CHAPTER ______ AN ACT concerning 1 Natural Resources – Vessels – Carbon Monoxide Warning Labels 2 (Matthew’s Law) 3 FOR the purpose of prohibiting a person from operating a gasoline–powered motorized 4 gasoline–powered vessel manufactured after a certain date that has a cabin or other 5 closed living space accommodation spaces, swim platforms, or aft lounging areas on 6 the waters of the State unless the vessel has carbon monoxide warning labels affixed 7 in conspicuous locations in certain areas of the vessel; prohibiting the Department 8 of Natural Resources from imposing a certain penalty; and generally relating to the 9 State Boat Act. 10 BY adding to 11 Article – Natural Resources 12 Section 8–740.2 13 Annotated Code of Maryland 14 2 SENATE BILL 1028 (2023 Replacement Volume and 2024 Supplement) 1 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 2 That the Laws of Maryland read as follows: 3 Article – Natural Resources 4 8–740.2. 5 (A) IN THIS SECTION, “MOTORIZED VESSEL ” DOES NOT INCLUDE A V ESSEL 6 POWERED BY AN ELECTR IC MOTOR. 7 (B) (A) A PERSON MAY NOT OPERA TE A GASOLINE–POWERED MOTORIZED 8 GASOLINE–POWERED VESSEL MANUFACTURED AFTER JULY 31, 2007, THAT HAS A 9 CABIN OR OTHER CLOSE D LIVING SPACE ACCOMMODATION SPACES , SWIM 10 PLATFORMS, OR AFT LOUNGING AREA S ON THE WATERS OF THE STATE UNLESS THE 11 VESSEL HAS CARBON MO NOXIDE WARNING LABEL S AFFIXED IN CONSPIC UOUS 12 LOCATIONS IN THE VIC INITY OF BOTH THE TR ANSOM AND THE HELM OF THE V ESSEL. 13 (C) THE (B) THE DEPARTMENT MAY NOT IM POSE A PENALTY ON A 14 PERSON THAT VIOLATES THE PROVISIONS OF TH IS SECTION. 15 SECTION 2.
