1.1 A bill for an act 1.2 relating to public safety; expanding driver's license suspensions to include all cases 1.3 where a person is believed to have committed criminal vehicular homicide or 1.4 criminal vehicular operation; requiring peace officers to report all cases where a 1.5 person is believed to have committed criminal vehicular homicide or criminal 1.6 vehicular operation; amending Minnesota Statutes 2024, sections 171.187, 1.7 subdivisions 1, 3; 629.344. 1.8BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.9 Section 1. Minnesota Statutes 2024, section 171.187, subdivision 1, is amended to read: 1.10 Subdivision 1.Suspension required.The commissioner shall suspend the driver's license 1.11of a person: 1.12 (1) for whom a peace officer has made the certification described in section 629.344 1.13that probable cause exists to believe that the person violated section 609.2112, subdivision 1.141, paragraph (a), clause (2), (3), (4), (5), or (6); 609.2113, subdivision 1, clause (2), (3), (4), 1.15(5), or (6); subdivision 2, clause (2), (3), (4), (5), or (6); or subdivision 3, clause (2), (3), 1.16(4), (5), or (6); or 609.2114, subdivision 1, paragraph (a), clause (2), (3), (4), (5), or (6), or 1.17subdivision 2, clause (2), (3), (4), (5), or (6); or 1.18 (2) who has been formally charged with a violation of section 609.20, 609.205, 609.2112, 1.19609.2113, or 609.2114, resulting from the operation of a motor vehicle. 1.20 EFFECTIVE DATE.This section is effective August 1, 2025, and applies to 1.21certifications made on or after that date. 1Section 1. Minnesota Statutes 2024, section 171.187, subdivision 3, is amended to read: 2.2 Subd. 3.Credit.If a person whose driver's license was suspended under subdivision 1 2.3is later convicted of the underlying offense that resulted in the suspension and the 2.4commissioner revokes the person's license, the commissioner shall credit the time accrued 2.5under the suspension period toward the revocation period imposed under section 171.17, 2.6subdivision 4, or for violations of section 609.20, or 609.205, or 609.2112, subdivision 1, 2.7paragraph (a), clause (1), (7), or (8); 609.2113, subdivision 1, clause (1), (7), or (8); 2.8subdivision 2, clause (1), (7), or (8); or subdivision 3, clause (1), (7), or (8); or 609.2114, 2.9subdivision 1, paragraph (a), clause (1), (7), or (8), or subdivision 2, clause (1), (7), or (8). 2.10 EFFECTIVE DATE.This section is effective August 1, 2025. 2.11 Sec. 3. Minnesota Statutes 2024, section 629.344, is amended to read: 2.12 629.344 CRIMINAL VEHICULAR OPERATION AND MANSLAUGHTER; 2.13CERTIFICATION OF PROBABLE CAUSE BY PEACE OFFICER. 2.14 If a peace officer determines that probable cause exists to believe that a person has 2.15violated section 609.2112, subdivision 1, paragraph (a), clause (2), (3), (4), (5), or (6); 2.16609.2113, subdivision 1, clause (2), (3), (4), (5), or (6); subdivision 2, clause (2), (3), (4), 2.17(5), or (6); or subdivision 3, clause (2), (3), (4), (5), or (6); or 609.2114, subdivision 1, 2.18paragraph (a), clause (2), (3), (4), (5), or (6); or subdivision 2, clause (2), (3), (4), (5), or 2.19(6), the officer shall certify this determination and notify the commissioner of public safety. 2.20 EFFECTIVE DATE.This section is effective August 1, 2025, and applies to 2.21determinations by a peace officer that probable cause exists made on or after that date. 2Sec. 3.
