Lewis Introduced and read first time: January 31, 2025 Assigned to: Health and Government Operations A BILL ENTITLED AN ACT concerning 1 Opioid–Associated Disease Prevention and Outreach Program Data – 2 Submission to Local Health Departments 3 FOR the purpose of requiring the Maryland Department of Health to submit the data 4 reported to the Department by an Opioid–Associated Disease Prevention and 5 Outreach Program to the local health department for each county in which the 6 Program operates; and generally relating to Opioid–Associated Disease Prevention 7 and Outreach Programs. 8 BY repealing and reenacting, without amendments, 9 Article – Health – General 10 Section 24–901(a) and (f) and 24–902(a) and (c) 11 Annotated Code of Maryland 12 (2023 Replacement Volume and 2024 Supplement) 13 BY repealing and reenacting, with amendments, 14 Article – Health – General 15 Section 24–907 16 Annotated Code of Maryland 17 (2023 Replacement Volume and 2024 Supplement) 18 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 19 That the Laws of Maryland read as follows: 20 Article – Health – General 21 24–901. 22 (a) In this subtitle the following words have the meanings indicated. 23 2 HOUSE BILL 999 (f) “Program” means an Opioid–Associated Disease Prevention and Outreach 1 Program. 2 24–902. 3 (a) (1) A Program may be established by a local health department or a 4 community–based organization, subject to the provisions of this subtitle. 5 (2) (i) A county may cooperate with another county to establish a 6 Program. 7 (ii) A community–based organization may establish a multicounty 8 Program. 9 (3) This subtitle does not apply to the AIDS Prevention Sterile Needle and 10 Syringe Exchange Pilot Program established under Subtitle 8 of this title. 11 (c) If established under subsection (a) of this section, a Program shall: 12 (1) Provide for substance use outreach, education, and linkage to treatment 13 services to participants, including distribution and collection of hypodermic needles and 14 syringes; and 15 (2) Operate in accordance with: 16 (i) The technical assistance of the Standing Advisory Committee; 17 and 18 (ii) The procedures, plans, and protocols approved by: 19 1. The local health officer for each county in which a Program 20 is established; and 21 2. The Department. 22 24–907. 23 (A) A Program shall collect and report at least annually the following data to the 24 Department: 25 (1) The number of participants served by the Program; 26 (2) The number of new participants registered by the Program during the 27 reporting period; 28 (3) Demographic profiles of participants served by the Program, including: 29 HOUSE BILL 999 3 (i) Age; 1 (ii) Gender; 2 (iii) Race; 3 (iv) Zip code; and 4 (v) Types of drugs used; 5 (4) The number of hypodermic needles and syringes distributed and 6 collected; 7 (5) Each location at which hypodermic needles and syringes were 8 distributed; and 9 (6) The number of linkages provided to participants under § 24–903(a)(6) 10 of this subtitle. 11 (B) THE DEPARTMENT SHALL SUBM IT THE DATA REPORTED FROM A 12 PROGRAM TO THE LOCAL HEALTH DEPARTMENT FOR EACH COUNTY IN W HICH THE 13 PROGRAM OPERATE S. 14 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 15 October 1, 2025. 16
