AN ACT concerning 1 
 
Prince George’s County – District Council Zoning Laws – Override by Municipal 2 
Corporation 3 
 
FOR the purpose of authorizing a municipal corporation in Prince George’s County that is 4 
in the regional district to override certain laws made by the district council under 5 
certain circumstances and by a majority vote of the governing body of the municipal 6 
corporation; and generally relating to zoning laws in Prince George’s County.  7 
 
BY repealing and reenacting, without amendments, 8

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 18 
That the Laws of Maryland read as follows: 19 
 
Article – Land Use 20

 (a) In this division the following words have the meanings indicated. 22 
 
 (q) (1) “Zoning law” means the legislative implementation of regulations for 23 
zoning by a local jurisdiction. 24  2 	SENATE BILL 832  
 
 
 
 (2) “Zoning law” includes a zoning ordinance, zoning regulation, zoning 1 
code, and any similar legislative action to implement zoning controls in a local jurisdiction. 2

 (A) [A] SUBJECT TO SUBSECTION (B) OF THIS SECTION , A municipal 4 
corporation in Prince George’s County that is in the regional district may not exercise any 5 
powers relating to planning, subdivision control, or zoning not granted to the municipal 6 
corporation by the district council under § 25–303 of this article. 7 
 
 (B) (1) A MUNICIPAL CORPORATIO N IN PRINCE GEORGE’S COUNTY THAT 8 
IS IN THE REGIONAL DISTRICT MA Y OVERRIDE A ZONING LAW MADE BY THE 9 
DISTRICT COUNCIL IF THE ZONING LAW AFFECTS LAND WITHIN THE JURISDICTION 10 
OF THE MUNICIPAL COR PORATION. 11 
 
 (2) AN ACTION BY A MUNICI PAL CORPORATION UNDE R THIS 12 
SUBSECTION SHALL BE BY A MAJORI TY VOTE OF THE MEMBE RS OF THE GOVERNING 13 
BODY OF THE MUNICIPA L CORPORATION . 14

 (a) (1) Except as provided in paragraphs (2) and (3) of this subsection AND 16 
SUBJECT TO § 20–709(B) OF THIS DIVISION, within the regional district, the zoning 17 
powers vested by Division I of this article in a municipal corporation or the council of a 18 
municipal corporation within the regional district shall be construed to be vested 19 
exclusively in the appropriate district council. 20 
 
 (2) A municipal corporation in Prince George’s County has concurrent 21 
jurisdiction with Prince George’s County to enforce zoning laws in the boundaries of the 22 
municipal corporation. 23 
 
 (3) The power to enforce zoning laws for the City of Takoma Park and the 24 
Town of Kensington is as provided in §§ 24–201 and 24–202 of this article, respectively. 25 
 
 SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 26 
October 1, 2025. 27
