AN ACT concerning 1 
 
Baltimore City – Alcoholic Beverages – Authorizations and Revisions 2 
 
FOR the purpose of requiring the Board of License Commissioners for Baltimore City to 3 
impose a fee for expedited processing of certain Class C per diem licenses; requiring 4 
the Board to adopt regulations related to the application process for Class C per diem 5 
licenses, including for the denial or revocation of the licenses, and limiting the 6 
number of licenses that may be issued to a person for the same location within a 7 
certain period of time; authorizing the Board to issue certain alcoholic beverages 8 
licenses for certain locations in the 40th alcoholic beverages district; prohibiting 9 
certain license holders in a certain area of the 40th alcoholic beverages district from 10 
selling alcoholic beverages at certain times of day; and generally relating to alcoholic 11 
beverages in Baltimore City. 12

 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 6 
That the Laws of Maryland read as follows: 7

 This title applies only in Baltimore City. 10 
 
12–1311. 11 
 
 (a) The Board shall set the license fee for a Class C per diem beer license and a 12 
Class C per diem beer and wine license. 13 
 
 (b) (1) The Board shall set the license fee for a Class C per diem beer, wine, 14 
and liquor license. 15 
 
 (2) The Board may collect from the license holder reimbursement for costs 16 
incurred while monitoring the event for which the license is issued. 17 
 
 (C) THE BOARD SHALL IMPOSE A FEE OF NOT MORE THAN $250 FOR 18 
EXPEDITED PROCESSING OF A PER DIEM LICENSE APPLICA TION IF THE 19 
APPLICATION IS SUBMI TTED LESS THAN 2 WEEKS BEFORE THE SCH EDULED EVENT 20 
REQUIRING THE PER DI EM LICENSE. 21

 (A) THE BOARD SHALL ADOPT REG ULATIONS RELATING TO THE 23 
APPLICATION PROCESS FOR CLASS C PER DIEM LICENSES ISSUED IN ACCORDANCE 24 
WITH §§ 4–1203 AND 4–1204 OF THIS ARTICLE. 25 
 
 (B) REGULATIONS ADOPTED B Y THE BOARD UNDER THIS SECT ION MAY 26 
AUTHORIZE THE BOARD TO: 27 
 
 (1) DENY OR REVOKE A CLASS C PER DIEM LICENSE ; OR 28 
 
 (2) LIMIT THE NUMBER OF CLASS C PER DIEM LICENSES THAT M AY 29 
BE ISSUED TO A PERSO N FOR THE SAME LOCAT ION WITHIN A CALENDA R YEAR. 30

 (a) The alcoholic beverages districts described in this section at all times are 2 
coterminous with the legislative districts in the Legislative Districting Plan of 2022. 3 
 
 (b) Except as provided in subsection (c) of this section, the Board may not issue a 4 
new license in: 5 
 
 (1) the 40th alcoholic beverages district; 6 
 
 (2) the 41st alcoholic beverages district; 7 
 
 (3) the 43rd alcoholic beverages district; 8 
 
 (4) the 44th alcoholic beverages district; and 9 
 
 (5) the 45th alcoholic beverages district. 10 
 
 (c) The Board may issue: 11 
 
 (1) in the alcoholic beverages districts specified in subsection (b) of this 12 
section: 13 
 
 (ii) a Class B beer, wine, and liquor license to a restaurant that: 14 
 
 1. has a minimum capital investment, not including the cost 15 
of land and buildings, of $200,000 for restaurant facilities; and 16 
 
 2. has a minimum seating capacity of 75 individuals; 17 
 
 (17) a Class A–7 beer, wine, and liquor license in the 1200 block of West 18 
North Avenue in the 40th alcoholic beverages district, if: 19 
 
 (i) the applicant executes a memorandum of understanding with the 20 
Penn North Community Association; 21 
 
 (ii) alcoholic beverages are sold only as part of a gift basket or floral 22 
arrangement; and 23 
 
 (iii) the applicant does not hold or apply for a Class BWLT beer, wine, 24 
and liquor (on–premises) tasting license; [and] 25 
 
