Strike out indicates matter stricken from the bill by amendment or deleted from the law by amendment. *sb0003* SENATE BILL 3 P2, K3 5lr1469 (PRE–FILED) CF HB 850 By: Senator Ellis Requested: October 29, 2024 Introduced and read first time: January 8, 2025 Assigned to: Finance Committee Report: Favorable with amendments Senate action: Adopted Read second time: March 11, 2025 CHAPTER ______ AN ACT concerning 1 Procurement – Public Work Contracts – Data Dashboard 2 (Maryland Public Works and Apprenticeship Transparency Act) 3 Workgroup on the Creation of a Data Dashboard for Public Work Contracts and 4 Apprentices – Establishment 5 FOR the purpose of requiring the Commissioner of Labor and Industry to develop and 6 maintain a data dashboard that includes certain information relating to contractors, 7 subcontractors, employees, and apprentices working under public work contracts; 8 requiring each contractor who is contracted under a public work contract to provide 9 certain information to the Commissioner; requiring the Commissioner to update the 10 data dashboard on a certain basis, post the data dashboard on the Maryland 11 Department of Labor website, and maintain a certain cache; and generally relating 12 to public work contracts establishing the Workgroup on the Creation of a Data 13 Dashboard for Public Work Contracts and Apprentices to study the most efficient 14 and cost–effective method to create a publicly available data dashboard that 15 disaggregates information regarding public work contracts with the State and 16 apprentices working under the public work contracts; and generally relating to the 17 Workgroup on the Creation of a Data Dashboard for Public Work Contracts and 18 Apprentices. 19 BY adding to 20 Article – State Finance and Procurement 21 Section 17–206 22 Annotated Code of Maryland 23 2 SENATE BILL 3 (2021 Replacement Volume and 2024 Supplement) 1 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 2 That the Laws of Maryland read as follows: 3 (a) There is a Workgroup on the Creation of a Data Dashboard for Public Work 4 Contracts and Apprentices. 5 (b) The Workgroup consists of the following members: 6 (1) three members of the Senate of Maryland, appointed by the President 7 of the Senate; 8 (2) three members of the House of Delegates, appointed by the Speaker of 9 the House; 10 (3) the Secretary of Labor, or the Secretary’s designee; 11 (4) the Commissioner of Labor and Industry, or the Commissioner’s 12 designee; and 13 (5) the following members, appointed by the Governor: 14 (i) one representative of the Baltimore–DC Building Trades 15 Council, selected by the President of the Council; 16 (ii) one representative of the Mid–Atlantic Pipe Trades Association; 17 (iii) one representative who is an attorney and a member of 18 Steamfitters Union Local 602; 19 (iv) one representative of the Associated Builders and Contractors of 20 Maryland (ABC); 21 (v) one representative of the Independent Electrical Contractors 22 (IEC) Chesapeake; and 23 (vi) one representative of the Maryland Minority Contractors 24 Association (MMCA). 25 (c) The President of the Senate and the Speaker of the House shall designate the 26 co–chairs of the Workgroup. 27 (d) The Commissioner of Labor and Industry shall provide staff for the 28 Workgroup. 29 (e) A member of the Workgroup: 30 SENATE BILL 3 3 (1) may not receive compensation as a member of the Workgroup; but 1 (2) is entitled to reimbursement for expenses under the Standard State 2 Travel Regulations, as provided in the State budget. 3 (f) At the first meeting of the Workgroup that occurs on or after July 1, 2025, the 4 Workgroup shall vote to adopt a code of conduct providing for the acceptable conduct of 5 Workgroup members. 