1111 1.11BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
1212 1.12 Section 1. Minnesota Statutes 2024, section 168.013, subdivision 1e, is amended to read:​
1313 1.13 Subd. 1e.Truck; tractor; combination; exceptions.(a) On trucks and tractors except​

6161 2.26those owners who declare a weight less than 55,000 pounds, a distinctive weight sticker​
6262 2.27must be issued and the owner is restricted to a gross vehicle weight of less than 55,000​

6464 2.29 (e) Truck-tractors except those herein defined as farm vehicles shall be taxed in​
6565 2.30accordance with the foregoing gross weight tax schedule on the basis of the combined gross​
6666 2.31weight of the truck-tractor and any semitrailer or semitrailers which the applicant proposes​
6767 2.32to combine with the truck-tractor.​
6868 2.33 (f) On trucks, truck-tractors and semitrailer combinations, except those defined as farm​
6969 2.34trucks and farm combinations, the tax for each of the first eight years of vehicle life is 100​
7070 2.35percent of the tax imposed in the Minnesota base rate schedule, and during the ninth and​
7171 2​Section 1.​

7474 3.3 (g) For the purpose of registration, trailers coupled with a truck-tractor, semitrailer​
7575 3.4combination are semitrailers.​
7676 3.5 Sec. 2. Minnesota Statutes 2024, section 168.013, subdivision 3, is amended to read:​
7777 3.6 Subd. 3.Application; cancellation; excessive gross weight forbidden.(a) The applicant​
7878 3.7for all licenses based on gross weight shall state the unloaded weight of the motor vehicle,​
7979 3.8trailer, or semitrailer and the maximum load the applicant proposes to carry on it, the sum​
8080 3.9of which constitutes the gross weight upon which the license tax must be paid. However,​
8181 3.10the declared gross weight upon which the tax is paid must not be less than 1-1/4 times the​
8282 3.11declared unloaded weight of the motor vehicle, trailer, or semitrailer to be registered, except​
8383 3.12recreational vehicles taxed under subdivision 1g, school buses taxed under subdivision 18,​
8484 3.13and tow trucks or towing vehicles defined in section 168B.011, subdivision 12a. The gross​
8585 3.14weight of a tow truck or towing vehicle is the actual weight of the tow truck or towing​
8686 3.15vehicle fully equipped, but does not include the weight of a wrecked or disabled vehicle​
8787 3.16towed or drawn by the tow truck or towing vehicle.​
8888 3.17 (b) Except as provided by special permit issued under section 169.86, The gross weight​
8989 3.18of a motor vehicle, trailer, or semitrailer must not exceed the gross weight upon which the​
9090 3.19license tax has been paid by more than four percent or 1,000 pounds, whichever is greater;​
9191 3.20provided that, a vehicle transporting unfinished forest products on a highway, other than a​
9292 3.21highway that is part of the system of interstate and defense highways, unless a federal​
9393 3.22exemption is granted, in accordance with paragraph (d), clause (3):.​
9494 3.23 (1) shall not exceed its gross vehicle weight upon which the license tax has been paid,​
9595 3.24or gross axle weight on any axle, by more than five percent and, notwithstanding other law​
9696 3.25to the contrary, is not subject to any fee, fine, or other assessment or penalty for exceeding​
9797 3.26a gross vehicle or axle weight by up to five percent. This clause applies year round to​
9898 3.27suppliers of unfinished forest products to mills; and​
9999 3.28 (2) is not subject to any provision of paragraph (d) or chapter 169 limiting the gross axle​
100100 3.29weight of any individual axle unless the entire vehicle also exceeds its gross vehicle weight​
101101 3.30plus its weight allowance allowed in clause (1) and plus any weight allowance permitted​
102102 3.31under section 169.826 or 169.8261, in which case the vehicle is subject to all applicable​
103103 3.32penalties for excess weight violations.​
104104 3​Sec. 2.​
105105 REVISOR KRB/DG 25-01073​12/12/24 ​ 4.1 (c) The gross weight of the motor vehicle, trailer, or semitrailer for which the license​
106106 4.2tax is paid must be indicated by a distinctive character on the license plate or plates except​
107107 4.3as provided in subdivision 12 or section 169.86, subdivision 5a, as applicable, and the plate​
108108 4.4or plates must be kept clean and clearly visible at all times.​
109109 4.5 (d) The owner, driver, or user of a motor vehicle, trailer, or semitrailer, upon conviction​
