprentices – Establishment 5 FOR the purpose of requiring the Commissioner of Labor and Industry to develop and 6 maintain a data dashboard that includes certain information relating to contractors, 7 subcontractors, employees, and apprentices working under public work contracts; 8 requiring each contractor who is contracted under a public work contract to provide 9 certain information to the Commissioner; requiring the Commissioner to update the 10 data dashboard on a certain basis, post the data dashboard on the Maryland 11 2 HOUSE BILL 850 Department of Labor website, and maintain a certain cache; and generally relating 1 to public work contracts establishing the Workgroup on the Creation of a Data 2 Dashboard for Public Work Contracts and Apprentices to study the most efficient 3 and cost–effective method to create a publicly available data dashboard that 4 disaggregates information regarding public work contracts with the State and 5 apprentices working under the public work contracts; and generally relating to the 6 Workgroup on the Creation of a Data Dashboard for Public Work Contracts and 7 Apprentices. 8 BY adding to 9 Article – State Finance and Procurement 10 Section 17–206 11 Annotated Code of Maryland 12 (2021 Replacement Volume and 2024 Supplement) 13 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 14 That the Laws of Maryland read as follows: 15 (a) There is a Workgroup on the Creation of a Data Dashboard for Public Work 16 Contracts and Apprentices. 17 (b) The Workgroup consists of the following members: 18 (1) three members of the Senate of Maryland, appointed by the President 19 of the Senate; 20 (2) three members of the House of Delegates, appointed by the Speaker of 21 the House; 22 (3) the Secretary of Labor, or the Secretary’s designee; 23 (4) the Commissioner of Labor and Industry, or the Commissioner’s 24 designee; and 25 (5) the following members, appointed by the Governor: 26 (i) one representative of the Baltimore–DC Building Trades 27 Council, selected by the President of the Council; 28 (ii) one representative of the Mid–Atlantic Pipe Trades Association; 29 and 30 (iii) one representative who is an attorney and a member of 31 Steamfitters Union Local 602; 32 (iv) one representative of the Associated Builders and Contractors of 33 Maryland (ABC); 34 HOUSE BILL 850 3 (v) one representative of the Independent Electrical Contractors 1 (IEC) Chesapeake; and 2 (vi) one representative of the Maryland Minority Contractors 3 Association (MMCA). 4 (c) The President of the Senate and the Speaker of the House shall designate the 5 co–chairs of the Workgroup. 6 (d) The Commissioner of Labor and Industry shall provide staff for the 7 Workgroup. 8 (e) A member of the Workgroup: 9 (1) may not receive compensation as a member of the Workgroup; but 10 (2) is entitled to reimbursement for expenses under the Standard State 11 Travel Regulations, as provided in the State budget. 12 (f) At the first meeting of the Workgroup that occurs on or after July 1, 2025, the 13 Workgroup shall vote to adopt a code of conduct providing for the acceptable conduct of 14 Workgroup members. 