19 (2) THE WEST NORTH AVENUE CORRIDOR HAS EXPERIEN CED LOW 20 HOUSING AND ECONOMIC DEVELOPMENT IN THE C OMMUNITY FOR DECADES ; 21 (3) AREAS IN THE WEST NORTH AVENUE CORRIDOR INCLUDE BOTH 22 AREAS THAT ARE CONSI DERED SLUM OR BLIGHT ED AND AREAS THAT AR E 23 DETERIORATED OR SUBJ ECT TO FURTHER DETER IORATING CONDITION , AND THOSE 24 AREAS ARE IN NEED OF DEVELOPMENT OR REDEV ELOPMENT FOR THE PUB LIC 25 BENEFIT; 26 (4) THE REVITALIZATION O F AREAS WITHIN THE WEST NORTH 27 AVENUE CORRIDOR NEEDING COMM ERCIAL DEVELOPMENT O R REDEVELOPMENT IS 28 AN ESSENTIAL GOVERNM ENTAL FUNCTION AND I S A PUBLIC USE THAT WILL CONFER 29 A PUBLIC BENEFIT ON CITIZENS OF BALTIMORE CITY BY: 30 (I) RELIEVING CONDITIONS OF UNEMPLOYMENT ; 31 SENATE BILL 4 5 (II) ENCOURAGING THE INCR EASE OF COMMERCE AND A 1 BALANCED ECONOMY ; 2 (III) ASSISTING IN THE RET ENTION OF BUSINESSES AND 3 RESIDENTS; 4 (IV) ATTRACTING NEW INDUS TRIES AND COMMERCE ; 9 (5) THE ESTABLISHMENT OF THIS PUBLIC AUTHORITY T O PROVIDE 10 FINANCIAL RESOURCES FOR THE DEVELOPMENT AND ESTABLISHMENT OF 11 RESIDENCES AND BUSIN ESSES THROUGH COMMUN ITY ORGANIZATIONS IN THE 12 TARGET AREA WILL SIG NIFICANTLY IMPROVE BALTIMORE CITY NEIGHBORHOODS 13 AND INCREASE PROPERT Y TAX REVENUES FOR T HE STATE AND THE CITY OF 14 BALTIMORE; AND 15 (6) THE AUTHORITY IS THE ECON OMIC DEVELOPMENT AUT HORITY 16 FOR THE STATE TO BENEFIT THE NEIGHBORHOODS OF BALTIMORE CITY WITHIN 17 THE TARGET AREA . 18 (B) THE LEGISLATIVE PURPO SES OF THE AUTHORITY ARE TO : 19 (1) REVIVE THE VARIOUS C OMMUNITIES ALONG THE WEST NORTH 20 AVENUE CORRIDOR IN BALTIMORE CITY; 21 (2) PROMOTE ECONOMIC DEV ELOPMENT; 22 (3) ENCOURAGE THE INCREA SE OF BUSINESS ACTIV ITY, COMMERCE , 23 AND A BALANCED ECONO MY IN BALTIMORE CITY; 24 (4) HELP TO RETAIN AND A TTRACT BUSINESS ACTI VITY AND 25 COMMERCE IN BALTIMORE CITY; 2 (2) WITHOUT LIMITING ITS AUTHORITY TO OTHERWI SE EXERCISE ITS 3 POWERS, THE AUTHORITY EXERCISE IT S POWERS TO ASSIST P RIVATE REAL ESTATE 4 ENTITIES AND NONPROF IT COMMUNITY DEVELOP MENT CORPORATIONS TO 5 DEVELOP AND REHABILI TATE HOUSING AND COM MERCIAL UNITS IN BALTIMORE 6 CITY AND SUPPORT LOCA L ECONOMIC DEVELOPME NT AGENCIES TO CONTR IBUTE 7 TO THE EXPANSION , MODERNIZATION , AND RETENTION OF EXI STING ENTERPRISES 8 IN BALTIMORE CITY AS WELL AS THE A TTRACTION OF NEW BUS INESSES TO 9 BALTIMORE CITY; 27 (4) the Secretary of Transportation, or the Secretary’s designee; 28 8 SENATE BILL 4 (5) the Secretary of Commerce, or the Secretary’s designee; 1 (6) the Executive Director of the Maryland Economic Development 2 Corporation, or the Executive Director’s designee; 3 (7) one member of the Baltimore City Council who represents the target 4 area, appointed by the President of the Baltimore City Council; 5 (8) one member appointed by the Mayor of Baltimore City; 6 (9) one member appointed by the Governor; 7 (10) the Director of the Baltimore Development Corporation, or the 8 Director’s designee; 9 (11) the Commissioner of the Baltimore City Department of Housing and 10 Community Development, or the Commissioner’s designee; and 20 (17) two members who are residents