110110 4.6for transporting a gross weight in excess of the gross weight for which it was registered or​
111111 4.7for operating a vehicle with an axle weight exceeding the maximum lawful axle load weight,​
112112 4.8is guilty of a misdemeanor and subject to increased registration or reregistration according​
113113 4.9to the following schedule:​
114114 4.10 (1) Upon conviction for transporting a gross weight in excess of the gross weight for​
115115 4.11which a motor vehicle, trailer, or semitrailer is registered by more than the allowance set​
116116 4.12forth in paragraph (b) but less than 25 percent, or for operating or using a motor vehicle,​
117117 4.13trailer, or semitrailer with an axle weight exceeding the maximum lawful axle load as​
118118 4.14provided in sections 169.822 to 169.829 by more than the allowance set forth in paragraph​
119119 4.15(b) but less than 25 percent, the owner, driver, or user of the motor vehicle, trailer, or​
120120 4.16semitrailer used to commit the violation, in addition to any penalty imposed for the​
121121 4.17misdemeanor, shall apply to the registrar to increase the authorized gross weight to be carried​
122122 4.18on the vehicle to a weight equal to or greater than the gross weight the owner, driver, or​
123123 4.19user was convicted of carrying. The increase is computed for the balance of the calendar​
124124 4.20year on the basis of 1/12 of the annual tax for each month remaining in the calendar year​
125125 4.21beginning with the first day of the month in which the violation occurred. If the additional​
126126 4.22registration tax computed upon that weight, plus the tax already paid, amounts to more than​
127127 4.23the regular tax for the maximum gross weight permitted for the vehicle under sections​
128128 4.24169.822 to 169.829 section 169.824, that additional amount must nevertheless be paid into​
129129 4.25the highway fund, but the additional tax thus paid does not authorize or permit any person​
130130 4.26to operate the vehicle with a gross weight in excess of the maximum legal weight as provided​
131131 4.27by sections 169.822 to 169.829 section 169.824. Unless the owner within 30 days after a​
132132 4.28conviction applies to increase the authorized weight and pays the additional tax as provided​
133133 4.29in this section, the registrar shall revoke the registration on the vehicle and demand the​
134134 4.30return of the registration card and plates issued on that registration.​
135135 4.31 (2) Upon conviction of an owner, driver, or user of a motor vehicle, trailer, or semitrailer​
136136 4.32for transporting a gross weight in excess of the gross weight for which the motor vehicle,​
137137 4.33trailer, or semitrailer was registered by 25 percent or more or for operating or using the​
138138 4.34vehicle or trailer with an axle weight exceeding the maximum lawful axle load as provided​
139139 4.35in sections 169.822 to 169.829 by 25 percent or more, and in addition to any penalty imposed​
140140 4​Sec. 2.​
141141 REVISOR KRB/DG 25-01073​12/12/24 ​ 5.1for the misdemeanor, the registrar shall either (i) cancel the reciprocity privileges on the​
142142 5.2vehicle involved if the vehicle is being operated under reciprocity or (ii) if the vehicle is​
143143 5.3not being operated under reciprocity, cancel the certificate of registration on the vehicle​
144144 5.4operated and demand the return of the registration certificate and registration plates. The​
145145 5.5registrar may not cancel the registration or reciprocity privileges for any vehicle found in​
146146 5.6violation of seasonal load restrictions imposed under section 169.87 unless the axle weight​
147147 5.7exceeds the year-round weight limit for the highway on which the violation occurred. The​
148148 5.8registrar may investigate any allegation of gross weight violations and demand that the​
149149 5.9operator show cause why all future operating privileges in the state should not be revoked​
150150 5.10unless the additional tax assessed is paid.​
151151 5.11 (3) Clause (1) does not apply to the first haul of unprocessed or raw farm products or​
152152 5.12unfinished forest products, when the registered gross weight is not exceeded by more than​
153153 5.13ten percent. For purposes of this clause, "first haul" means (i) the first, continuous​
154154 5.14transportation of unprocessed or raw farm products from the place of production or on-farm​