6 (g) The Workgroup shall: 7 (1) study the most efficient and cost–effective method to create a publicly 8 available data dashboard that disaggregates information regarding public work contracts 9 with the State, including information on: 10 (i) the name of each contractor and subcontractor working under a 11 public work contract; 12 (ii) wages, including overtime wages, and benefits paid to each 13 employee of a contractor or subcontractor working under a public work contract; 14 (iii) the job classification of each employee employed by a contractor 15 or subcontractor working under a public work contract; 16 (iv) apprentices working under each contractor and subcontractor for 17 public works contracts, including: 18 1. the number of apprentices employed; 19 2. demographic information for each apprentice; 20 3. the date each apprentice registered with the Maryland 21 Department of Labor; 22 4. the trade practiced by each apprentice; and 23 5. the certification status of each apprentice; and 24 (v) each apprenticeship program sponsored by each contractor or 25 subcontractor working under a public work contract; and 26 (2) make recommendations regarding: 27 (i) where the data dashboard shall be located; 28 4 SENATE BILL 3 (ii) necessary costs associated with the development and 1 maintenance of the data dashboard; and 2 (iii) time frames during which the data dashboard can be developed 3 and implemented and the frequency with which the information in the data dashboard can 4 be updated. 5 (h) On or before January 7, 2027, the Workgroup shall report its findings and 6 recommendations to the Governor and, in accordance with § 2–1257 of the State 7 Government Article, the General Assembly. 8 Article – State Finance and Procurement 9 17–206. 10 (A) THE COMMISSIONER SHALL DE VELOP A CLEAR AND 11 EASY–TO–UNDERSTAND GRAPHIC D ATA DASHBOARD THAT I NCLUDES, FOR EACH 12 ONGOING PUBLIC WORK CONTRACT : 13 (1) THE NAME OF EACH CON TRACTOR AND SUBCONTR ACTOR 14 WORKING UNDER THE PU BLIC WORK CONTRACT ; 15 (2) THE FOLLOWING INFORM ATION REGARDING THE EMPLOYEES OF 16 EACH CONTRACTOR AND SUBCONTRACTOR WORKIN G UNDER THE PUBLIC W ORK 17 CONTRACT: 18 (I) THE PREVAILING WAGE RATE S PAID BY EACH CONTR ACTOR 19 OR SUBCONTRACTOR ; 20 (II) THE NUMBER OF EMPLOY EES EMPLOYED BY EACH 21 CONTRACTOR OR SUBCON TRACTOR; 22 (III) THE REGULAR WAGES AN D OVERTIME WAGES PAI D BY THE 23 CONTRACTOR OR SUBCON TRACTOR; 24 (IV) ANY FRINGE BENEFITS PROVIDED TO EMPLOYEES BY THE 25 CONTRACTOR OR SUBCON TRACTOR; 26 (V) THE JOB CLASSIFICATI ON OF EACH EMPLOYEE EMPLOYED 27 BY THE CONTRACTOR OR SUBCONTRACTOR ; AND 28 (VI) ANY ADDITIONAL INFOR MATION DETERMINED NE CESSARY 29 BY THE COMMISSIONER ; AND 30 SENATE BILL 3 5 (3) (I) THE NUMBER OF APPREN TICES WORKING FOR EA CH 1 CONTRACTOR OR SUBCON TRACTOR; 2 (II) THE TRADE PRACTICED BY EACH APPRENTICE W ORKING 3 FOR EACH CONTRACTOR OR SUBCONTRACTOR ; 4 (III) THE CERTIFICATION ST ATUS OF EACH APPRENT ICE 5 WORKING FOR EACH CON TRACTOR OR SUB CONTRACTOR ; 6 (IV) CONTACT INFORMATION FOR EACH APPRENTICES HIP 7 PROGRAM SPONSOR ; 8 (V) DEMOGRAPHIC DATA FOR EACH APPRENTICE WORK ING FOR 9 EACH CONTRACTOR OR S UBCONTRACTOR ; AND 10 (VI) THE DATE EACH APPREN TICE REGISTERED WITH THE 11 MARYLAND DEPARTMENT OF LABOR. 12 (B) EACH CONTRACTOR WHO I S CONTRACTED UNDER A PUBLIC WORK 13 CONTRACT SHALL PROVI DE THE COMMISSIONER WITH THE INFORMATION LISTED 14 UNDER SUBSECTION (A) OF THIS SECTION ONCE A WEEK. 15 (C) THE COMMISSIONER SHALL : 16 (1) UPDATE THE DATA DASH BOARD DEVELOPED UNDER SUBS ECTION 17 (A) OF THIS SECTION AT L EAST ONCE A MONTH ; 18 (2) POST THE MOST RECENT LY UPDATED DATA DASH BOARD 19 PROMINENTLY ON THE MARYLAND DEPARTMENT OF LABOR WEBSITE ; AND 20 (3) MAINTAIN A CACHE CON TAINING THE INFORMAT ION POSTED ON 21 THE DATA DASHBOARD FOR AT LEAS T THE IMMEDIATELY PR ECEDING 24 MONTHS. 22 (D) THE COMMISSIONER MAY ADOP T REGULATIONS TO CAR RY OUT THIS 23 SECTION. 24 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 25 October 1, 2025. 26 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 27 1, 2025. It shall remain effective for a period of 1 year and 7 months and, at the end of 28 January 31, 2027, this Act, with no further action required by the General Assembly, shall 29 be abrogated and of no further force and effect. 30
