1.1 A bill for an act 1.2 relating to local government; allowing local government noncompliance with 1.3 unfunded mandates; proposing coding for new law in Minnesota Statutes, chapters 1.4 373; 471. 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. [373.52] NO MANDATES WITHOUT FUNDING. 1.7 Subdivision 1.County noncompliance allowed.(a) Except as provided under subdivision 1.82, a county is not required to comply with a state mandate in paragraph (b) until a state law 1.9provides a county with the amount of revenue needed to pay for the mandate. 1.10 (b) A state mandate that a county is not required to comply with under paragraph (a) is 1.11a mandate that: 1.12 (1) affects the daily operation of a county government; 1.13 (2) changes the allocation of a county's resources; or 1.14 (3) changes a county's spending priorities. 1.15 Subd. 2.Exceptions.A county must comply with a state mandate if the amount of 1.16revenue needed for compliance is incidental compared to the county's total budget.
