BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 25 That the Laws of Maryland read as follows: 26 Article – Education 27 7–426.2. 28 (a) (1) In this section the following words have the meanings indicated. 29 (2) “Anaphylaxis” means a sudden, severe, and potentially life–threatening 30 allergic reaction that occurs when an individual is exposed to an allergen. 31 (3) [“Auto–injectable] “EMERGENCY USE epinephrine” means a portable, 32 disposable drug delivery device OR PRODUCT APPROVED BY THE FEDERAL FOOD AND 33 DRUG ADMINISTRATION that contains a premeasured single dose of epinephrine that is 34 used to treat anaphylaxis in an emergency situation. 35 SENATE BILL 459 3 (b) Each county board shall establish a policy for public schools within its 1 jurisdiction to authorize the school nurse and other school personnel to administer 2 [auto–injectable] EMERGENCY USE epinephrine, if available, to a student who is 3 determined to be or perceived to be in anaphylaxis, regardless of whether the student: 4 (1) Has been identified as having an anaphylactic allergy, as defined in § 5 7–426.1 of this subtitle; or 6 (2) Has a prescription for epinephrine as prescribed by an authorized 7 licensed health care practitioner under the Health Occupations Article. 8 (c) The policy established under subsection (b) of this section shall include: 9 (1) Training for school personnel on how to recognize the symptoms of 10 anaphylaxis; 11 (2) Procedures for the emergency administration of [auto–injectable] 12 EMERGENCY USE epinephrine; 13 (3) The proper follow–up emergency procedures; 14 (4) A provision authorizing a school nurse to obtain and store at a public 15 school [auto–injectable] EMERGENCY USE epinephrine to be used in an emergency 16 situation; and 17 (5) A requirement that each public school develop and implement a method 18 for notifying the parents or guardians of students of the school’s policy under this section 19 at the beginning of each school year. 20 (d) Except for any willful or grossly negligent act, a school nurse or other school 21 personnel who respond in good faith to the anaphylactic reaction of a child in accordance 22 with this section may not be held personally liable for any act or omission in the course of 23 responding to the reaction. 24 (e) (1) Each public school shall submit, on the form that the Department 25 requires, a report to the Department on each incident at the school or at a related school 26 event that required the use of [auto–injectable] EMERGENCY USE epinephrine. 27 (2) The Department shall develop and disseminate a standard form to 28 report each incident requiring the use of [auto–injectable] EMERGENCY USE epinephrine 29 at a public school. 30 7–426.3. 31 (a) (1) In this section the following words have the meanings indicated. 32 4 SENATE BILL 459 (2) “Anaphylaxis” means a sudden, severe, and potentially life–threatening 1 allergic reaction that occurs when an individual is exposed to an allergen. 2 (3) [“Auto–injectable] “EMERGENCY USE epinephrine” means a portable, 3 disposable drug delivery device OR PRODUCT APPROVED BY THE FEDE RAL FOOD AND 4 DRUG ADMINISTRATION that contains a premeasured single dose of epinephrine that is 5 used to treat anaphylaxis in an emergency situation. 6 (4) “School personnel” means individuals who are employed by a nonpublic 7 school, including part–time employees, teachers and substitute teachers employed by the 8 school for at least 7 days each school year, a school nurse, registered nurse case manager, 9 delegating nurse, and administrative staff. 10 (b) Each nonpublic school in the State may establish a policy authorizing school 11 personnel to administer [auto–injectable] EMERGENCY USE epinephrine, if available, to a 12 student who is determined to be or perceived to be in anaphylaxis, regardless of whether 13 the student: 14 (1) Has been identified as having an anaphylactic allergy, as defined in § 15 7–426.1 of this subtitle; or 16 (2) Has a prescription for epinephrine as prescribed by an authorized 17 licensed health care practitioner under the Health Occupations Article. 