66 1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
77 1.7 Section 1. Minnesota Statutes 2022, section 124D.09, subdivision 5, is amended to read:​
88 1.8 Subd. 5.Authorization; notification.Notwithstanding any other law to the contrary,​
99 1.9an 11th or 12th grade pupil enrolled in a school or an American Indian-controlled tribal​
1010 1.10contract or grant school eligible for aid under section 124D.83, except a foreign exchange​
1111 1.11pupil enrolled in a district under a cultural exchange program, may apply to an eligible​
1212 1.12institution, as defined in subdivision 3, to enroll in nonsectarian courses offered by that​
1313 1.13postsecondary institution. If an institution accepts a secondary pupil for enrollment under​
1414 1.14this section, the institution shall send written notice to the pupil, the pupil's school or school​
1515 1.15district, and the commissioner. The notice must indicate the course and hours of enrollment​
1616 1.16of that pupil. If the pupil enrolls in a course for postsecondary credit, the institution must​
1717 1.17notify:​
1818 1.18 (1) the pupil about payment in the customary manner used by the institution.; and​
1919 1.19 (2) the pupil's school as soon as practicable if the pupil withdraws from the course or​
2020 1.20stops attending the course.​
2121 1.21 EFFECTIVE DATE.This section is effective July 1, 2023.​

3030 Referred to Higher Education​ 2.1 Sec. 2. Minnesota Statutes 2022, section 124D.09, subdivision 12, is amended to read:​
3131 2.2 Subd. 12.Credits; grade point average weighting policy.(a) A pupil must not audit​
3232 2.3a course under this section.​
3333 2.4 (b) A district shall must grant academic credit to a pupil enrolled in a course for secondary​
3434 2.5credit if the pupil successfully completes the course. Seven quarter or four semester college​
3535 2.6credits equal at least one full year of high school credit. Fewer college credits may be​
3636 2.7prorated. A district must also grant academic credit to a pupil enrolled in a course for​
3737 2.8postsecondary credit if secondary credit is requested by a pupil. If no comparable course is​
3838 2.9offered by the district, the district must, as soon as possible, notify the commissioner, who​
3939 2.10shall must determine the number of credits that shall must be granted to a pupil who​
4040 2.11successfully completes a course. If a comparable course is offered by the district, the school​
4141 2.12board shall must grant a comparable number of credits to the pupil. If there is a dispute​
4242 2.13between the district and the pupil regarding the number of credits granted for a particular​
4343 2.14course, the pupil may appeal the board's decision to the commissioner. The commissioner's​
4444 2.15decision regarding the number of credits shall be is final.​
4545 2.16 (c) A school board must adopt a policy regarding weighted grade point averages for any​
4646 2.17high school or dual enrollment course. The policy must state whether the district offers​
4747 2.18weighted grades. A school board must annually publish on its website a list of courses for​
4848 2.19which a student may earn a weighted grade.​
4949 2.20 (d) The secondary credits granted to a pupil must be counted toward the graduation​
5050 2.21requirements and subject area requirements of the district. Evidence of successful completion​
5151 2.22of each course and secondary credits granted must be included in the pupil's secondary​
5252 2.23school record. A pupil shall must provide the school with a copy of the pupil's grade grades​
5353 2.24in each course taken for secondary credit under this section, including interim or nonfinal​
5454 2.25grades earned during the academic term. Upon the request of a pupil, the pupil's secondary​
5555 2.26school record must also include evidence of successful completion and credits granted for​
5656 2.27a course taken for postsecondary credit. In either case, the record must indicate that the​
5757 2.28credits were earned at a postsecondary institution.​
5858 2.29 (e) If a pupil enrolls in a postsecondary institution after leaving secondary school, the​
5959 2.30postsecondary institution must award postsecondary credit for any course successfully​
6060 2.31completed for secondary credit at that institution. Other postsecondary institutions may​
6161 2.32award, after a pupil leaves secondary school, postsecondary credit for any courses​
6262 2.33successfully completed under this section. An institution may not charge a pupil for the​
6363 2.34award of credit.​

6666 3.2Board of Regents of the University of Minnesota must, and private nonprofit and proprietary​
6767 3.3postsecondary institutions should, award postsecondary credit for any successfully completed​
6868 3.4courses in a program certified by the National Alliance of Concurrent Enrollment Partnerships​
6969 3.5offered according to an agreement under subdivision 10. Consistent with section 135A.101,​
7070 3.6subdivision 3, all MnSCU institutions must give full credit to a secondary pupil who​
7171 3.7completes for postsecondary credit a postsecondary course or program that is part or all of​
7272 3.8a goal area or a transfer curriculum at a MnSCU institution when the pupil enrolls in a​
7373 3.9MnSCU institution after leaving secondary school. Once one MnSCU institution certifies​
7474 3.10as completed a secondary student's postsecondary course or program that is part or all of a​
7575 3.11goal area or a transfer curriculum, every MnSCU institution must consider the student's​
7676 3.12course or program for that goal area or the transfer curriculum as completed.​
7777 3.13 EFFECTIVE DATE.This section is effective July 1, 2023.​
