44 1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
55 1.5 Section 1. [123B.023] NO MANDATES WITHOUT FUNDING.​
66 1.6 Subdivision 1.District noncompliance allowed.Until the amount of revenue needed​
77 1.7to pay for a mandate identified in state law or rule is appropriated, a school district is not​
88 1.8required to comply with a state mandate that:​
99 1.9 (1) affects the daily operation of schools;​
1010 1.10 (2) affects the authority of a school board to establish locally developed education​
1111 1.11policies;​
1212 1.12 (3) changes a school district's curriculum; or​
1313 1.13 (4) changes a school district's spending priorities.​
1414 1.14 Subd. 2.Exceptions.A school district must comply with a mandate if the amount of​
1515 1.15revenue needed for compliance is incidental compared to the school district's total budget.​
1616 1.16A school district must continue to comply with any law governing financial audit​
1717 1.17requirements or directly affecting the life, safety, and health of students.​
1818 1.18 EFFECTIVE DATE.This section applies to state mandates that are in effect after June​
1919 1.1930, 2025.​