18 (c) The policy established under subsection (b) of this section shall include: 19 (1) Training for school personnel on how to recognize the signs and 20 symptoms of anaphylaxis by a licensed health care practitioner who is authorized to 21 administer [auto–injectable] EMERGENCY USE epinephrine and who has been trained in 22 an established protocol on how to recognize the signs and symptoms of anaphylaxis; 23 (2) Procedures for the emergency administration of [auto–injectable] 24 EMERGENCY USE epinephrine; 25 (3) The proper follow–up emergency procedures; 26 (4) A provision authorizing a school nurse or other licensed health care 27 practitioner to obtain, and[,] school personnel to store, at a nonpublic school 28 [auto–injectable] EMERGENCY USE epinephrine to be used in an emergency situation; 29 (5) A requirement that the nonpublic school develop and implement a 30 method for notifying the parents or guardians of students of the school’s policy under this 31 section at the beginning of each school year; and 32 SENATE BILL 459 5 (6) An ongoing process for oversight and monitoring by a licensed health 1 care practitioner of the implementation of the policy established under subsection (b) of this 2 section. 3 (d) Except for any willful or grossly negligent act, school personnel who respond 4 in good faith to the anaphylactic reaction of a child in accordance with this section may not 5 be held personally liable for any act or omission in the course of responding to the reaction. 6 9.5–117. 7 (a) (1) In this section the following words have the meanings indicated. 8 (3) [“Auto–injectable] “EMERGENCY USE epinephrine” has the meaning 9 stated in § 7–426.2 of this article. 10 (f) Except for any willfully or grossly negligent act, a child care provider or an 11 employee of a child care provider who responds in good faith to the anaphylactic reaction 12 of a child in accordance with the guidelines implemented under this section or by use of 13 [auto–injectable] EMERGENCY USE epinephrine is immune from civil liability for any act 14 or omission in the course of responding to the reaction. 15 Article – Health – General 16 13–702. 17 (a) In this subtitle the following words have the meanings indicated. 18 (b) “Agent” means an individual who: 19 (1) Is at least 18 years of age; 20 (2) Has successfully completed, at the expense of an applicant, an 21 educational training program approved by the Department; and 22 (3) Is appointed by a certificate holder to administer [auto–injectable] 23 EMERGENCY USE epinephrine in accordance with the provisions of this subtitle. 24 (c) “Anaphylaxis” means a sudden, severe, and potentially life–threatening 25 allergic reaction that occurs when an individual is exposed to an allergen. 26 [(d) “Auto–injectable epinephrine” means a portable, disposable drug delivery 27 device that contains a premeasured single dose of epinephrine that is used to treat 28 anaphylaxis in an emergency situation.] 29 [(e)] (D) “Certificate” means a certificate or an endorsement on the operating 30 certificate of a youth camp issued by the Department to an individual who operates a youth 31 6 SENATE BILL 459 camp under Title 14, Subtitle 4 of this article to obtain, store, and administer 1 [auto–injectable] EMERGENCY USE epinephrine. 2 [(f)] (E) “Certificate holder” means an individual who is authorized by the 3 Department to obtain, store, and administer [auto–injectable] EMERGENCY USE 4 epinephrine to be used in an emergency situation. 5 (F) “EMERGENCY USE EPI NEPHRINE” MEANS A PORTABLE , DISPOSABLE 6 DRUG DELIVERY DEVICE OR PRODUCT APPROVED BY THE FEDERAL FOOD AND 7 DRUG ADMINISTRATION THAT C ONTAINS A PREMEASURE D SINGLE DOSE OF 8 EPINEPHRINE THAT IS USED TO TREAT ANAPHY LAXIS IN AN EMERGENC Y SITUATION. 9 (g) “Program” means the Emergency and Allergy Treatment Program. 10 (h) “Registered nurse practitioner” has the meaning stated in § 8–101 of the 11 Health Occupations Article. 12 (i) “Youth camp” has the meaning stated in § 14–401 of this article. 13 13–704. 14 (e) An applicant shall have a written policy that includes: 15 (1) Authorization for the certificate holder or agent to administer 16 [auto–injectable] EMERGENCY USE epinephrine, if available, to an individual who has 17 been determined to be or is believed to be experiencing anaphylaxis, whether or not the 18 individual: 19 (i) Has previously been known to have experienced anaphylaxis; or 20 (ii) Has a prescription for epinephrine prescribed by an authorized 21 health care practitioner licensed under the Health Occupations Article; 22 (2) A requirement that youth camp personnel complete training on how to 23 recognize the symptoms of anaphylaxis; 24 (3) Procedures for the emergency administration of [auto–injectable] 25 EMERGENCY USE epinephrine; 26 (4) Procedures for proper emergency follow–up; 27 (5) Authorization for a certificate holder to obtain and store 28 [auto–injectable] EMERGENCY USE epinephrine to be used in an emergency; and 29 SENATE BILL 459 7 (6) A requirement that each certificate holder implement a method for 1 notifying the parent or guardian of a camper of the youth camp’s policy under this section 2 before the camper’s attendance. 