155155 5.15storage site to any other location within 100 miles of the place of production or on-farm​
156156 5.16storage site, or (ii) the continuous or noncontinuous transportation of unfinished forest​
157157 5.17products from the place of production to the place of final processing or manufacture located​
158158 5.18within 200 miles of the place of production.​
159159 5.19 (4) (3) When the registration on a motor vehicle, trailer, or semitrailer is revoked by the​
160160 5.20registrar according to this section, the vehicle must not be operated on the highways of the​
161161 5.21state until it is registered or reregistered, as the case may be, and new plates issued, and the​
162162 5.22registration fee is the annual tax for the total gross weight of the vehicle at the time of​
163163 5.23violation. The reregistration pursuant to this subdivision of any vehicle operating under​
164164 5.24reciprocity agreements pursuant to section 168.181 or 168.187 must be at the full annual​
165165 5.25registration fee without regard to the percentage of vehicle miles traveled in this state.​
166166 5.26 Sec. 3. Minnesota Statutes 2024, section 168.013, subdivision 12, is amended to read:​
167167 5.27 Subd. 12.Additional tax for excessive gross weight.(a) Whenever an owner has​
168168 5.28registered a vehicle and paid the tax as provided in subdivisions 1 to 1g, on the basis of a​
169169 5.29selected gross weight of the vehicle and thereafter such owner desires to operate such vehicle​
170170 5.30with a greater gross weight than that for which the tax has been paid, such owner shall be​
171171 5.31permitted to reregister such vehicle by paying the additional tax due thereon for the remainder​
172172 5.32of the calendar year for which such vehicle has been reregistered, the additional tax computed​
173173 5.33pro rata by the month, 1/12 of the annual tax due for each month of the year remaining in​
174174 5.34the calendar year, beginning with the first day of the month in which such owner desires to​
175175 5​Sec. 3.​
176176 REVISOR KRB/DG 25-01073​12/12/24 ​ 6.1operate the vehicle with the greater weight. In computing the additional tax as aforesaid,​
177177 6.2the owner shall be given credit for the unused portion of the tax previously paid computed​
178178 6.3pro rata by the month, 1/12 of the annual tax paid for each month of the year remaining in​
179179 6.4the calendar year beginning with the first day of the month in which such owner desires to​
180180 6.5operate the vehicle with the greater weight. An owner will be permitted one reduction of​
181181 6.6gross weight or change of registration per year, which will result in a refund. This refund​
182182 6.7will be prorated monthly beginning with the first day of the month after such owner applies​
183183 6.8to amend the registration. The application for amendment shall be accompanied by a fee of​
184184 6.9$3, and all fees shall be deposited in the highway user tax distribution fund. Provided,​
185185 6.10however, the owner of a vehicle may reregister the vehicle for a weight of more than 81,000​
186186 6.11109,000 pounds for one or more 30-day periods. For each 30-day period, the additional tax​
187187 6.12shall be equal to 1/12 of the difference between the annual tax for the weight at which the​
188188 6.13vehicle is registered and reregistered.​
189189 6.14 (b) This subdivision does not apply to the owner of a vehicle who pays the additional​
190190 6.15tax for excessive gross weight under section 169.86, subdivision 5a, when buying a permit​
191191 6.16to operate with the greater gross weight.​
192192 6.17 Sec. 4. Minnesota Statutes 2024, section 169.824, subdivision 1, is amended to read:​
193193 6.18 Subdivision 1.Table of axle weight limits.(a) No vehicle or combination of vehicles​
194194 6.19equipped with pneumatic tires shall be operated upon the highways of this state where the​
195195 6.20total gross weight on any group of two or more consecutive axles of any vehicle or​
196196 6.21combination of vehicles exceeds that given in the following axle weight limits table for the​
197197 6.22distance between the centers of the first and last axles of any group of two or more​
198198 6.23consecutive axles under consideration. Unless otherwise noted, the distance between axles​
199199 6.24must be measured longitudinally to the nearest even foot, and when the measurement is a​
200200 6.25fraction of exactly one-half foot the next largest whole number in feet shall be used, except​

