Lewis, Miller, Pasteur, Patterson, Pena–Melnyk, Ruth, Spiegel, Taveras, Terrasa, and Wolek Introduced and read first time: January 31, 2025 Assigned to: Appropriations A BILL ENTITLED AN ACT concerning 1 Institutions of Higher Education – Instructor Training – Accommodations for 2 Students With Disabilities 3 FOR the purpose of requiring certain institutions of higher education to provide instructors 4 with certain training on institutional obligations toward students with disabilities 5 under certain federal laws; requiring the Maryland Higher Education Commission 6 to develop a certain model training program; and generally relating to instructor 7 training on accommodations for students with disabilities and institutions of higher 8 education. 9 BY adding to 10 Article – Education 11 Section 11–409 12 Annotated Code of Maryland 13 (2022 Replacement Volume and 2024 Supplement) 14 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 15 That the Laws of Maryland read as follows: 16 Article – Education 17 11–409. 18 (A) IN THIS SECTION, “INSTRUCTOR” MEANS AN INDIVIDUAL EMPLOYED BY 19 OR UNDER CONTRACT WITH AN INSTITUTION OF HIGHER EDUCATION : 20 (1) AS A TENURED OR NONTENURED PROFESSOR , AN INSTRUCTOR, 21 OR A TEACHING ASSISTANT ; OR 22 2 HOUSE BILL 912 (2) TO PROVIDE DIRECT INSTR UCTION TO STUDENTS . 1 (B) THIS SECTION DOES NOT APPLY TO AN INSTITUT ION OF HIGHER 2 EDUCATION THAT HAS A N EXISTING TRAINING ON THE LEGAL OBLIGAT IONS OF THE 3 INSTITUTION TOWARD S TUDENTS WITH DISABIL ITIES UNDER THE FEDE RAL 4 AMERICANS WITH DISABILITIES ACT AND SECTION 504 OF THE REHABILITATION 5 ACT THAT MEETS THE ST ANDARDS REQUIRED UND ER SUBSECTION (C) OF THIS 6 SECTION. 7 (C) (1) BEGINNING IN THE 2026–2027 ACADEMIC YEAR , EACH 8 INSTITUTION OF HIGHE R EDUCATION SHALL PR OVIDE TO INSTRUCTORS OF TH E 9 INSTITUTION TRAINING ON THE LEGAL OBLIGATION S OF THE INSTITUTION TOWARD 10 STUDENTS WITH DISABI LITIES UNDER THE FED ERAL AMERICANS WITH 11 DISABILITIES ACT AND SECTION 504 OF THE REHABILITATION ACT, INCLUDING 12 INFORMATION ON ACADE MIC ACCOMMODATIONS A ND ADJUSTMENTS FOR 13 QUALIFIED STUDENTS . 14 (2) THE TRAINING REQ UIRED UNDER PARAGRAP H (1) OF THIS 15 SUBSECTION SHALL BE: 16 (I) PROVIDED T O INSTRUCTORS BY THE INSTITUTION O F 17 HIGHER EDUCATION IN PERSON OR VIRTUALLY ; AND 18 (II) PROVIDED TO AND COMPLETED BY : 19 1. A NEW INSTRUCTOR BEFORE TH E INSTRUCTOR 20 BEGINS TEACHING STUD ENTS; AND 21 2. A CURRENTLY EMPLOYED INSTRUCTOR ON OR 22 BEFORE OCTOBER 1, 2026. 23 (D) THE COMMISSION SHALL DEVELOP A MODEL TRAINING PROGRAM FOR 24 THE INFORMATION REQU IRED UNDER SUBSECTIO N (C) OF THIS SECTION THAT MAY 25 BE USED BY INSTITUTIONS OF HIGHER EDUCATION THROUGHOUT THE STATE. 26 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 27 1, 2025. 28
