Policy That Allows a Student to Use a Restroom Designated for Use 
by the Opposite Sex

4 the contrary within Title 5, chapter 337, a school administrative unit may not adopt a policy 
5 that permits a student to use a sanitary facility according to the student's gender identity if 
6 that sanitary facility is designated for use by a sex that does not correspond to the student's 
7 sex assigned at birth.
8  The Department of Education 
9 shall update its rules as necessary to conform with the Maine Revised Statutes, Title 20-A, 
10 section 6501, subsection 6.

12 This bill prohibits a school administrative unit from adopting a policy that permits a 
13 student to use a school restroom according to the student's gender identity if that restroom 
14 is designated for use by a sex that does not correspond to the student's sex assigned at birth. 
15 The bill also directs the Department of Education to update its rules consistent with this 
16 legislation.