431431 12.8 Sec. 7. Minnesota Statutes 2024, section 169.8261, subdivision 2, is amended to read:​
432432 12.9 Subd. 2.Conditions.(a) A vehicle or combination of vehicles operated under this section​
433433 12.10must:​
434434 12.11 (1) comply with seasonal load restrictions in effect between the dates set by the​
435435 12.12commissioner under section 169.87, subdivision 2;​
436436 12.13 (2) (1) comply with bridge load limits posted under section 169.84;​
437437 12.14 (3) (2) be equipped and operated with six or more axles and brakes on all wheels;​
438438 12.15 (4) (3) be operated under a permit issued by each road authority having jurisdiction over​
439439 12.16a road on which the vehicle is operated, if required by the road authority;​
440440 12.17 (5) (4) obey all road and bridge postings, including those pertaining to lane or roadway​
441441 12.18width; and​
442442 12.19 (6) (5) not exceed 20,000 pounds gross weight on any single axle.​
443443 12.20 (b) A vehicle operated under this section may exceed the legal axle weight limits listed​
444444 12.21in section 169.824 by not more than 12.5 percent; except that, the weight limits may be​
445445 12.22exceeded by not more than 23.75 percent during the time when seasonal increases are​
446446 12.23authorized under section 169.826, subdivision 1.​
447447 12.24Sec. 8. Minnesota Statutes 2024, section 169.86, subdivision 1, is amended to read:​
448448 12.25 Subdivision 1.Permit authorities; restrictions.(a) The commissioner, with respect to​
449449 12.26highways under the commissioner's jurisdiction, and local authorities, with respect to​
450450 12.27highways under their jurisdiction, may, in their discretion, upon application in writing and​
451451 12.28good cause being shown therefor, issue a special permit, in writing, authorizing the applicant​
452452 12.29to move a vehicle or combination of vehicles of a size or weight of vehicle or load exceeding​
453453 12.30the maximum specified in this chapter, exceeding the gross weight for which the vehicle is​
454454 12​Sec. 8.​
455455 REVISOR KRB/DG 25-01073​12/12/24 ​ 13.1registered under chapter 168, or otherwise not in conformity with the provisions of this​
456456 13.2chapter, upon any highway under the jurisdiction of the party granting such permit and for​
457457 13.3the maintenance of which such party is responsible.​
458458 13.4 (b) Permits relating to over-width, over-length manufactured homes shall not be issued​
459459 13.5to persons other than manufactured home dealers or manufacturers for movement of new​
460460 13.6units owned by the manufactured home dealer or manufacturer, until the person has presented​
461461 13.7a statement from the county auditor and treasurer where the unit is presently located, stating​
462462 13.8that all personal and real property taxes have been paid. Upon payment of the most recent​
463463 13.9single year delinquent personal property or current year taxes only, the county auditor or​
464464 13.10treasurer must issue a taxes paid statement to a manufactured home dealer or a financial​
465465 13.11institution desiring to relocate a manufactured home that has been repossessed. This statement​
466466 13.12must be dated within 30 days of the contemplated move. The statement from the county​
467467 13.13auditor and treasurer where the unit is presently located, stating that all personal and real​
468468 13.14property taxes have been paid, may be made by telephone. If the statement is obtained by​
469469 13.15telephone, the permit shall contain the date and time of the telephone call and the names of​
470470 13.16the persons in the auditor's office and treasurer's office who verified that all personal and​
471471 13.17real property taxes had been paid.​
472472 13.18 (c) The commissioner may not grant a permit authorizing the movement, in a three-vehicle​
473473 13.19combination, of a semitrailer or trailer that exceeds 28-1/2 feet, except that the commissioner​
474474 13.20(1) may renew a permit that was granted before April 16, 1984, for the movement of a​
475475 13.21semitrailer or trailer that exceeds the length limitation in section 169.81, subdivision 2, or​
476476 13.22(2) may grant a permit authorizing the transportation of empty trailers that exceed 28-1/2​
477477 13.23feet when using a B-train hitching mechanism as defined in Code of Federal Regulations,​
478478 13.24title 23, section 658.5, from a point of manufacture in the state to the state border.​
479479 13.25 (d) The state as to state trunk highways, a statutory or home rule charter city as to streets​
480480 13.26in the city, or a town as to roads in the town, may issue permits authorizing the transportation​
481481 13.27of combinations of vehicles exceeding the limitations in section 169.81, subdivisions 2a​
482482 13.28and 3, over highways, streets, or roads within its boundaries. Combinations of vehicles​
483483 13.29authorized by this paragraph may be restricted as to the use of state trunk highways by the​
484484 13.30commissioner, to the use of streets by the city road authority, and to the use of roads by the​
485485 13.31town road authority. Nothing in this paragraph or section 169.81, subdivisions 2a and 3,​
486486 13.32alters or changes the authority vested in local authorities under section 169.04.​
487487 13​Sec. 8.​
488488 REVISOR KRB/DG 25-01073​12/12/24 ​ 14.1 Sec. 9. Minnesota Statutes 2024, section 169.86, subdivision 5, is amended to read:​
489489 14.2 Subd. 5.Fees; proceeds deposited; appropriation.The commissioner, with respect to​
490490 14.3highways under the commissioner's jurisdiction, may charge a fee for each permit issued.​
491491 14.4The fee for an annual permit that expires by law on the date of the vehicle registration​
492492 14.5expiration must be based on the proportion of the year that remains until the expiration date.​
493493 14.6All fees for permits issued by the commissioner of transportation must be deposited as​
494494 14.7provided in paragraph (i) and in section 174.525. Except for those annual permits for which​
495495 14.8the permit fees are specified elsewhere in this chapter, the fees are:​
496496 14.9 (a) $15 for each single trip permit.​
497497 14.10 (b) $36 for each job permit. A job permit may be issued for like loads carried on a specific​
498498 14.11route for a period not to exceed two months. "Like loads" means loads of the same product,​
499499 14.12weight, and dimension.​
500500 14.13 (c) $60 for an annual permit to be issued for a period not to exceed 12 consecutive​
501501 14.14months. Annual permits may be issued for:​
502502 14.15 (1) motor vehicles used to alleviate a temporary crisis adversely affecting the safety or​
503503 14.16well-being of the public;​
504504 14.17 (2) motor vehicles that travel on interstate highways and carry loads authorized under​
505505 14.18subdivision 1a;​
506506 14.19 (3) motor vehicles operating with gross weights authorized under section 169.826,​
507507 14.20subdivision 1a;​
508508 14.21 (4) (3) special pulpwood vehicles described in section 169.863;​
509509 14.22 (5) (4) motor vehicles bearing snowplow blades not exceeding ten feet in width;​
510510 14.23 (6) (5) noncommercial transportation of a boat by the owner or user of the boat; and​
511511 14.24 (7) (6) motor vehicles carrying bales of agricultural products authorized under section​
512512 14.25169.862.​
513513 14.26 (d) $120 for an oversize annual permit to be issued for a period not to exceed 12​
514514 14.27consecutive months. Annual permits may be issued for:​
515515 14.28 (1) mobile cranes;​
516516 14.29 (2) construction equipment, machinery, and supplies;​
517517 14.30 (3) manufactured homes and manufactured storage buildings;​

