AN ACT concerning 1 
 
Home Builders – New Home Sales – Notice of Appliance Warranty Registration 2 
 
FOR the purpose of requiring a person registered to build a new home to include in a 3 
contract provide at the time of closing for the initial sale of a new home certain 4 
information about the warranties for appliances registered by the person; and 5 
generally relating to home builders and notice of appliance warranty registration. 6 
 
BY repealing and reenacting, without amendments, 7

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 17 
That the Laws of Maryland read as follows: 18 
 
Article – Business Regulation 19 
 
4.5–101. 20  2 	SENATE BILL 522  
 
 
 
 (a) In this title the following words have the meanings indicated. 1 
 
 (m) (1) “New home” means each newly constructed residential dwelling unit in 2 
the State and the fixtures and structure that are made a part of a newly constructed private 3 
dwelling unit at the time of construction. 4 
 
 (2) “New home” includes: 5 
 
 (i) a custom home as defined in § 10–501(c) of the Real Property 6 
Article; 7 
 
 (ii) a new home to which § 10–301 of the Real Property Article 8 
applies; 9 
 
 (iii) an industrialized building intended for residential use; and 10 
 
 (iv) a mobile home. 11 
 
 (r) “Registrant” means a person registered to build new homes. 12 
 
4.5–603. 13 
 
 (a) (1) This subsection applies only to a development that contains 11 or more 14 
new homes to be built by the same registrant. 15 
 
 (2) Prior to the execution of any contract for the initial sale of a new home, 16 
a registrant shall provide the purchaser with written information about any 17 
energy–efficient options, including a statement that tax credits may be available related to 18 
the energy–efficient options, that are available for installation in the home before 19 
construction of the home is completed. 20 
 
 (b) A registrant shall include in any contract for the initial sale of a new home: 21 
 
 (1) FOR EACH APPLIANCE I N THE NEW HOME , INCLUDING THE 22 
HEATING, VENTILATION, AND AIR–CONDITIONING SYSTEM , THAT WAS REGISTERED 23 
BY THE REGISTRANT , THE WARRANTY INFORMA TION FOR THE APPLIAN CE, 24 
INCLUDING: 25 
 
 (I) THE DATE THE REGISTR ANT REGISTERED THE W ARRANTY; 26 
AND 27 
 
 (II) THE TIME REMAINING U NDER THE WARRANTY ; AND 28 
 
 (2) the information required under § 14–117(a)(3), (i), and (m) of the Real 29

 (A) IN THIS SECTION, “APPLIANCE” INCLUDES A HEATING , VENTILATION, 2 
AND AIR–CONDITIONING SYSTEM . 3 
 
 (B) A REGISTRANT SHALL PRO VIDE, AT THE TIME OF CLOSI NG FOR THE 4 
INITIAL SALE OF A NE W HOME, THE WARRANTY INFORMA TION FOR EACH APPLIA NCE 5 
IN THE NEW HOME THAT WAS REGISTERED BY TH E REGISTRANT, INCLUDING: 6 
 
 (1) THE DATE THE REGISTR ANT REGISTERED THE W ARRANTY; AND 7 
 
 (2) THE TIME REMAINING U NDER THE WARRANTY .  8 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 9 
October 1, 2025.  10
