Natural Resources – Wildland Areas – Overhead Transmission Lines 2 
 
FOR the purpose of exempting certain areas in the Big Savage Mountain Wildland, Bear 3 
Pen Wildland, and Dan’s Mountain Wildland from being designated as a wildland 4 
area, subject to a certificate of public convenience and necessity being obtained for a 5 
certain transmission line; requiring the Public Service Commission to require an 6 
applicant for a certificate of public convenience and necessity for the construction of 7 
a certain overhead transmission line to provide wildland impact mitigation 8 
guarantees; and generally relating to wildland areas in the State. 9

Preamble 11 
 
 WHEREAS, As a result of an open, transparent, and comprehensive planning 12 
process, NextEra Energy Transmission MidAtlantic, Inc., through certain affiliates, has 13 
been designated by PJM Interconnection, LLC, the regional electric transmission 14 
organization for Maryland, to construct an overhead transmission line to address and 15 
resolve certain reliability issues impacting the electric transmission system serving the 16 
State’s and surrounding region’s electric customers; and 17 
 
 WHEREAS, Before beginning construction of an overhead transmission line, 18 
NextEra Energy Transmission MidAtlantic, Inc., must first obtain a certificate of public 19 
convenience and necessity, in accordance with the requirements in § 7–207 of the Public 20 
Utilities Article, to demonstrate that the transmission line is consistent with the public 21 
interest and public need and subject the proposed transmission line to a comprehensive 22 
review and input process involving the public, relevant local governments, and each 23 
appropriate State unit; and 24 
 
 WHEREAS, Before approving an application for a certificate of public convenience 25 
and necessity, the Public Service Commission must provide an opportunity for public 26 
comment and hold a public hearing on the application in each county and municipal 27 
corporation in which any portion of the construction of an overhead transmission line is 28 
proposed to be located; and 29 
 
 WHEREAS, The Public Service Commission may take final action on an application 30 
for a certificate of public convenience and necessity only after due consideration of, among 31 
other things:  32 
 
 (1) the recommendation of the governing body of each county or municipal 33 
corporation in which any portion of the construction of the overhead transmission line is 34 
proposed to be located; and 35 
 
 (2) the effect of the overhead transmission line on:  36 
 
 (i) the stability and reliability of the electric system;  37   	SENATE BILL 399 	3 
 
 
 
 (ii) economics;  1 
 
 (iii) aesthetics;  2 
 
 (iv) historic sites;  3 
 
 (v) aviation safety as determined by the Maryland Aviation 4 
Administration and the administrator of the Federal Aviation Administration; and  5 
 
 (vi) when applicable, air quality and water pollution; now, therefore, 6 
 
 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 7 
That the Laws of Maryland read as follows: 8

5–1203. 10 
 
 (a) (1) In order to assure that an increasing population, accompanied by 11 
expanding settlement and growing mechanization, does not occupy and modify all areas 12 
within the State, leaving no lands designated for preservation and protection in their 13 
natural condition, it is the policy of the General Assembly to secure for the people of present 14 
and future generations the benefits of an enduring resource of State wildlands. 15 
 
 (2) For this purpose there is established a State wildlands preservation 16 
system composed of areas in the State designated by the General Assembly as “wildland 17 
areas”. 18 
 
 (3) The wildland areas shall be administered for the use and enjoyment of 19 
the people of Maryland in a manner that will leave them unimpaired for the future use and 20 
enjoyment as wildlands, to provide for their protection, preservation of their wildland 21 
character, and for gathering and dissemination of information regarding their use and 22 
enjoyment as wildlands. 23 
 
 (4) A State land may not be designated as a wildland area except as 24 
provided for in this section or by a subsequent act. 25 
 
 (b) (1) [Pursuant to] IN ACCORDANCE WITH the provisions of subsection (a) 26 
of this section [that] AND EXCEPT AS PROVID ED IN PARAGRAPH (2) OF THIS 27 
SUBSECTION, THE property in Garrett County containing approximately 2,879 acres and 28 
described as follows is a Type 1 State wildland and shall be named the “Big Savage 29 
Mountain Wildland”: 30 
 
 Beginning at a point, said point being the intersection of the south side of High Rock 31 
Tower Road and a point located 200 feet west of the Big Savage Mountain Hiking Trail and 32  4 	SENATE BILL 399  
 
 
running then in a generally southwest direction, 200 feet west of the Big Savage Mountain 1 
Hiking Trail to a point located at the waters of the Savage River Reservoir, then running 2 
generally in a northerly direction with the waters of the Savage River Reservoir, the Savage 3 
River and the existing Savage River State Forest boundary to a point of intersection of the 4 
Savage River and the southern margin of the right of way of Savage River Road and 5 
running then with the southern and eastern right of way of the Savage River Road to the 6 
Savage River State Forest boundary, then running along said boundary in an easterly 7 
direction to corner 533, then leaving the said Savage River State Forest boundary and 8 
running due east to a point on the eastern right of way of Westernport Road, then running 9 
along said right of way in an easterly and southern direction to a point of intersection with 10 
the Savage River State Forest boundary, then running with the said State forest boundary 11

 (iii) Take all other actions necessary to manage the area in a way that 11 
fulfills the purposes of the 1966 Federal Aid in Fish and Wildlife Restoration Act grant from 12 
the Department of the Interior that partially funded acquisition of the area. 13

