1.1 A bill for an act 1.2 relating to transportation; modifying certain employment requirements for 1.3 third-party testing program applicants; amending Minnesota Statutes 2024, section 1.4 171.3213. 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. Minnesota Statutes 2024, section 171.3213, is amended to read: 1.7 171.3213 THIRD-PARTY TESTING OF SCHOOL BUS DRIVERS; APPLICANT 1.8REQUIREMENT . 1.9 (a) A school district that is a third-party testing program and owns or operates school 1.10buses may enter into an agreement with other school districts to test the other districts' 1.11school bus driver employees. A school bus company that is a third-party testing program 1.12and owns or operates school buses may enter into an agreement with other school bus 1.13companies to test the other companies' school bus driver employees. A third-party testing 1.14program may be reimbursed by the tested driver's school district or company. The agreement 1.15must be submitted to the commissioner for approval. A certified third-party tester must be 1.16employed by a school district or a school bus company providing the testing services. 1.17 (b) Notwithstanding any rule or statute to the contrary, a test applicant's test results and 1.18test passage administered under a third-party testing program are contingent upon: 1.19 (1) remaining employed with the third-party testing program for six months following 1.20the test administration date; or 1.21 (2) completing the approved school bus driver training program. 1Section 1.
