1	1	HOUSE BILL NO. 6094 A bill to require certain training and equipment with respect to cardiac arrest in senior living facilities; to provide for the powers and duties of certain state and local governmental officers and entities; and to prescribe civil sanctions. the people of the state of michigan enact: Sec. 1. As used in this act: (a) "Activities of daily living" includes, but is not limited to, the following services that are available 24 hours a day: (i) Personal services. (ii) Supportive services. (iii) Intermittent health-related services. (b) "Adult foster care facility" means that term as defined in section 3 of the adult foster care facility licensing act, 1979 PA 218, MCL 400.703. (c) "AED" means automated external defibrillator. (d) "Assisted living facility" means an unlicensed entity that offers community-based residential care for not fewer than 3 unrelated adults who are 65 years of age or older or who need assistance with activities of daily living. (e) "Home for the aged" means that term as defined in section 20106 of the public health code, 1978 PA 368, MCL 333.20106. (f) "Nursing home" means that term as defined in section 20109 of the public health code, 1978 PA 368, MCL 333.20109. (g) "Senior living facility" means all of the following: (i) An adult foster care facility. (ii) A home for the aged. (iii) An assisted living facility. (iv) A nursing home. (v) An independent living facility. Sec. 5. Beginning 1 year after the effective date of this act, the owner or operator of a senior living facility shall do all of the following: (a) Provide a training course taught by the American Red Cross, the American Heart Association, or an equivalent organization approved by the department of licensing and regulatory affairs, to employees of the senior living facility and interested residents in both of the following areas: (i) Basic cardiopulmonary resuscitation. (ii) AED use. (b) Have available on the premises of the senior living facility an AED deployed in a manner that provides obvious and ready accessibility to employees, residents, and guests of the senior living facility. Sec. 7. A person who violates this act is responsible for a state civil infraction and may be ordered to pay a civil fine of not more than $500.00.
