11 HOUSE BILL NO. 4690 A bill to amend 1927 PA 175, entitled "The code of criminal procedure," (MCL 760.1 to 777.69) by adding section 3a to chapter IX. the people of the state of michigan enact: CHAPTER IX Sec. 3a. (1) If the court orders a defendant to attend a treatment program as part of a sentence or a condition of a deferred proceeding, the court shall inquire, on the record, if the defendant has an objection to a religious element of that treatment program. If the defendant objects to a religious element of the treatment program, the court shall identify a secular treatment program that the defendant confirms on the record eliminates the defendant's religious objection. If a secular treatment program is not available locally, the court shall allow the defendant to participate in a secular treatment program online. (2) As used in this section: (a) "Secular treatment program" means a treatment program that does not ask the participants to engage in religious practices such as prayer or reliance on a God. (b) "Treatment program" means any court-ordered substance use disorder recovery program. Enacting section 1. This amendatory act takes effect 90 days after the date it is enacted into law.
