| 1 | 1 | | HOUSE BILL NO. 4089 A bill to amend 1976 PA 451, entitled "The revised school code," (MCL 380.1 to 380.1852) by adding section 1308h. the people of the state of michigan enact: Sec. 1308h. (1) The school safety and mental health commission is created within the department. (2) The commission must consist of all of the following members who must be appointed as follows: (a) One member appointed by the speaker of the house of representatives who has experience in school mental health. (b) One member appointed by the speaker of the house of representatives who has a background in law enforcement. (c) One member appointed by the speaker of the house of representatives who is a parent. (d) One member appointed by the senate majority leader who is a school psychologist or psychiatrist. (e) One member appointed by the senate majority leader who is a prosecutor. (f) One member appointed by the senate majority leader who is a teacher. (g) One member appointed by the governor who has a background in school administration. (h) One member appointed by the governor who has experience in school-threat assessments. (i) One member appointed by the governor who has experience in the provision of inpatient treatment to children under age 18. (3) The term of a member of the commission is 4 years. (4) If a vacancy occurs on the commission, an individual must be appointed in the same manner as prescribed under subsection (2) to fill the vacancy for the balance of the term. (5) The governor may remove a member of the commission for incompetence, dereliction of duty, malfeasance, or nonfeasance in office, or any other good cause. (6) The commission shall meet at least monthly. (7) A majority of the members of the commission constitutes a quorum for transacting business. A vote of the majority of the members of the commission serving is required for any action of the commission. (8) The commission shall conduct its business in compliance with the open meetings act, 1976 PA 267, MCL 15.261 to 15.275. (9) A writing that is prepared, owned, used, possessed, or retained by the commission in performing an official function is subject to the freedom of information act, 1976 PA 442, MCL 15.231 to 15.246. (10) A member of the commission is not entitled to compensation for service on the commission, but the commission may reimburse a member for actual and necessary expenses incurred in serving. (11) The commission shall do all of the following: (a) Collaborate with entities and state agencies, including, but not limited to, the department and the office of school safety within the department of state police, to reduce youth suicides and strengthen the mental health of school-aged children, adolescents, and their families in a comprehensive, statewide approach. (b) Seek input from educational professionals, mental health professionals, and organizations from across this state to work together to identify and support students at risk of behavioral health issues. (c) Collaborate with the Michigan suicide prevention commission on recommendations regarding youth suicide. (d) Create and maintain an online community through which best practices and resources can be shared, host professional trainings, and engage in public awareness efforts regarding mental health issues and resources. (e) Work with mental health coordinators and civilian school safety specialists as described in section 1308g and act as a liaison for the coordinators and managers to facilitate and aid the communication of best practices. (f) Review possible uses of and make recommendations for the use of funding under section 97 of the state school aid act of 1979, MCL 388.1697, and provide an analysis of the effectiveness of programs, products, and vendors that have received or will receive money from funding under section 97 of the state school aid act of 1979, MCL 388.1697. (g) Convey recommendations to the department of licensing and regulatory affairs and the bureau of construction codes within the department of licensing and regulatory affairs concerning building construction that is consistent with school safety needs. (12) The commission may hire an executive director and staff. (13) As used in this section, "commission" means the school safety and mental health commission created in subsection (1). |
