AN ACT concerning 1 
 
State Employees – Colleague Bereavement Leave 2 
 
FOR the purpose of providing that certain State employees are entitled to a certain amount 3 
of colleague bereavement leave with pay under certain circumstances; prohibiting 4 
certain State entities from requiring certain State employees to use certain paid 5 
leave under certain circumstances; and generally relating to colleague bereavement 6 
leave for State employees.  7 
 
BY repealing and reenacting, without amendments, 8

Section 9–1101 10

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 18 
That the Laws of Maryland read as follows: 19 
 
Article – State Personnel and Pensions 20

 Except as otherwise provided in this subtitle, this subtitle applies to all employees 22 
in the State Personnel Management System, except temporary employees. 23

 (A) THIS SECTION APPLIES TO ALL EMPLOYEES , INCLUDING TEMPORARY 2 
EMPLOYEES, IN THE EXECUTIVE, JUDICIAL, AND LEGISLATIVE BRANCHES OF 3 
STATE GOVERNMENT , INCLUDING ANY UNIT W ITH AN INDEPENDENT P ERSONNEL 4 
SYSTEM.  5 
 
 (B) AN EMPLOYEE SUBJECT T O THIS SECTION IS EN TITLED TO COLLEAGUE 6 
BEREAVEMENT LEAVE WITH PAY.  7 
 
 (C) (1) SUBJECT TO PARAGRAPH (2) OF THIS SUBSECTION , AN EMPLOYEE 8 
MAY USE UP TO 5 DAYS OF COLLEAGUE BEREAVEMENT LEAVE IMMEDIATELY 9 
FOLLOWING THE DEATH OF A COLLEAGUE WHO IS EMPLOYED BY THE S AME AGENCY 10 
AS THE EMPLOYEE IF: 11 
 
 (I) THE COLLEAGUE’S DEATH OCCURS ON THE JOB; AND 12 
 
 (II) THE EMPLOYEE WORKS I N CLOSE PROXIMITY TO THE 13 
COLLEAGUE WHO DIED. 14 
 
 (2) AN EMPLOYEE MAY USE COLLEAGUE BEREAVEMENT LEAVE ON LY 15 
AFTER NOTIFYING THE EMPLOYEE’S APPOINTING AUTHORI TY OF THE EMPLOYEE ’S 16 
INTENTION TO USE CO LLEAGUE BEREAVEMENT LEAVE .  17 
 
 (3) AN EMPLOYEE ’S APPOINTING AUTHORI TY MAY NOT REQUIRE A N 18 
EMPLOYEE ENTITLED TO USE CO LLEAGUE BEREAVEMENT LEAVE UNDER 19 
PARAGRAPH (1) OF THIS SUBSECTION T O USE ANY OTHER PAID LEAVE AVAILABLE 20 
TO THE EMPLOYEE . 21 
 
 (D) THE SECRETARY SHALL ADOPT REGULATION S GOVERNING CO LLEAGUE 22 
BEREAVEMENT LEAVE .  23 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 24 
October 1, 2025. 25
