267-facilities to establish a percentage price preference, not to exceed [5%] 10%, for the 19
268-purchase of locally grown food. 20

271-BOARD SHALL ADOPT REG ULATIONS AUTH ORIZING STATE SCHOOLS AND 22

273-RESPONSES FROM CERTI FIED LOCAL FARMS AS DEFINED IN § 14–701 OF THIS TITLE. 24

275- (c) A percentage price preference under this section may not be used in 25
276-conjunction with any other percentage price preference established under this title. 26

278- (d) Each State school and facility shall review the procurement specifications 27
279-currently used and, to the extent practicable, require the use of a percentage price 28
280-preference in their purchase of locally grown food. 29

282- (e) (1) Except as provided in paragraph (2) of this subsection, this section is 30
283-broadly applicable to all procurements by State schools and facilities if the locally grown 31
284-food is consistent with the requirements of the bid specification. 32

288- (2) Only to the extent necessary to prevent the denial of federal money or 1
289-eliminate the inconsistency with federal law, this section does not apply to a procurement 2
290-by a State school or facility if it is determined that compliance with this section would: 3

294- (ii) be inconsistent with the requirements of federal law. 5

300- (b) “Certified Chesapeake invasive species” means a finfish species that is: 8

302- (1) ranked as high priority in the Maryland Aquatic Nuisance Species 9

305- (2) harvested from the Chesapeake Bay or its tributaries. 11

307- (c) “Certified Chesapeake invasive species provider” means a person licensed and 12
308-authorized as a seafood dealer under § 4–701 of the Natural Resources Article that: 13

310- (1) is certified by the Department in accordance with regulations adopted 14
311-under this subtitle; and 15

313- (2) can demonstrate that the person’s product is a certified Chesapeake 16
314-invasive species. 17

316- (d) “Certified local farm” means a local farm enterprise that: 18

318- (1) meets the nutrient management requirements established under Title 19
319-8, Subtitle 8 of the Agriculture Article; and 20

321- (2) is certified by the Department in accordance with regulations adopted 21
322-under this subtitle. 22

326- (a) (1) There is an Office for the Certified Local Farm and Fish Program in the 24

329- (2) The purpose of the Office is to administer the Program and facilitate 26
330-the participation of certified local farms and certified Chesapeake invasive species 27

215+ (a) In this subtitle the following words have the meanings indicated. 15

217+ (b) “Certified Chesapeake invasive species” means a finfish species that is: 16
218+
219+ (1) ranked as high priority in the Maryland Aquatic Nuisance Species 17
220+Management Plan; and 18

222+ (2) harvested from the Chesapeake Bay or its tributaries. 19

224+ (c) “Certified Chesapeake invasive species provider” means a person licensed and 20
225+authorized as a seafood dealer under § 4–701 of the Natural Resources Article that: 21
226+
227+ (1) is certified by the Department in accordance with regulations adopted 22
228+under this subtitle; and 23

230+ (2) can demonstrate that the person’s product is a certified Chesapeake 24
231+invasive species. 25

233+ (d) “Certified local farm” means a local farm enterprise that: 26
234+
235+ (1) meets the nutrient management requirements established under Title 27
236+8, Subtitle 8 of the Agriculture Article; and 28
237+
238+ (2) is certified by the Department in accordance with regulations adopted 29 6 SENATE BILL 177

241+under this subtitle. 1

243+ SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 2
