Page 1 - 132LR1184(01) 1 2 is enacted to read: 3 4 with a condition that the purchaser may not transfer the ticket with or without consideration 5 to a 3rd party without permission of the person or without an added fee. If a person sells or 6 offers to sell a ticket by means of a system that does not allow for the transferability of the 7 ticket, the person shall provide the purchaser at the time of the initial sale the option to 8 purchase the ticket in another form that is transferable to a 3rd party without an added fee 9 for the transferable ticket. A person may not disallow a ticket holder admission to an event 10 solely because the ticket has been resold. This subsection does not apply to a ticket sold or 11 offered for sale to a student of a public institution of higher education for an entertainment 12 event held by or on behalf of the institution or to a place of entertainment with a seating 13 capacity of not more than 3,500 individuals if the place of entertainment provides written 14 notice to the Commissioner of Administrative and Financial Services of the intent not to 15 comply with the provisions of this subsection. 16 17 This bill prohibits a seller of a ticket to an entertainment event from prohibiting the 18 purchaser from transferring the ticket with or without consideration to a 3rd party, requires 19 the seller to offer the option of a transferable ticket if the ticketing system does not allow 20 for a ticket to be transferred and prohibits a person from denying a ticket holder admission 21 to an entertainment event solely because the ticket has been resold. This bill does not apply 22 to tickets sold to students for events at public institutions of higher education or to places 23 of entertainment with a seating capacity of 3,500 or less if the place of entertainment 24 provides written notice to the Commissioner of Administrative and Financial Services. 17 18 19 20 21 22 23 24
