1.1 A bill for an act 1.2 relating to transportation; limiting authority to issue certain citations to pedestrians; 1.3 amending Minnesota Statutes 2024, sections 169.06, subdivisions 5, 6; 169.21, 1.4 subdivision 3. 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. Minnesota Statutes 2024, section 169.06, subdivision 5, is amended to read: 1.7 Subd. 5.Traffic-control signal.(a) Whenever traffic is controlled by traffic-control 1.8signals exhibiting different colored lights, or colored lighted arrows, successively one at a 1.9time or in combination, only the colors Green, Red, and Yellow shall are permitted to be 1.10used, except for special pedestrian signals carrying a word or legend symbol. The 1.11traffic-control signal lights or colored lighted arrows indicate and apply to drivers of vehicles 1.12and pedestrians as follows: 1.13 (1) Green indication: 1.14 (i) Vehicular traffic facing a circular green signal may proceed straight through or turn 1.15right or left unless a sign prohibits either turn. But vehicular traffic, including vehicles 1.16turning right or left, shall must yield the right-of-way to other vehicles and to pedestrians 1.17lawfully within the intersection or adjacent crosswalk at the time this signal is exhibited. 1.18Vehicular traffic turning left or making a U-turn to the left shall must yield the right-of-way 1.19to other vehicles approaching from the opposite direction so closely as to constitute an 1.20immediate hazard. 1.21 (ii) Vehicular traffic facing a green arrow signal, shown alone or in combination with 1.22another indication, may cautiously enter the intersection only to make the movement indicated 1.23by the arrow, or other movement as permitted by other indications shown at the same time. 1Section 1. No. 1509 NINETY-FOURTH SESSION 2.1Vehicular traffic shall must yield the right-of-way to pedestrians lawfully within an adjacent 2.2crosswalk and to other traffic lawfully using the intersection. 2.3 (iii) Unless otherwise directed by a pedestrian-control signal as provided in subdivision 2.46, pedestrians facing any green signal, except when the sole green signal is a turn arrow, 2.5may proceed across the roadway within any marked or unmarked crosswalk. Every driver 2.6of a vehicle shall must yield the right-of-way to such pedestrian, except that the pedestrian 2.7shall must yield the right-of-way to vehicles lawfully within the intersection at the time that 2.8the green signal indication is first shown. 2.9 (2) Steady yellow indication: 2.10 (i) Vehicular traffic facing a steady circular yellow or yellow arrow signal is thereby 2.11warned that the related green movement is being terminated or that a red indication will be 2.12exhibited immediately thereafter when vehicular traffic must not enter the intersection, 2.13except for the continued movement allowed by any green arrow indication simultaneously 2.14exhibited. 2.15 (ii) Pedestrians facing a circular yellow signal, unless otherwise directed by a 2.16pedestrian-control signal as provided in subdivision 6, are thereby advised that there is 2.17insufficient time to cross the roadway before a red indication is shown and no a pedestrian 2.18shall must not then start to cross the roadway. 2.19 (3) Steady red indication: 2.20 (i) Vehicular traffic facing a circular red signal alone must stop at a clearly marked stop 2.21line but, if none, before entering the crosswalk on the near side of the intersection or, if 2.22none, then before entering the intersection and shall must remain standing until a green 2.23indication is shown, except as follows: 2.24 (A) the driver of a vehicle stopped as close as practicable at the entrance to the crosswalk 2.25on the near side of the intersection or, if none, then at the entrance to the intersection in 2.26obedience to a red or stop signal, and with the intention of making a right turn may make 2.27the right turn, after stopping, unless an official sign has been erected prohibiting such 2.28movement, but shall must yield the right-of-way to pedestrians and other traffic lawfully 2.29proceeding as directed by the signal at that intersection; or 2.30 (B) the driver of a vehicle on a one-way street intersecting another one-way street on 2.31which traffic moves to the left shall must stop in obedience to a red or stop signal and may 2.32then make a left turn into the one-way street, unless an official sign has been erected 2Section 1. REVISOR KRB/AC 25-0224201/15/25 3.1prohibiting the movement, but shall must yield the right-of-way to pedestrians and other 3.2traffic lawfully proceeding as directed by the signal at that intersection. 3.3 (ii) Unless otherwise directed by a pedestrian-control signal as provided in subdivision 3.46, pedestrians facing a steady red signal alone shall must not enter the roadway. 3.5 (iii) Vehicular traffic facing a steady red arrow signal, with the intention of making a 3.6movement indicated by the arrow, must stop at a clearly marked stop line but, if none, before 3.7entering the crosswalk on the near side of the intersection or, if none, then before entering 3.8the intersection and must remain standing until a permissive signal indication permitting 3.9the movement indicated by the red arrow is displayed, except as follows: when an official 3.10sign has been erected permitting a turn on a red arrow signal, the vehicular traffic facing a 3.11red arrow signal indication is permitted to enter the intersection to turn right, or to turn left 3.12from a one-way street into a one-way street on which traffic moves to the left, after stopping, 3.13but must yield the right-of-way to pedestrians and other traffic lawfully proceeding as 3.14directed by the signal at that intersection. 