of communities impacted by the target 21 area or buffer zone, WITH ONE MEMBER REPR ESENTING THE NEIGHBO RHOODS EAST 22 OF NORTH FULTON AVENUE AND ONE MEMBER REPRESENTING THE 23 NEIGHBORHOODS WEST O F NORTH FULTON AVENUE, selected by the majority vote of 24 the leadership of the following organizations: 25 (i) Alliance of Rosemont Community Associations; 29 (24) MAKE RULES AND RE GULATIONS FOR THE OP ERATION AND USE 30 OF LAND , PROPERTY, AND UNDERTAKINGS UND ER THE AUTHORITY’S 31 JURISDICTION; AND 32 12 SENATE BILL 4 (25) DO ALL THINGS NECESS ARY OR CONVENIENT TO CARRY OUT THE 1 POWERS EXPRESSLY GRA NTED BY THIS SUBTITL E. 2 12–711. 3 (A) THE AUTHORITY SHALL ESTAB LISH A SYSTEM OF FIN ANCIAL 4 ACCOUNTING , CONTROLS, AUDITS, AND REPORTS . 5 (B) THE FISCAL YEAR OF TH E AUTHORITY BEGINS ON JULY 1 AND ENDS ON 6 THE FOLLOWING JUNE 30. 7 12–712. 8 (A) THE AUTHORITY MAY CREATE AND ADMINISTER THE A CCOUNTS THAT 9 IT REQUIRES. 10 (B) THE AUTHORITY SHALL DEPOS IT ITS MONEY INTO A BALTIMORE CITY 11 OR NATIONAL BANK OR A FEDERALLY INSURED SAVINGS AND LOAN ASS OCIATION 12 THAT HAS A TOTAL PAI D–IN CAPITAL OF AT LEA ST $1,000,000. 13 (C) THE AUTHORITY MAY DESIGNA TE THE TRUST DEPARTM ENT OF A 14 BALTIMORE CITY OR NATIONAL BANK OR SAVINGS AND LOAN ASSOCIATION AS A 15 DEPOSITORY TO RECEIV E SECURITIES THAT TH E AUTHORITY OWNS OR ACQ UIRES. 16 12–713. 17 (A) EXCEPT AS PROVIDED IN SUBSECTION (B) OF THIS SE CTION, THE 18 AUTHORITY IS EXEMPT F ROM TAXATION OR ASSE SSMENTS ON ANY PART OF A 19 DEVELOPMENT OR PROJE CT, THE AUTHORITY’S ACTIVITIES IN OPER ATING AND 20 MAINTAINING A DEVELO PMENT OR PROJECT , AND REVENUES FROM A 21 DEVELOPMENT OR PROJE CT. 22 (B) ANY PROPERTY THAT IS SOLD OR LEASED BY THE AUTHORITY TO A 23 PRIVATE ENTITY IS SU BJECT TO BALTIMORE CITY AND LOCAL REAL P ROPERTY 24 TAXES FROM THE TIME OF SALE OR LEASE . 25 (C) THE AUTHORITY IS EXEMPT F ROM STATE AND LOCAL TRANS FER AND 26 RECORDATION TAX . 27 12–714. 28 (A) IN THIS SECTION , “FUND” MEANS THE WEST NORTH AVENUE 29 DEVELOPMENT AUTHORITY FUND. 30 SENATE BILL 4 13 (B) THERE IS A WEST NORTH AVENUE DEVELOPMENT AUTHORITY FUND. 1 (C) THE PURPOSE OF THE FUND IS TO PROVIDE FU NDS FOR THE 2 AUTHORITY TO USE FOR CONSULTING FEES , SALARIES, AND ADMINISTRATIVE 3 EXPENSES. 4 (D) THE AUTHORITY SHALL ADMIN ISTER THE FUND. 5 (E) (1) THE FUND IS A SPECIAL , NONLAPSING FUND THAT IS NOT 6 SUBJECT TO § 7–302 OF THE STATE FINANCE AND PROCUREMENT ARTICLE. 7 (2) THE STATE TREASURER SHALL HOLD THE FUND SEPARATELY , 8 AND THE COMPTROLLER SHALL ACC OUNT FOR THE FUND. 9 (F) THE FUND CONSISTS OF : 10 (1) MONEY APPROPRIATED I N THE STATE BUDGET TO THE FUND; 11 (2) INTEREST EARNINGS; AND 12 (3) ANY OTHER MONEY FROM ANY OTHER SOURCE ACC EPTED FOR 13 THE BENEFIT OF THE FUND. 14 (G) THE FUND MAY BE USED ONLY FOR ADMINISTRATIVE P URPOSES AND TO 15 CARRY OUT THE FUNCTI ONS OF THIS SUBTITLE . 16 (H) THE STATE TREASURER SHALL INVES T THE MONEY OF THE FUND IN 17 THE SAME MANNER AS O THER STATE MONEY MAY BE IN VESTED. 18 (I) EXPENDITURES FROM THE FUND MAY BE MADE ONLY IN ACCORDANCE 19 WITH THE STATE BUDGET . 20 Article – State Finance and Procurement 21 6–226. 