11 1.1 A bill for an act​
2-1.2 relating to child care; allowing aides to supervise children in child care under
3-1.3 certain circumstances; amending Minnesota Statutes 2024, section 142B.41, by
4-1.4 adding a subdivision.
5-1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
6-1.6 Section 1. Minnesota Statutes 2024, section 142B.41, is amended by adding a subdivision
7-1.7to read:
8-1.8 Subd. 7a.Staff distribution.Notwithstanding Minnesota Rules, part 9503.0040, subpart
9-1.92, item B, an aide may substitute for a teacher during morning arrival and afternoon departure
10-1.10times in a licensed child care center if the total arrival and departure time does not exceed
11-1.1125 percent of the center's daily hours of operation. In order for an aide to be used in this
12-1.12capacity, an aide must:
13-1.13 (1) be at least 18 years of age;
14-1.14 (2) have worked in the licensed child care center for a minimum of 30 days; and
15-1.15 (3) have completed all preservice and first-90-days training required for licensing.​
16-1.16 EFFECTIVE DATE.This section is effective July 1, 2025.​

4+1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
5+1.5 Section 1. DIRECTION TO COMMISSIONER; AMENDING STAFF
6+1.6DISTRIBUTION RULES FOR CHILD CARE CENTERS.​
7+1.7 The commissioner of children, youth, and families shall amend Minnesota Rules to make
8+1.8the exception in Laws 2023, chapter 70, article 8, section 63, permanent. Notwithstanding​
9+1.9any other requirements for good cause exempt rulemaking, the commissioner may use the
10+1.10procedure under Minnesota Statutes, section 14.388, subdivision 1, clause (3), for changes
11+1.11to Minnesota Rules pursuant to this section. Minnesota Statutes, section 14.386, does not
12+1.12apply to rules amended pursuant to this section except as provided under Minnesota Statutes,​
13+1.13section 14.388. The commissioner must submit a proposed rule pursuant to this section to
14+1.14the Office of Administrative Hearings pursuant to Minnesota Statutes, section 14.388,
15+1.15subdivision 1, no later than June 1, 2025.​
16+1.16 EFFECTIVE DATE.This section is effective the day following final enactment.​