 (f) For the construction of an overhead transmission line, in addition to the 16 
considerations listed in subsection (e) of this section, the Commission shall: 17 
 
 (1) take final action on an application for a certificate of public convenience 18 
and necessity only after due consideration of: 19 
 
 (i) the need to meet existing and future demand for electric service; 20 
and 21 
 
 (ii) for construction related to a new overhead transmission line, the 22 
alternative routes that the applicant considered, including the estimated capital and 23 
operating costs of each alternative route and a statement of the reason why the alternative 24 
route was rejected; 25 
 
 (2) require as an ongoing condition of the certificate of public convenience 26 
and necessity that an applicant comply with: 27 
 
 (i) all relevant agreements with PJM Interconnection, L.L.C., or its 28 
successors, related to the ongoing operation and maintenance of the overhead transmission 29 
line; and 30

 (ii) all obligations imposed by the North America Electric Reliability 1 
Council and the Federal Energy Regulatory Commission related to the ongoing operation 2 
and maintenance of the overhead transmission line; [and] 3 
 
 (3) require the applicant to identify whether the overhead transmission 4 
line is proposed to be constructed on: 5 
 
 (i) an existing brownfields site; 6 
 
 (ii) property that is subject to an existing easement; or 7 
 
 (iii) a site where a tower structure or components of a tower structure 8 
used to support an overhead transmission line exist; AND 9 
 
 (4) FOR THE CONSTRUCTION OF AN OVERHEAD TRANS MISSION LINE 10 
IN AN AREA SPECIFIED IN § 5–1203(B)(2)(II), (Y)(2), OR (KK)(1)(II) OF THE NATURAL 11 
RESOURCES ARTICLE, REQUIRE THAT AN APPL ICANT PROVIDE WILDLA ND IMPACT 12 
MITIGATION GUARANTEE S, INCLUDING WORKING WI TH THE DEPARTMENT OF 13 
NATURAL RESOURCES TO ADD ADDITIONAL WILDL AND ACREAGE ACQUIRE AND 14 
REPLACE THE TYPE 1 STATE WILDLAND ACREAGE THAT IS LOST AS A RESULT OF THE 15 
TRANSMISSION LINE WI TH ACREAGE THAT IS T WICE THE SIZE AND IS SUITABLE FOR 16 
DESIGNATION AS WILDL AND ACREAGE , AND TO DEVELOP AND I MPLEMENT A LAND 17 
CONSERVATION MANAGEM ENT PLAN FOR THE ARE	A AFFECTED BY THE 18 
TRANSMISSION LI NE THAT SUPPORTS WIL DLIFE HABITATS .  19 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That it is the intent of the General 20 
Assembly that nothing in this Act shall be construed as a recommendation that a proposed 21 
NextEra Energy Transmission MidAtlantic, Inc., transmission line be issued a certificate 22 
of public convenience and necessity from the Public Service Commission. 23 
 
 SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall not abrogate an 24 
existing right of public participation in statute or regulations. 25 
 
 SECTION 4. AND BE IT FURTHER ENACTED, That: 26 
 
 (a) Section 1 of this Act is contingent on: 27 
 
 (1) a 120–day stakeholder process that includes: 28 
 
 (i) a public participation process that meets the requirements of 29 
COMAR 20.79.01; 30 
 
 (ii) at least one public advertised meeting within 25 miles of each 31 
impacted designated wildland area; 32 
 
 (iii) at least one public meeting that provides for virtual participation; 33   	SENATE BILL 399 	13 
 
 
 
 (iv) special effort on the part of an applicant to reach out to 1 
organizations with special expertise in wildlands, wildlife management, and environmental 2 
stewardship; and 3 
 
 (v) a portal for public comments, which must be submitted to the 4 
Department of Natural Resources; 5 
 
 (2) a 90–day deliberation period by the Department of Natural Resources; 6 
and 7 
 
 (3) a recommendation by the Secretary of Natural Resources that the Public 8 
Service Commission issue a certificate of public convenience and necessity for a proposed 9 
transmission line. 10 
 
 (b) The Commission shall notify the Department of Legislative Services within 5 11 
days after the criteria under subsection (a) of this section have been met.  12 
 
 SECTION 3. 5. AND BE IT FURTHER ENACTED, That: 13 
 
 (a) This Act shall be abrogated and of no further force and effect if the Public 14 
Service Commission: 15 
 
 (1) approves a certificate of public convenience and necessity, in accordance 16 
with § 7–207 of the Public Utilities Article, for an alternative NextEra Energy 17 
Transmission MidAtlantic, Inc., transmission line that is part of the Mid–Atlantic 18 
Resiliency Link project that does not pass through the Big Savage Mountain Wildland, the 19 
Bear Pen Wildland, or the Dan’s Mountain Wildland; or 20 
 
 (2) denies a certificate of public convenience and necessity for a NextEra 21 
Energy Transmission MidAtlantic, Inc., transmission line that is part of the Mid–Atlantic 22 
Resiliency Link project. 23 
 
 (b) The Commission shall notify the Department of Legislative Services within 5 24 
days after a determination under subsection (a) of this section has been made.  25 
 
 SECTION 3. 4. 6. AND BE IT FURTHER ENACTED, That , subject to Section 4 of 26 
this Act, this Act shall take effect October 1, 2025.  27
