1.1 A bill for an act 1.2 relating to public safety; providing penalties for crime of altering controlled 1.3 substances with fentanyl; proposing coding for new law in Minnesota Statutes, 1.4 chapter 609. 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. [609.2285] FENTANYL ADULTERATED SUBSTANCES. 1.7 Subdivision 1.Crime.(a) A person who knowingly adulterates or alters a controlled 1.8substance or drug with fentanyl or substitutes a controlled substance or drug with fentanyl 1.9is guilty of a felony. 1.10 (b) A person who knowingly adulterates or alters any package or receptacle containing 1.11any controlled substance by replacing the controlled substance or drug in the package or 1.12receptacle with fentanyl or a controlled substance or drug containing fentanyl or substitutes 1.13any package or receptacle containing any controlled substance or drug with another package 1.14or receptacle containing fentanyl is guilty of a felony. 1.15 (c) Paragraphs (a) and (b) do not apply to manufacturers, practitioners, pharmacists, 1.16owners of pharmacies, nurses, and other persons when the manufacturer, practitioner, 1.17pharmacist, owner of a pharmacy, nurse, or other person is acting in a professional capacity. 1.18 Subd. 2.Definitions.(a) For purposes of this section, the terms in this subdivision have 1.19the meanings given them. 1.20 (b) "Controlled substance" has the meaning given in section 152.01, subdivision 4. 1.21 (c) "Drug" has the meaning given in section 152.01, subdivision 2. 1Section 1.
