1.1 A bill for an act 1.2 relating to liquor; establishing a food truck license for the sale of intoxicating 1.3 liquor; amending Minnesota Statutes 2024, section 340A.404, by adding a 1.4 subdivision. 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. Minnesota Statutes 2024, section 340A.404, is amended by adding a subdivision 1.7to read: 1.8 Subd. 15.Food truck.(a) The governing body of a municipality may issue a temporary 1.9license to a food truck for the on-sale of intoxicating liquor at a community festival or event, 1.10or a private event that the food truck has entered into a contract with a person to cater. For 1.11purposes of this section, "food truck" means a business that is licensed or permitted by the 1.12licensing authority to prepare and sell food from a motorized vehicle or trailer within the 1.13municipality. 1.14 (b) A license under this subdivision must specify the conditions under which the 1.15intoxicating liquor must be dispensed and consumed and shall not be issued unless the 1.16licensee demonstrates that it has liability insurance as prescribed by section 340A.409 to 1.17cover the event. The license under this subdivision authorizes sales on all days of the week 1.18to persons attending a community festival or event, or, for a private event, to the person 1.19who has entered into a catering contract with the food truck, and the person's guests. 1.20 (c) A license under this subdivision is subject to the terms, including a license fee, 1.21imposed by the issuing municipality and all laws and ordinances governing the sale of 1.22intoxicating liquor.