3 13–705. 4 (a) (1) A registered nurse practitioner or a physician licensed to practice 5 medicine in the State may prescribe [auto–injectable] EMERGENCY USE epinephrine in 6 the name of a certificate holder. 7 (2) A registered nurse practitioner, a pharmacist licensed to practice 8 pharmacy in the State, or a physician may dispense [auto–injectable] EMERGENCY USE 9 epinephrine under a prescription issued to a certificate holder. 10 (b) A certificate holder may: 11 (1) On presentment of a certificate, receive from any registered nurse 12 practitioner or any physician licensed to practice medicine in the State a prescription for 13 [auto–injectable] EMERGENCY USE epinephrine and the necessary paraphernalia for the 14 administration of [auto–injectable] EMERGENCY USE epinephrine; and 15 (2) Possess and store prescribed [auto–injectable] EMERGENCY USE 16 epinephrine and the necessary paraphernalia for the administration of [auto–injectable] 17 EMERGENCY USE epinephrine. 18 (c) In an emergency situation when registered nurse practitioner, physician, or 19 emergency medical services are not immediately available, a certificate holder or agent may 20 administer [auto–injectable] EMERGENCY USE epinephrine to an individual who is 21 experiencing or believed in good faith by the certificate holder or agent to be experiencing 22 anaphylaxis. 23 13–706. 24 (a) A certificate holder shall submit to the Department, on a form required by the 25 Department, a report of each incident that occurs while the youth camp is in session that 26 required the administration of [auto–injectable] EMERGENCY USE epinephrine. 27 13–707. 28 (a) A cause of action may not arise against a certificate holder or agent authorized 29 under this subtitle for any act or omission when the certificate holder or agent is acting in 30 good faith while administering [auto–injectable] EMERGENCY USE epinephrine to an 31 individual experiencing or believed by the certificate holder or agent to be experiencing 32 anaphylaxis, except where the conduct of the certificate holder or agent amounts to gross 33 negligence, willful or wanton misconduct, or intentionally tortious conduct. 34 8 SENATE BILL 459 (b) (1) A cause of action may not arise against any physician for any act or 1 omission when the physician in good faith prescribes or dispenses [auto–injectable] 2 EMERGENCY USE epinephrine and the necessary paraphernalia for the administration of 3 [auto–injectable] EMERGENCY USE epinephrine to a person certified by the Department 4 under this subtitle. 5 (2) A cause of action may not arise against any pharmacist for any act or 6 omission when the pharmacist in good faith dispenses [auto–injectable] EMERGENCY USE 7 epinephrine and the necessary paraphernalia for the administration of [auto–injectable] 8 EMERGENCY USE epinephrine to a person certified by the Department under this subtitle. 9 (3) A cause of action may not arise against any nurse practitioner for any 10 act or omission when the nurse practitioner in good faith prescribes or dispenses 11 [auto–injectable] EMERGENCY USE epinephrine and the necessary paraphernalia for the 12 administration of [auto–injectable] EMERGENCY USE epinephrine to a person certified by 13 the Department under this subtitle. 14 13–708. 15 (b) An individual may not be held civilly liable in any action arising from or in 16 connection with the administration of [auto–injectable] EMERGENCY USE epinephrine by 17 the individual solely because the individual did not possess a certificate issued under this 18 subtitle. 19 Subtitle 7A. Emergency Use [Auto–Injectable] Epinephrine Program. 20 13–7A–01. 21 (a) In this subtitle the following words have the meanings indicated. 22 (b) “Agent” means an individual who: 23 (1) Is at least 18 years of age; 24 (2) Has successfully completed, at the expense of the participating facility, 25 an educational training program approved by the Department under § 13–7A–03 of this 26 subtitle; and 27 (3) Is designated by a certificate holder to administer [auto–injectable] 28 EMERGENCY U SE epinephrine in accordance with the provisions of this subtitle. 29 (c) “Anaphylaxis” means a sudden, severe, and potentially life–threatening 30 allergic reaction that occurs when an individual is exposed to an allergen. 31 SENATE BILL 459 9 [(d) “Auto–injectable epinephrine” means a portable, disposable drug delivery 1 device that contains a premeasured single dose of epinephrine that is used to treat 2 anaphylaxis in an emergency situation.] 