3.15 (b) In the event an official traffic-control signal is erected and maintained at a place 3.16other than an intersection, the provisions of this section are applicable except those which 3.17can have no application. Any stop required must be made at a sign or marking on the 3.18pavement indicating where the stop must be made, but in the absence of any such sign or 3.19marking the stop must be made at the signal. 3.20 (c) When a traffic-control signal indication or indications placed to control a certain 3.21movement or lane are so identified by placing a sign near the indication or indications, no 3.22other traffic-control signal indication or indications within the intersection controls vehicular 3.23traffic for that movement or lane. 3.24 (d) A peace officer is prohibited from stopping, detaining, or issuing a citation to a 3.25pedestrian for a violation of paragraph (a), clause (2), item (ii), or (3), item (ii), unless: 3.26 (1) the officer lawfully stops or detains the pedestrian for an unrelated violation or 3.27offense; or 3.28 (2) at the time of the violation, a vehicle is approaching in a manner that constitutes a 3.29hazard of collision between the vehicle and the pedestrian. 3.30 EFFECTIVE DATE.This section is effective August 1, 2025, and applies to violations 3.31committed on or after that date. 3Section 1. Minnesota Statutes 2024, section 169.06, subdivision 6, is amended to read: 4.2 Subd. 6.Pedestrian control signal.(a) Whenever special pedestrian-control signals 4.3exhibiting the words "Walk" or "Don't Walk" or symbols of a "walking person" or "upraised 4.4hand" are in place, the signals or symbols indicate as follows: 4.5 (1) A steady "Walk" signal or the symbol of a "walking person" indicates that a pedestrian 4.6facing either of these signals may proceed across the roadway in the direction of the signal, 4.7possibly in conflict with turning vehicles. Every driver of a vehicle shall must yield the 4.8right-of-way to such pedestrian except that the pedestrian shall must yield the right-of-way 4.9to vehicles lawfully within the intersection at the time that either signal indication is first 4.10shown. 4.11 (2) A "Don't Walk" signal or the symbol of an "upraised hand," flashing or steady, 4.12indicates that a pedestrian shall must not start to cross the roadway in the direction of either 4.13signal, but any pedestrian who has partially crossed on the "Walk" or "walking person" 4.14signal indication shall must proceed to a sidewalk or safety island while the signal is showing. 4.15 (b) A pedestrian crossing a roadway in conformity with this section is lawfully within 4.16the intersection and, when in a crosswalk, is lawfully within the crosswalk. 4.17 (c) A peace officer is prohibited from stopping, detaining, or issuing a citation to a 4.18pedestrian for a violation of paragraph (a), clause (2), unless: 4.19 (1) the officer lawfully stops or detains the pedestrian for an unrelated violation or 4.20offense; or 4.21 (2) at the time of the violation, a vehicle is approaching in a manner that constitutes a 4.22hazard of collision between the vehicle and the pedestrian. 4.23 EFFECTIVE DATE.This section is effective August 1, 2025, and applies to violations 4.24committed on or after that date. 4.25 Sec. 3. Minnesota Statutes 2024, section 169.21, subdivision 3, is amended to read: 4.26 Subd. 3.Crossing between intersections.(a) Every pedestrian crossing a roadway at 4.27any point other than within a marked crosswalk or at an intersection with no marked 4.28crosswalk shall must yield the right-of-way to all vehicles upon the roadway. 4.29 (b) Any pedestrian crossing a roadway at a point where a pedestrian tunnel or overhead 4.30pedestrian crossing has been provided shall must yield the right-of-way to all vehicles upon 4.31the roadway. 4Sec. 3. REVISOR KRB/AC 25-0224201/15/25 5.1 (c) Between adjacent intersections at which traffic-control signals are in operation 5.2pedestrians shall must not cross at any place except in a marked crosswalk. 5.3 (d) Notwithstanding the other provisions of this section, every driver of a vehicle shall 5.4must (1) exercise due care to avoid colliding with any bicycle or pedestrian upon any 5.5roadway, and (2) give an audible signal when necessary and exercise proper precaution 5.6upon observing any child or any obviously confused or incapacitated person upon a roadway. 5.7 (e) A peace officer is prohibited from stopping, detaining, or issuing a citation to a 5.8pedestrian for a violation of paragraph (c), unless: 5.9 (1) the officer lawfully stops or detains the pedestrian for an unrelated violation or 5.10offense; or 5.11 (2) at the time of the violation, a vehicle is approaching in a manner that constitutes a 5.12hazard of collision between the vehicle and the pedestrian. 5.13 EFFECTIVE DATE.This section is effective August 1, 2025, and applies to violations 5.14committed on or after that date. 5Sec. 3.