611611 16.34costs related to administering the permit program and inspecting and posting bridges; and​

631631 17.19 (d) The vehicle may not be equipped with a variable load axle, unless the variable load​

656656 18.14contemporaneously attempted to evade a fixed weigh station or to otherwise avoid weighing​
657657 18.15by means of stationary scales under section 169.85 or other law, the court must impose a​
658658 18.16penalty of twice the amount otherwise authorized under paragraph (a).​
659659 18.17 (c) Any penalty imposed upon a defendant under this subdivision must not exceed the​
660660 18.18penalty prescribed by this subdivision. Any fine paid by the defendant in a criminal​
661661 18.19overweight action that arose from the same overweight violation is applied toward payment​
662662 18.20of the civil penalty under this subdivision. A peace officer or Department of Public Safety​
663663 18.21employee described in section 299D.06 who cites a driver for a violation of the weight​
664664 18.22limitations established by sections 169.81 to 169.851 and 169.87 section 169.824 must give​
665665 18.23written notice to the driver that the driver or another may also be liable for the civil penalties​
666666 18.24provided herein in the same or separate proceedings.​
667667 18.25 (d) A penalty imposed upon the owner or lessee of a vehicle that is based on violations​
668668 18.26identified by the use of shippers' weight records under section 169.872 must not exceed an​
669669 18.27aggregate of $10,000.​
670670 18.28Sec. 12. Minnesota Statutes 2024, section 169.871, subdivision 1b, is amended to read:​
671671 18.29 Subd. 1b.Civil penalty for first two violations.Notwithstanding subdivision 1,​

692692 Subdivision 1.Winter increase amounts.The limitations provided in sections 169.823 to​
693693 169.829 are increased by ten percent between the dates set by the commissioner for each zone​
694694 established by the commissioner based on a freezing index model each winter.​
695695 Subd. 1a.Harvest season increase amount; permit.The limitations provided in sections​
696696 169.823 to 169.829 are increased by ten percent from the beginning of harvest to November 30​
697697 each year for the movement of sugar beets, carrots, and potatoes from the field of harvest to the​
698698 point of the first unloading. Transfer of the product from a farm vehicle or small farm trailer, within​
699699 the meaning of chapter 168, to another vehicle is not considered to be the first unloading. A permit​
700700 issued under section 169.86, subdivision 1, paragraph (a), is required. The commissioner shall not​
701701 issue permits under this subdivision if to do so will result in a loss of federal highway funding to​
702702 the state.​
703703 Subd. 2.Duration.The duration of a ten percent increase in load limits is subject to limitation​
704704 by order of the commissioner, subject to implementation of springtime load restrictions.​
705705 Subd. 3.Excess weight permit.When the ten percent increase is in effect, a permit is required​