15 (g) The Workgroup shall: 16 (1) study the most efficient and cost–effective method to create a publicly 17 available data dashboard that disaggregates information regarding public work contracts 18 with the State, including information on: 19 (i) the name of each contractor and subcontractor working under a 20 public work contract; 21 (ii) wages, including overtime wages, and benefits paid to each 22 employee of a contractor or subcontractor working under a public work contract; 23 (iii) the job classification of each employee employed by a contractor 24 or subcontractor working under a public work contract; 25 (iv) apprentices working under each contractor and subcontractor for 26 public works contracts, including: 27 1. the number of apprentices employed; 28 2. demographic information for each apprentice; 29 4 HOUSE BILL 850 3. the date each apprentice registered with the Maryland 1 Department of Labor; 2 4. the trade practiced by each apprentice; and 3 5. the certification status of each apprentice; and 4 (v) each apprenticeship program sponsored by each contractor or 5 subcontractor working under a public work contract; and 6 (2) make recommendations regarding: 7 (i) where the data dashboard shall be located; 8 (ii) necessary costs associated with the development and 9 maintenance of the data dashboard; and 10 (iii) time frames during which the data dashboard can be developed 11 and implemented and the frequency with which the information in the data dashboard can 12 be updated. 13 (h) On or before January 7, 2027, the Workgroup shall report its findings and 14 recommendations to the Governor and, in accordance with § 2 –1257 of the State 15 Government Article, the General Assembly. 16 Article – State Finance and Procurement 17 17–206. 18 (A) THE COMMISSIONER SHALL DE VELOP A CLEAR AND 19 EASY–TO–UNDERSTAND GRAPHIC D ATA DASHBOARD THAT I NCLUDES, FOR EACH 20 ONGOING PUBLIC WORK CONTRACT: 21 (1) THE NAME OF EACH CON TRACTOR AND SUBCONTR ACTOR 22 WORKING UNDER THE PUBLIC WORK CONTRACT ; 23 (2) THE FOLLOWING INFORM ATION REGARDING THE EMPLOYEES OF 24 EACH CONTRACTOR AND SUBCONTRACTOR WORKIN G UNDER THE PUBLIC W ORK 25 CONTRACT: 26 (I) THE PREVAILING WAGE RATES PAID BY EACH C ONTRACTOR 27 OR SUBCONTRACTOR ; 28 (II) THE NUMBER OF EMPLOYEES EMPLOYED B Y EACH 29 CONTRACTOR OR SUBCON TRACTOR; 30 HOUSE BILL 850 5 (III) THE REGULAR WAGES AN D OVERTIME WAGES PAI D BY THE 1 CONTRACTOR OR SUBCON TRACTOR; 2 (IV) ANY FRINGE BENEFITS PROVIDED TO EMPLOYEE S BY THE 3 CONTRACTOR OR SUBCON TRACTOR; 10 (II) THE TRADE PRACTICED BY EACH AP PRENTICE WORKING 11 FOR EACH CONTRACTOR OR SUBCONTRACTOR ; 12 (III) THE CERTIFICATION ST ATUS OF EACH APPRENT ICE 13 WORKING FOR EACH CON TRACTOR OR SUBCONTRA CTOR; 14 (IV) CONTACT INFORMATION FOR EACH APPRENTICES HIP 15 PROGRAM SPONSOR ; 16 (V) DEMOGRAPHIC DATA FOR EACH APPRENTICE WORK ING FOR 17 EACH CONTRACTOR OR S UBCONTRACTOR ; AND 18 (VI) THE DATE EACH APPREN TICE REGISTERED WITH THE 19 MARYLAND DEPARTMENT OF LABOR. 20 (B) EACH CONTRACTOR WHO I S CONTRACTED UNDER A PUBLIC WORK 21 CONTRACT SHALL PROVI DE THE COMMISSIONER WITH THE INFORMATION LISTED 22 UNDER SUBSECTION (A) OF THIS SECTION ONCE A WEEK. 23 (C) THE COMMISSIONER SHALL : 24 (1) UPDATE THE DATA DASH BOARD DEVELOPED UNDE R SUBSECTION 25 (A) OF THIS SECTION AT L EAST ONCE A MONTH ; 26 (2) POST THE MOST RECENT LY UPDATED DATA DASHBOA RD 27 PROMINENTLY ON THE MARYLAND DEPARTMENT OF LABOR WEBSITE ; AND 28 (3) MAINTAIN A CACHE CON TAINING THE INFORMAT ION POSTED ON 29 THE DATA DASHBOARD F OR AT LEAST THE IMME DIATELY PRECEDING 24 MONTHS. 30 6 HOUSE BILL 850 (D) THE COMMISSIONER MAY ADOP T REGULATIO NS TO CARRY OUT THIS 1 SECTION. 2 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 3 October 1, 2025. 4 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 5 1, 2025.
