55 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
66 1.6 Section 1. Minnesota Statutes 2024, section 256B.056, subdivision 8, is amended to read:​
77 1.7 Subd. 8.Cooperation.To be eligible for Medical assistance, applicants and recipients​
88 1.8must may cooperate with the state and local agency to identify potentially liable third-party​
99 1.9payers and assist the state in obtaining third-party payments, unless good cause for​
1010 1.10noncooperation is determined according to Code of Federal Regulations, title 42, part​
1111 1.11433.147. "Cooperation" includes identifying any third party who may be liable for care and​
1212 1.12services provided under this chapter to the applicant, recipient, or any other family member​
1313 1.13for whom application is made and providing relevant information to assist the state in​
1414 1.14pursuing a potentially liable third party. Cooperation also includes providing information​
1515 1.15about a group health plan for which the person may be eligible and if the plan is determined​
1616 1.16cost-effective by the state agency and premiums are paid by the local agency or there is no​
1717 1.17cost to the recipient, they must the person may enroll or remain enrolled with the group.​
1818 1.18For purposes of this subdivision, coverage provided by the Minnesota Comprehensive​
1919 1.19Health Association under chapter 62E shall not be considered group health plan coverage​
2020 1.20or cost-effective by the state and local agency. Cost-effective insurance premiums approved​
2121 1.21for payment by the state agency and paid by the local agency are eligible for reimbursement​
2222 1.22according to section 256B.19.​