711711 by or under another section of this chapter, the lesser gross weight as fixed, limited, or restricted​
712712 may not be exceeded and must control instead of the gross weights set forth in sections 169.823 to​

714714 Subd. 7.Expiration date.Upon request of the permit applicant, the expiration date for a permit​
715715 issued under this section must be the same as the expiration date of the permitted vehicle's​

717717 169.8295 WEIGHT LIMITS; VEHICLES TRANSPORTING MILK.​
718718 Subdivision 1.Weight limits increase.(a) The weight limitations under sections 169.823 to​
719719 169.829 are increased by ten percent for a single-unit vehicle transporting fluid milk from the point​
720720 of production to (1) another point of production for additional loading, or (2) the point of first​
721721 processing.​
722722 (b) Notwithstanding sections 169.824, subdivision 1, paragraph (d); 169.826, subdivision 3; or​
723723 other law to the contrary, a permit is not required to operate a vehicle under this section.​
724724 (c) The seasonal weight increases under section 169.826, subdivision 1, do not apply to a vehicle​
725725 operated under this section.​
726726 Subd. 2.Requirements; restrictions.A vehicle operated under this section:​
727727 (1) is subject to seasonal load restrictions under section 169.87, except as otherwise provided​
728728 under section 169.87, subdivision 4;​
729729 (2) is subject to bridge load limits posted under section 169.84; and​
730730 (3) must not be operated with a load that exceeds the tire manufacturer's recommended load,​
731731 the manufacturer's gross vehicle weight rating as affixed to the vehicle, or other certification of​
732732 gross vehicle weight rating under Code of Federal Regulations, title 49, sections 567.4 to 567.7.​
733733 169.86 SPECIAL PERMIT TO EXCEED HEIGHT, WIDTH, OR LOAD; FEES.​
734734 Subd. 1a.Seasonal permits for certain haulers.The commissioner of transportation, upon​
735735 application in writing therefor, may issue special permits annually to any hauler authorizing the​
736736 hauler to move vehicles or combinations of vehicles with weights exceeding by not more than ten​
737737 percent the weight limitations contained in sections 169.823 to 169.829, on interstate highways​
738738 during the times and within the zones specified in sections 169.823 to 169.829.​
739739 Subd. 5a.Additional tax for excessive gross weight.When a special permit is issued under​
740740 this chapter, the commissioner shall collect in addition to the permit fee an additional tax for​
741741 excessive gross weight, if the weight allowed under the permit is greater than the gross weight for​
742742 which the vehicle is registered under section 168.013. The tax shall be calculated as the difference​
743743 between the registration tax paid under section 168.013, subdivision 1e, and the additional tax that​

760760 (5) is operated only in this state on Trunk Highway marked 2 between Grand Rapids and the​
761761 port of Duluth; on Trunk Highway marked 169 between Grand Rapids and its junction with Trunk​
762762 Highway marked 53; on Trunk Highway marked 194 between Trunk Highway marked 2 and Trunk​
763763 Highway marked 53; and on Trunk Highway marked 53; and​
764764 (6) the seasonal weight increases authorized under section 169.826, subdivision 1, do not apply.​
765765 Subd. 2.Special two-unit vehicle permit.The commissioner may issue a permit for a vehicle​
766766 that transports paper products, finished forest products, or iron ore tailings and meets the following​
767767 requirements:​
768768 (1) is a combination of vehicles consisting of a truck-tractor and a single semitrailer that may​
769769 exceed 48 feet, but not 53 feet, if the distance from the kingpin to the centerline of the rear axle​
770770 group of the semitrailer does not exceed 43 feet;​
771771 (2) has a maximum gross vehicle weight of 90,000 pounds if the vehicle combination has a total​
772772 of six or more axles or 97,000 pounds if the vehicle combination has a total of seven or more axles;​
773773 (3) has a maximum gross vehicle weight of 99,000 pounds during the time when seasonal weight​
774774 increases authorized under section 169.826, subdivision 1, are in effect;​
775775 (4) complies with the axle weight limits in section 169.824;​
776776 (5) complies with the tire weight limits in section 169.823 or the tire manufacturer's recommended​
777777 load, whichever is less; and​
778778 (6) is operated only on the highways specified in subdivision 1, clause (5).​
779779 Subd. 2a.Special tire-hauling permit.(a) The commissioner may issue a permit authorizing​
780780 a vehicle used exclusively to haul earthmover tires, if the vehicle:​
781781 (1) is a combination of vehicles with seven or more axles, consisting of a truck with loader and​
782782 trailer, which may be equipped with an auxiliary dolly;​
783783 (2) has a maximum gross vehicle weight of 108,000 pounds;​
784784 (3) has a maximum width of 144 inches;​
785785 (4) does not exceed the axle weight limits in sections 169.823, subdivision 1, clause (2), and​
786786 169.824, by more than 22 percent;​
787787 (5) complies with the tire weight limits in section 169.823, or the tire manufacturer's​
788788 recommended load, whichever is less; and​
789789 (6) is operated only on the highways specified in subdivision 1, clause (5).​
790790 (b) The seasonal weight increases authorized under section 169.826, subdivision 1, do not apply​
791791 to permits issued under this subdivision.​
792792 Subd. 3.Restrictions.Vehicles issued permits under subdivisions 1, 2, and 2a, must comply​

