[Brackets] indicate matter deleted from existing law. *hb0873* HOUSE BILL 873 E3 5lr2103 By: Delegate Rosenberg Introduced and read first time: January 30, 2025 Assigned to: Judiciary A BILL ENTITLED AN ACT concerning 1 Juvenile Law – Juvenile Court Jurisdiction – Theft of a Motor Vehicle 2 FOR the purpose of altering the jurisdiction of the juvenile court over a child of a certain 3 age alleged to have committed theft of a motor vehicle under certain circumstances; 4 and generally relating to juvenile court jurisdiction. 5 BY repealing and reenacting, with amendments, 6 Article – Courts and Judicial Proceedings 7 Section 3–8A–03(a) 8 Annotated Code of Maryland 9 (2020 Replacement Volume and 2024 Supplement) 10 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 11 That the Laws of Maryland read as follows: 12 Article – Courts and Judicial Proceedings 13 3–8A–03. 14 (a) In addition to the jurisdiction specified in Subtitle 8 of this title, the court has 15 exclusive original jurisdiction over: 16 (1) A child: 17 (i) Who is at least 13 years old alleged to be delinquent; or 18 (ii) Except as provided in subsection (d) of this section, who is at least 19 10 years old alleged to have committed an act: 20 1. That, if committed by an adult, would constitute: 21 2 HOUSE BILL 873 A. A crime of violence, as defined in § 14–101 of the Criminal 1 Law Article; 2 B. A crime involving handguns under § 4–203 or § 4–204 of 3 the Criminal Law Article; 4 C. A crime involving firearms under § 5–133, § 5–134, § 5 5–138, § 5–142, § 5–203, or § 5–703 of the Public Safety Article; 6 D. Aggravated cruelty to animals under § 10–606 of the 7 Criminal Law Article; [or] 8 E. Sexual offense in the third degree under § 3–307 of the 9 Criminal Law Article; or 10 F. THEFT OF A MOTOR VEHI CLE UNDER § 7–105 OF THE 11 CRIMINAL LAW ARTICLE, IF THE CHILD HAS PRE VIOUSLY BEEN REFERRE D TO AN 12 AT–RISK YOUTH PREVENTIO N AND DIVERSION PROG RAM, AS DEFINED IN § 8–601 OF 13 THE HUMAN SERVICES ARTICLE, FOR A VIOLATION OF § 4–203, § 4–204, OR § 7–105 14 OF THE CRIMINAL LAW ARTICLE OR § 5–133, § 5–134, § 5–138, § 5–142, § 5–203, OR 15 § 5–703 OF THE PUBLIC SAFETY ARTICLE; OR 16 2. Arising out of the same incident as an act listed in item 1 17 of this item; 18 (2) A child who is in need of supervision; 19 (3) A child who has received a citation for a violation; 20 (4) Except as provided in subsection (d)(6) of this section, a peace order 21 proceeding in which the respondent is a child; and 22 (5) Proceedings arising under the Interstate Compact on Juveniles. 23 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 24 October 1, 2025. 25
