4 F.  The procurement of goods or services involves expenditures of $25,000 or less, in 
5 which case the Director of the Bureau of General Services may accept informal written 
6 quotes or bids; or
7 as amended by PL 1999, c. 105, §3, is 
8 further amended to read:
9 G.  The procurement of goods or services involves expenditures of $10,000 or less, and 
10 procurement from a single source is the most economical, effective and appropriate 
11 means of fulfilling a demonstrated need.; or

13 H.  The procurement of goods or services is consistent with the purposes and duties of 
14 the Maine Development Foundation under Title 10, section 917-A and procuring those 
15 goods or services from the Maine Development Foundation is the most economical, 
16 effective and appropriate means of fulfilling a demonstrated need.

20 The Board of Directors of the Maine Development Foundation, referred to in this 
21 chapter as "the "board of directors," consists of a minimum of 15 directors elected or 
22 appointed to serve in that capacity in accordance with this section.  The board of directors 
23 shall annually determine the number of directors for the succeeding year.  The corporators 
24 shall elect 1/2 of the elected directors from among the private sector corporators and 1/2 of 
25 the elected directors from among the public sector corporators.  The Governor shall appoint 
26 2 directors from among the ex officio corporators.  Except for the president of the Maine 
27 Development Foundation, a person may not serve as a director for more than 5 years in 
28 succession. Elected directors must be elected to 4-year staggered terms, as provided by the 
29 board of directors, and may not be elected for more than 2 successive terms. The 
30 corporators shall elect a chair, a vice-chair and a treasurer from among the board of 
31 directors. The board of directors shall appoint a president of the Maine Development 
32 Foundation.  The president may not be appointed from among the other directors.  Upon 
33 appointment, the president becomes a director and the chief executive officer of the Maine 
34 Development Foundation.

36 This bill revises the term limits of the Board of Directors of the Maine Development 
37 Foundation.  The bill also authorizes the Director of the Bureau of General Services within 
38 the Department of Administrative and Financial Services to waive the competitive bidding 
39 requirement if the procurement of goods or services is consistent with the purposes and 
40 duties of the Maine Development Foundation and procuring those goods or services from 
41 the Maine Development Foundation is the most economical, effective and appropriate 
42 means of fulfilling a demonstrated need.