 (18) a Class B beer, wine, and liquor license for a restaurant on the even 26 
side of the 400 block of West 29th Street in the 40th alcoholic beverages district if: 27 
 
 (i) the applicant executes a memorandum of understanding with the 28 
Greater Remington Improvement Association; and 29  4 	SENATE BILL 939  
 
 
 
 (ii) the Board waives a minimum seating requirement under item 1 
(1)(ii)2 of this subsection; 2 
 
 (19) A CLASS C BEER AND LIGHT WINE LICENSE IN THE 2500 BLOCK OF 3 
WEST NORTH AVENUE IN THE 40TH ALCOHOLIC BEVERAG ES DISTRICT TO BE US ED 4 
DURING ON–CAMPUS EVENTS IF : 5 
 
 (I) THE APPLICANT EXECUT ES A MEMORANDUM OF 6 
UNDERSTANDING WITH T HE GREATER MONDAWMIN COORDINATING COUNCIL; AND 7 
 
 (II) THE BOARD WAIVES ANY REQU IREMENTS THAT SALES CAN 8 
BE MADE ONLY TO MEMB ERS AND THE GUESTS O F MEMBERS; 9 
 
 (20) A CLASS C BEER AND WINE LICENS E ON THE ODD SIDE OF THE 800 10 
BLOCK OF NORTH HOWARD STREET IN THE 40TH ALCOHOLIC BEVERAG ES DISTRICT 11 
IF:  12 
 
 (I) THE APPLICANT DOES N OT CONVERT THE LICEN SE TO A 13

OCCUPATIONS AND PROFESSIONS ARTICLE;  25 
 
 (VI) THE BOARD WAIVES ANY REQU IREMENTS THAT SALES CAN 26 
BE MADE ONLY TO MEMB ERS AND THE GUESTS OF ME MBERS; AND 27

 (d) (1) This subsection does not apply to: 16 
 
 (i) a Class B beer and light wine (restaurant) license; 17

§ 12–1603(c)(1)(ii) of this title; 19 
 
 (iii) a Class B–BWL (H–M) license; 20 
 
 (iv) a Class C beer and wine license; 21 
 
 (v) a Class C beer, wine, and liquor license; 22 
 
 (vi) an arena license; [or] 23 
 
 (vii) a marketplace license; OR 24 
 
 (VIII) A CLASS M–F (MUNICIPAL FAMILY FUN CENTER) LICENSE. 25 
 
 (2) For a license holder in the 40th alcoholic beverages district, the hours 26 
of sale for alcoholic beverages may not begin before 10 a.m. or end after 10 p.m.: 27 
 
 (i) within an area bounded: 28

 1. from the intersection of Reisterstown Road and Quantico 1 
Avenue, northwest on Reisterstown Road to the intersection with Wylie Avenue, northeast 2 
on Wylie Avenue to the intersection with Pimlico Road, northwest on Pimlico Road to the 3 
intersection with Dupont Avenue, east on Dupont Avenue to the intersection with Pall Mall 4 
Road, southeast on Pall Mall Road to the intersection with Edgecombe Circle North, east 5 
on Edgecombe Circle North to the intersection with Finney Avenue, south on Finney 6 
Avenue to the intersection with Oakford Avenue, west on Oakford Avenue to the 7

 (ii) within the area of West North Avenue between the 1000 block of 19

 (iii) for a license holder within 250 yards in any direction of the area 21 
described in item (ii) of this paragraph; AND 22 
 
 (IV) WITHIN AN AREA BOUND ED AS FOLLOWS : FROM THE 23 
INTERSECTION OF NORTH FULTON AVENUE WITH NORTH AVENUE, NORTH ON 24 
NORTH FULTON AVENUE TO THE INTERSE CTION WITH PENNSYLVANIA AVENUE, 25 
NORTHEAST ON NORTH FULTON AVENUE TO THE INTERSE CTION WITH DRUID HILL 26 
AVENUE, SOUTHEAST ON DRUID HILL AVENUE TO THE IN TERSECTION WITH 27 
MOSHER STREET, SOUTHWEST ON MOSHER STREET TO THE INTERSE CTION WITH 28
