29 | 29 | | SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 11 |

32 | 32 | | (a) In this section, “artificial intelligence” means a machine–based system that: 13 |
---|
33 | 33 | | |
---|
34 | 34 | | (1) can, for a given set of human–defined objectives, make predictions, 14 |
---|
35 | 35 | | recommendations, or decisions influencing real or virtual environments; 15 |
---|
36 | 36 | | |
---|
37 | 37 | | (2) uses machine and human–based inputs to perceive real and virtual 16 |
---|
38 | 38 | | environments and abstracts those perceptions into models through analysis in an 17 |
---|
39 | 39 | | automated manner; and 18 |
---|
40 | 40 | | |
---|
41 | 41 | | (3) uses model inference to formulate options for information or action. 19 |
---|

---|
43 | 43 | | (b) The State Department of Education shall conduct an evaluation of the use and 20 |
---|
44 | 44 | | potential use of artificial intelligence in public schools. 21 |

46 | 46 | | (c) (1) In conducting its evaluation, the State Department of Education shall 22 |
---|
47 | 47 | | create a survey for local school systems that assesses: 23 |

55 | 55 | | (ii) whether the local school system has a policy for the use of 4 |

56 | 56 | | artificial intelligence as part of curricula, teaching materials, or lessons; 5 |

---|
58 | 58 | | (iii) whether the local school system or any school within the school 6 |
---|
59 | 59 | | system currently uses a system that makes use of artificial intelligence to assist with 7 |
---|
60 | 60 | | student learning and, if so, which system is used and whether the system has been effective; 8 |

62 | 62 | | (iv) whether the local school system is adequately prepared for the 9 |
---|
63 | 63 | | use of artificial intelligence, including whether the school system currently has in place: 10 |
---|

65 | 65 | | 1. sufficient technological infrastructure; 11 |
---|
66 | 66 | | |
---|
67 | 67 | | 2. staff capacity to implement artificial intelligence systems 12 |
---|
68 | 68 | | to assist with student learning; and 13 |
---|

---|
70 | 70 | | 3. plans to address specific student needs using artificial 14 |
---|
71 | 71 | | intelligence; 15 |
---|

---|
73 | 73 | | (v) the local school system’s identification and assessment of the 16 |
---|
74 | 74 | | most commonly used artificial intelligence systems in education; and 17 |
---|

---|
76 | 76 | | (vi) how the State Department of Education could best assist the 18 |
---|
77 | 77 | | local school system in its use of artificial intelligence to meet staff and student needs. 19 |
---|

79 | 79 | | (2) On or before August 1, 2025, the State Department of Education shall 20 |
---|
80 | 80 | | distribute the survey required under this subsection to each county board of education, 21 |
---|
81 | 81 | | including Baltimore City. 22 |
---|

---|
83 | 83 | | (3) On or before October 1, 2025, each county board of education, including 23 |
---|
84 | 84 | | Baltimore City, shall return a completed survey to the State Department of Education. 24 |
---|

---|
86 | 86 | | (d) (1) In addition to the survey required under subsection (c) of this section, 25 |
---|
87 | 87 | | the State Department of Education’s evaluation shall include a review of available systems 26 |
---|
88 | 88 | | that use artificial intelligence to: 27 |
---|
89 | 89 | | |
---|
90 | 90 | | (i) assist with student learning; 28 |
---|
91 | 91 | | |
---|
92 | 92 | | (ii) aid in the creation of curricula, lesson plans, and teaching 29 |
---|
93 | 93 | | material; 30 |
---|

---|
95 | 95 | | (iii) help with the evaluation of student work; and 31 |

102 | 102 | | (2) In completing its review of available artificial intelligence systems, the 3 |
---|
103 | 103 | | State Department of Education shall analyze the pedagogical value of available artificial 4 |
---|
104 | 104 | | intelligence systems and administrative aspects with which the artificial intelligence 5 |
---|
105 | 105 | | systems are able to assist. 6 |
---|

107 | 107 | | (3) (i) The Department of Information Technology shall assist the State 7 |
---|
108 | 108 | | Department of Education in completing the review of artificial intelligence systems 8 |
---|
109 | 109 | | required by this subsection. 9 |
---|

---|
111 | 111 | | (ii) The Department of Information Technology shall assist with the 10 |
---|
112 | 112 | | review of artificial intelligence systems by evaluating the relative costs and benefits of: 11 |
---|
113 | 113 | | |
---|
114 | 114 | | 1. the available artificial intelligence systems identified by 12 |
---|
115 | 115 | | local school systems under subsection (c) of this section; 13 |
---|
116 | 116 | | |
---|
117 | 117 | | 2. any additional available artificial intelligence systems 14 |
---|
118 | 118 | | that meet the objectives listed under paragraph (1) of this subsection; and 15 |
---|
119 | 119 | | |
---|
120 | 120 | | 3. the implementation of one or more statewide artificial 16 |
---|
121 | 121 | | intelligence systems for use in public schools throughout the State, in accordance with the 17 |
---|
122 | 122 | | policies and strategies developed by the Governor’s Artificial Intelligence Subcabinet of the 18 |
---|
123 | 123 | | Governor’s Executive Council. 19 |
---|

---|
125 | 125 | | (e) (1) On or before January 1, 2026, the Department shall provide an interim 20 |
---|
126 | 126 | | report on the results of the survey conducted under subsection (c) of this section to the 21 |
---|
127 | 127 | | Governor and, in accordance with § 2–1257 of the State Government Article, the General 22 |
---|
128 | 128 | | Assembly. 23 |

130 | 130 | | (2) On or before December 15, 2026, the Department shall issue a final 24 |
---|
131 | 131 | | report on the results of its evaluation to the Governor and, in accordance with § 2–1257 of 25 |
---|
132 | 132 | | the State Government Article, the General Assembly. 26 |
---|

---|
134 | 134 | | SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect June 27 |
---|
135 | 135 | | 1, 2025. It shall remain effective for a period of 2 years and 1 month and, at the end of June 28 |
---|
136 | 136 | | 30, 2027, this Act, with no further action required by the General Assembly, shall be 29 |
---|
137 | 137 | | abrogated and of no further force and effect. 30 |