3 [(e)] (D) “Certificate” means a certificate issued by the Department to an 4 individual to obtain, store, and administer [auto–injectable] EMERGENCY USE 5 epinephrine. 6 [(f)] (E) “Certificate holder” means an individual who is authorized by the 7 Department to obtain, store, and administer [auto–injectable] EMERGENCY USE 8 epinephrine to be used in an emergency situation. 9 [(g)] (F) “Eligible institution” means an institution of higher education that has 10 a food service facility or a recreation and wellness facility on the premises and that is 11 authorized under this subtitle to obtain and store [auto–injectable] EMERGENCY USE 12 epinephrine. 13 (G) “EMERGENCY USE EPINEPH RINE” MEANS A PORTABLE , DISPOSABLE 14 DRUG DELIVERY DEVICE OR PRODUCT APPROVED BY THE FEDERAL FOOD AND 15 DRUG ADMINISTRATION THAT C ONTAINS A PREMEASURE D SINGLE DOSE OF 16 EPINEPHRINE THAT IS USED TO TREAT ANAPHYLAXIS IN AN EMERGENCY SITU ATION. 17 (h) “Food service facility” has the meaning indicated in § 21–301 of this article. 18 (i) “Participating facility” means a recreation or wellness facility at an eligible 19 institution or a food service facility, including a food service facility at an eligible 20 institution, in the State that voluntarily participates in the Program. 21 (j) “Program” means the Emergency Use [Auto–Injectable] Epinephrine 22 Program established under § 13–7A–02 of this subtitle. 23 13–7A–02. 24 (a) There is an Emergency Use [Auto–Injectable] Epinephrine Program. 25 (b) The purpose of the Program is to authorize individuals employed by a 26 participating facility to obtain and store [auto–injectable] EMERGENCY USE epinephrine 27 and administer [auto–injectable] EMERGENCY USE epinephrine to individuals who are 28 experiencing or are believed to be experiencing anaphylaxis when a physician or emergency 29 medical services are not immediately available. 30 (c) (1) Subject to paragraph (4) of this subsection, each participating facility 31 may obtain: 32 10 SENATE BILL 459 (i) A prescription for a supply of [auto–injectable] EMERGENCY 1 USE epinephrine from a licensed physician as provided in § 13–7A–06 of this subtitle; and 2 (ii) A supply of [auto–injectable] EMERGENCY USE epinephrine 3 from a licensed pharmacist or a licensed physician as provided in § 13–7A–06 of this 4 subtitle. 5 (2) Each participating facility shall store a supply of [auto–injectable] 6 EMERGENCY USE epinephrine obtained under paragraph (1)(ii) of this subsection: 7 (i) In accordance with the manufacturer’s instructions; and 8 (ii) In a location that is readily accessible to employees or affiliated 9 individuals in an emergency situation. 10 (3) Each participating facility shall designate the employees who are 11 certificate holders or designated affiliated individuals who are certificate holders who will 12 be responsible for the storage, maintenance, and control of the supply of [auto–injectable] 13 EMERGENCY USE epinephrine. 14 (4) A participating facility may not obtain or store [auto–injectable] 15 EMERGENCY USE epinephrine unless the participating facility has at least two employees 16 or designated affiliated individuals who are certificate holders. 17 (5) Each participating facility shall maintain a copy of the certificate issued 18 to an employee or a designated affiliated individual under § 13–7A–05 of this subtitle. 19 13–7A–03. 20 (a) The Department shall: 21 (5) Develop a method by which certificate holders may submit a report to 22 the Department about each incident that occurred on the premises of a participating facility 23 that involved the administration of [auto–injectable] EMERGENCY USE epinephrine by a 24 certificate holder or an agent; and 25 13–7A–06. 26 (a) (1) A physician licensed to practice medicine in the State may prescribe 27 [auto–injectable] EMERGENCY USE epinephrine in the name of a certificate holder. 28 (2) A pharmacist licensed to practice pharmacy in the State or a physician 29 may dispense [auto–injectable] EMERGENCY USE epinephrine under a prescription issued 30 to a certificate holder. 31 (b) A certificate holder may: 32 SENATE BILL 459 11 (1) On presentment of a certificate, receive from any physician licensed to 1 practice medicine in the State a prescription for [auto–injectable] EMERGENCY USE 2 epinephrine and the necessary paraphernalia for the administration of [auto–injectable] 3 EMERGENCY USE epinephrine; and 4 (2) Possess and store prescribed [auto–injectable] EMERGENCY USE 5 epinephrine and the necessary paraphernalia for the administration of [auto–injectable] 6 EMERGENCY USE epinephrine. 