11 HOUSE JOINT RESOLUTION U A joint resolution proposing an amendment to the state constitution of 1963, by adding section 29 to article I, to recognize a right to hunt, fish, trap, and harvest wildlife. Resolved by the Senate and House of Representatives of the state of Michigan, That the following amendment to the state constitution of 1963, to recognize a right to hunt, fish, trap, and harvest wildlife, is proposed, agreed to, and submitted to the people of the state: article I Sec. 29. (1) In recognition of this state's heritage and to promote the continued health of its natural bounty, all citizens have a right to hunt, fish, trap, and harvest wildlife. (2) The right to hunt, fish, trap, and harvest wildlife is subject only to regulations that promote sound wildlife conservation and management, and this state shall afford reasonable times allowing citizens to exercise these rights consistent with sound conservation and management practices. (3) Public hunting, fishing, and trapping is a preferred means of managing and controlling nonthreatened species, and citizens may use traditional methods for harvesting wildlife. (4) This section does not alter, repeal, or modify any of the following: (a) Common law or statute relating to any of the following: (i) Trespass. (ii) Private property rights. (iii) Eminent domain. (iv) Public ownership of property. (v) Firearms unrelated to hunting. (b) The sovereign immunity of this state. Resolved further, That the foregoing amendment shall be submitted to the people of the state at the next general election in the manner provided by law.
