                            1.1	A bill for an act​
1.2 relating to public safety; providing for local correctional officers in Peace Officers​
1.3 Discipline Procedures Act; amending Minnesota Statutes 2024, sections 241.026,​
1.4 subdivision 1; 626.89, subdivisions 1, 2.​
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
1.6 Section 1. Minnesota Statutes 2024, section 241.026, subdivision 1, is amended to read:​
1.7 Subdivision 1.Definitions.(a) For purposes of this section, the terms defined in this​
1.8subdivision have the meanings given them.​
1.9 (b) "Correctional officer" and "officer" mean a person employed by the state, or a state​
1.10correctional facility, or a local correctional or detention facility in a security capacity.​
1.11 (c) "Formal statement" means the questioning of an officer in the course of obtaining a​
1.12recorded, stenographic, or signed statement to be used as evidence in a disciplinary​
1.13proceeding against the officer.​
1.14 Sec. 2. Minnesota Statutes 2024, section 626.89, subdivision 1, is amended to read:​

1.17 (a) "Administrative hearing" means a nonjudicial hearing or arbitration authorized to​
1.18recommend, approve, or order discipline.​
1.19 (b) "Correctional officer" means a person employed by a local correctional or detention​
1.20facility in a security capacity.​

NINETY-FOURTH SESSION​ 2.1 (b) (c) "Formal statement" means the questioning of an officer in the course of obtaining​
2.2a recorded, stenographic, or signed statement information to be used as a basis for disciplining​
2.3an officer or as evidence in a disciplinary proceeding against the officer.​
2.4 (c) (d) "Officer" means a licensed peace officer or part-time peace officer, as defined in​
2.5section 626.84, subdivision 1, paragraphs (c) and (d), who is employed by a unit of​
2.6government, or a correctional officer.​
2.7 Sec. 3. Minnesota Statutes 2024, section 626.89, subdivision 2, is amended to read:​
2.8 Subd. 2.Applicability.The procedures and provisions of this section apply to law​
2.9enforcement agencies and government units, local correctional facilities, and local detention​
2.10facilities. The procedures and provisions of this section do not apply to investigations of​
2.11criminal charges against an officer.​