7 (c) In an emergency situation when a physician or emergency medical services 8 are not immediately available, a certificate holder or an agent may administer 9 [auto–injectable] EMERGENCY USE epinephrine to an individual who is experiencing or is 10 believed in good faith by the certificate holder or agent to be experiencing anaphylaxis. 11 13–7A–07. 12 (a) (1) Except as provided in paragraph (2) of this subsection, a cause of action 13 may not arise against a certificate holder for any act or omission if the certificate holder or 14 agent is acting in good faith while administering [auto–injectable] EMERGENCY USE 15 epinephrine to an individual who is experiencing or believed by the certificate holder or 16 agent to be experiencing anaphylaxis except where the conduct of the certificate holder or 17 agent amounts to gross negligence, willful or wanton misconduct, or intentionally tortious 18 conduct. 19 (2) The provisions of paragraph (1) of this subsection do not apply if a 20 certificate holder or participating facility that makes available, or a certificate holder who 21 administers, [auto–injectable] EMERGENCY USE epinephrine to an individual who is 22 experiencing or is believed by the certificate holder or participating facility to be 23 experiencing anaphylaxis: 24 (i) Fails to follow standards and procedures for storage and 25 administration of [auto–injectable] EMERGENCY USE epinephrine; or 26 (ii) Administers [auto–injectable] EMERGENCY USE epinephrine 27 that is beyond the manufacturer’s expiration date. 28 (b) (1) A cause of action may not arise against any physician for any act or 29 omission if the physician in good faith prescribes or dispenses [auto–injectable] 30 EMERGENCY USE epinephrine and the necessary paraphernalia for the administration of 31 [auto–injectable] EMERGENCY USE epinephrine to a certificate holder or participating 32 facility under this subtitle. 33 (2) A cause of action may not arise against any pharmacist for any act or 34 omission if the pharmacist in good faith dispenses [auto–injectable] EMERGENCY USE 35 epinephrine and the necessary paraphernalia for the administration of [auto–injectable] 36 12 SENATE BILL 459 EMERGENCY USE epinephrine to a certificate holder or a participating facility under this 1 subtitle. 2 13–7A–08. 3 (b) An individual may not be held civilly liable in any action arising from or in 4 connection with the administration of [auto–injectable] EMERGENCY USE epinephrine by 5 the individual solely because the individual did not possess a certificate issued under this 6 subtitle. 7 13–7A–09. 8 A certificate holder shall submit to the Department, in the manner required under § 9 13–7A–03 of this subtitle, a report of each incident that occurred on the premises of a 10 participating facility that involved the administration of [auto–injectable] EMERGENCY 11 USE epinephrine by a certificate holder or an agent. 12 Article – Health Occupations 13 14–5F–01. 14 (a) In this subtitle the following words have the meanings indicated. 15 [(c) “Auto–injectable epinephrine” means a portable, disposable drug delivery 16 device that contains a premeasured single dose of epinephrine that is used to treat 17 anaphylaxis in an emergency situation.] 18 [(d)] (C) “Board” means the State Board of Physicians. 19 [(e)] (D) “Committee” means the Naturopathic Medicine Advisory Committee. 20 [(f)] (E) “Council” means the Naturopathic Doctors Formulary Council. 21 [(g)] (F) (1) “Device” means a device used in the diagnosis, treatment, or 22 prevention of disease. 23 (2) “Device” does not include: 24 (i) Any surgical or dental instrument; 25 (ii) Any physical therapy equipment; 26 (iii) Any X–ray apparatus; or 27 (iv) Any component part or accessory of any of the items listed in 28 items (i) through (iii) of this paragraph. 29 SENATE BILL 459 13 (G) “EMERGENCY USE EPINEPH RINE” MEANS A PORTABLE , DISPOSABLE 1 DRUG DELIVERY DEVICE OR PRODUCT APPROVED BY THE FEDERAL FOOD AND 2 DRUG ADMINISTRATION THAT C ONTAINS A PREMEASURE D SINGLE DOSE OF 3 EPINEPHRINE THAT I S USED TO TREAT ANAP HYLAXIS IN AN EMERGE NCY SITUATION. 4 14–5F–04.1. 5 (a) (1) There is a Naturopathic Doctors Formulary Council within the Board. 6 (d) (1) The formulary adopted by the Board shall include: 7 (i) Nonprescription drugs and devices; 8 (ii) Prescription oxygen and [auto–injectable] EMERGENCY USE 9 epinephrine; and 10 (iii) Prescription diaphragms and cervical caps for contraception. 11 14–5F–14. 12 (a) A license authorizes a licensee, consistent with naturopathic education and 13 training and competence demonstrated by passing the naturopathic physician licensing 14 examination, to: 15 (5) Administer [auto–injectable] EMERGENCY USE epinephrine; 16 SECTION 2.