804804 Subd. 4.Permit fee; appropriation.Vehicle permits issued under subdivision 1, clause (1),​
805805 must be annual permits. The fee is $850 for each vehicle combination and must be deposited in the​
806806 trunk highway fund. The fee for annual permits issued under subdivision 2 is $300 for a 90,000-pound​
807807 vehicle combination or $500 for a 97,000-pound vehicle combination. The fee for annual permits​
808808 issued under subdivision 2a is $850. An amount sufficient to administer the permit program is​
809809 appropriated from the trunk highway fund to the commissioner for the costs of administering the​
810810 permit program.​
811811 169.865 SPECIAL FARM PRODUCTS PERMITS.​
812812 Subd. 1a.Definition.For purposes of this section, "qualifying agricultural products" means:​
813813 (1) agricultural crops, including but not limited to corn, soybeans, oats, grain, and by-products​
814814 of agricultural crops;​
815815 (2) livestock, including but not limited to cattle, hogs, and poultry;​
816816 (3) food crops, including but not limited to sugar beets, potatoes, carrots, and onions;​
817817 (4) fluid milk;​
818818 (5) seed and material used for or in livestock and poultry feed;​
819819 (6) livestock manure; and​
820820 (7) raw or processed grass seed.​
821821 Subd. 1b.Six-axle vehicles.(a) A road authority may issue an annual permit authorizing a​
822822 vehicle or combination of vehicles with a total of six or more axles to haul qualifying agricultural​
823823 products and be operated with a gross vehicle weight of up to:​
824824 (1) 90,000 pounds; and​
825825 (2) 99,000 pounds during the period set by the commissioner under section 169.826, subdivision​
826826 1.​
827827 (b) Notwithstanding subdivision 3, paragraph (a), clause (4), a vehicle or combination of vehicles​
828828 operated under this subdivision and transporting only sealed intermodal containers may be operated​
829829 on an interstate highway if allowed by the United States Department of Transportation.​
830830 (c) The fee for a permit issued under this subdivision is $300, or a proportional amount as​
831831 provided in section 169.86, subdivision 5.​
832832 Subd. 2.Seven-axle vehicles.(a) A road authority may issue an annual permit authorizing a​
833833 vehicle or combination of vehicles with a total of seven or more axles to haul qualifying agricultural​
834834 products and be operated with a gross weight of up to:​

836836 (2) 99,000 pounds during the period set by the commissioner under section 169.826, subdivision​

838838 (b) Drivers of vehicles operating under this subdivision must comply with driver qualification​
839839 requirements adopted under section 221.0314, subdivisions 2 to 5, and Code of Federal Regulations,​
840840 title 49, parts 40 and 382, unless exempt under section 221.031, subdivision 2c.​
841841 (c) The fee for a permit issued under this subdivision is $500, or a proportional amount as​
842842 provided in section 169.86, subdivision 5.​
843843 Subd. 3.Requirements; restrictions.(a) A vehicle or combination of vehicles operating under​

