55 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
66 1.6 Section 1. [145.686] IMMUNITY FROM CRIMINAL LIABILITY FOR HEALTH​
77 1.7CARE PROVIDERS WHEN PROVIDING HEALTH TREATMENT AND SERVICES.​
88 1.8 Subdivision 1.Definition.For the purposes of this section, "health care provider" means​
99 1.9a health professional who is licensed or registered by the state to provide health treatment​
1010 1.10and services within the professional's scope of practice and in accordance with state law.​
1111 1.11 Subd. 2.Immunity from criminal liability.(a) Notwithstanding any provision of law​
1212 1.12to the contrary, a health care provider providing health treatment and services shall be​
1313 1.13immune from criminal liability for any harm or damages alleged to arise from an act or​
1414 1.14omission relating to the provision of health treatment and services, except as provided in​
1515 1.15paragraph (b).​
1616 1.16 (b) Nothing in this section limits any liability for gross negligence or wanton, willful,​
1717 1.17malicious, or intentional misconduct.​
1818 1.18 (c) Nothing in this section shall be construed to amend, repeal, or alter any other​
1919 1.19immunity, defense, limitation of liability, or procedure available or required under any other​
2020 1.20law or contract.​