22 (a) (2) (i) 1. This subparagraph does not apply in fiscal years 2024 23 through 2028. 24 2. Notwithstanding any other provision of law, and unless 25 inconsistent with a federal law, grant agreement, or other federal requirement or with the 26 terms of a gift or settlement agreement, net interest on all State money allocated by the 27 State Treasurer under this section to special funds or accounts, and otherwise entitled to 28 receive interest earnings, as accounted for by the Comptroller, shall accrue to the General 29 Fund of the State. 30 14 SENATE BILL 4 (ii) The provisions of subparagraph (i) of this paragraph do not apply 1 to the following funds: 2 204. the Victims of Domestic Violence Program Grant Fund; 3 [and] 4 205. the Proposed Programs Collaborative Grant Fund; AND 5 206. THE WEST NORTH AVENUE DEVELOPMENT 6 AUTHORITY FUND. 7 Chapter 80 of the Acts of 2021 8 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 9 October 1, 2021. [It shall remain effective for a period of 5 8 years and, at the end of 10 September 30, 2026 2029, this Act, with no further action required by the General 11 Assembly, shall be abrogated and of no further force and effect.] 12 Chapter 81 of the Acts of 2021 13 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 14 October 1, 2021. [It shall remain effective for a period of 5 8 years and, at the end of 15 September 30, 2026 2029, this Act, with no further action required by the General 16 Assembly, shall be abrogated and of no further force and effect.] 17 Chapter 136 of the Acts of 2023 18 SECTION 3. AND BE IT FURTHER ENACTED, That this Act is an emergency 19 measure, is necessary for the immediate preservation of the public health or safety, has been 20 passed by a yea and nay vote supported by three–fifths of all the members elected to each of 21 the two Houses of the General Assembly, and shall take effect from the date it is enacted. 22 Section 1 of this Act shall remain effective until the taking effect of the termination provision 23 specified in Section 2 of Chapters 80 and 81 of the Acts of the General Assembly of 2021. If 24 that termination provision takes effect, Section 1 of this Act, with no further action required 25 by the General Assembly, shall be abrogated and of no further force and effect. This Act may 26 not be interpreted to have any effect on that termination provision. Section 2 of this Act shall 27 remain effective through September 30, [2026] 2029, and, at the end of September 30, 28 [2026] 2029, Section 2 of this Act, with no further action required by the General Assembly, 29 shall be abrogated and of no further force and effect. 30 SECTION 4. AND BE IT FURTHER ENACTED, That, on or before January 1, 2027, 31 the West North Avenue Development Authority shall report to the General Assembly, in 32 accordance with § 2–1257 of the State Government Article, on the progress of the Authority 33 toward becoming self–sustaining in accordance with § 12–703 of the Economic Development 34 Article, as enacted by Section 3 of this Act. 35 SENATE BILL 4 15 SECTION 4. 5.