859859 products under section 168.013, subdivision 3, paragraph (b), or for the first haul of unprocessed​
860860 or raw farm products or unfinished forest products under section 168.013, subdivision 3, paragraph​
861861 (d), clause (3), do not apply to a vehicle or combination of vehicles operated under this section.​
862862 (c) Notwithstanding paragraph (a), clause (4), a vehicle or combination of vehicles hauling fluid​
863863 milk under a permit issued by the commissioner of transportation may also operate on interstate​
864864 highways as provided under United States Code, title 23, section 127.​
865865 Subd. 4.Deposit of revenues.Revenue from the permits issued by the commissioner under​
866866 this section must be deposited in the bridge inspection and signing account as provided under section​
867867 169.86, subdivision 5b.​
868868 Subd. 5.Expiration date.Upon request of the permit applicant, the expiration date for a permit​
869869 issued under this section must be the same as the expiration date of the permitted vehicle's​
870870 registration.​
871871 169.866 SPECIAL CANOLA-HAULING VEHICLE PERMIT.​
872872 Subdivision 1.Special three-unit vehicle permit.The commissioner may issue a permit for a​
873873 vehicle that meets the following requirements:​
874874 (1) is a combination of vehicles, including a truck-tractor and a semitrailer drawing one additional​
875875 trailer or semitrailer, and no semitrailer used in the three-vehicle combination has an overall length​
876876 in excess of 28-1/2 feet;​
877877 (2) has a maximum gross vehicle weight of 105,500 pounds;​
878878 (3) complies with the axle weight limits in section 169.824;​
879879 (4) complies with the tire weight limits in section 169.823, or the tire manufacturers'​
880880 recommended load, whichever is less;​
881881 (5) is operated only in this state on marked Trunk Highway 175 from Hallock to the North​
882882 Dakota border, on U.S. Highway 75 from Hallock to Donaldson, and on marked Trunk Highway​
883883 11 from Donaldson to the North Dakota border; and​
884884 (6) the seasonal weight increases authorized under section 169.826, subdivision 1, do not apply.​
885885 Subd. 2.Restrictions.Vehicles issued permits under subdivision 1 must comply with the​
886886 following restrictions:​
887887 (1) the vehicle must be operated in compliance with seasonal load restrictions under section​
888888 169.87;​

915915 Subd. 2.Special two-unit vehicle permit.The commissioner may issue a permit for a vehicle​

971971 169.869 ROAD CONSTRUCTION MATERIALS SPECIAL PERMIT.​
972972 Subdivision 1.Definition.For purposes of this section, "road construction materials" means​
973973 street or highway construction materials, including but not limited to aggregate material as defined​
974974 in section 298.75, subdivision 1, paragraph (a), hot mix asphalt, plastic concrete, cementitious​
975975 materials, concrete admixtures, asphalt cement, and recycled road materials.​

10111011 Subd. 8.Local preferred routes.A local road authority may identify local preferred routes for​
10121012 operating a vehicle on local streets and highways under a permit issued in this section. A holder of​
10131013 a permit issued in this section and any person seeking to apply for a permit are encouraged to:​
10141014 (1) upon request of a local road authority, provide comment on identification of preferred routes;​
10151015 and​
10161016 (2) make reasonable efforts to operate a vehicle on the preferred routes when operating under​
10171017 the permit.​
10181018 169.87 SEASONAL LOAD RESTRICTION; ROUTE DESIGNATION.​
10191019 Subd. 4.Vehicle transporting milk.A weight restriction imposed under subdivision 1 by the​
10201020 commissioner of transportation or a local road authority, or imposed by subdivision 2, does not​
10211021 apply to a vehicle transporting milk from the point of production to the point of first processing if,​
10221022 at the time the weight restriction is exceeded, the vehicle is carrying milk loaded at only one point​
10231023 of production. This subdivision does not authorize a vehicle described in this subdivision to exceed​
10241024 a weight restriction of five tons per axle by more than two tons per axle.​
10251025 169.871 EXCESS WEIGHT; CIVIL PENALTY.​
10261026 Subd. 1a.Special permit violations.(a) The owner or lessee of a vehicle that is operated with​
10271027 a gross weight in excess of an adjusted weight limit and a shipper who ships or tenders goods for​
10281028 shipment in a single truck or combination vehicle that exceeds an adjusted weight limit is liable for​
10291029 a civil penalty. The civil penalty is the greater of (1) as calculated at a rate of five cents per pound​
10301030 for each pound in excess of the highest weight allowed by the permit or under section 169.826,​
10311031 subdivision 1, or (2) $100.​
10321032 (b) Any penalty imposed upon a defendant under this subdivision shall not exceed the penalty​
10331033 prescribed by this subdivision. Any fine paid by the defendant in a criminal overweight action that​
10341034 arose from the same overweight violation may not be applied toward payment of the civil penalty​
10351035 under this subdivision. A peace officer or Department of Public Safety employee described in​
10361036 section 299D.06 who cites a driver for a violation of the adjusted weight limit shall give written​
10371037 notice to the driver that the driver or another may also be liable for the civil penalty provided in​
10381038 this subdivision in the same or separate proceedings.​
10391039 (c) For purposes of this subdivision, "adjusted weight limit" means a weight limit (1) imposed​
10401040 by a permit issued under this chapter, or (2) imposed under section 169.826, subdivision 1.​
