66 1.6 Section 1. [473.1453] OPT-OUT BY LOCAL GOVERNMENT AL UNIT​
77 1.7AUTHORIZED.​
88 1.8 Subdivision 1.Opt-out authorized.A local governmental unit may opt out of the​
99 1.9regulatory jurisdiction of the Metropolitan Council upon the filing of a resolution by the​
1010 1.10governing body of the local governmental unit with the Metropolitan Council. The resolution​
1111 1.11must resolve to independently exercise authority over development and public infrastructure​
1212 1.12within the boundaries of the local governmental unit. The Metropolitan Council's regulatory​
1313 1.13jurisdiction over the local governmental unit ceases on January 1 following the date of the​
1414 1.14filing of the resolution with the council, and the local governmental unit is exempt from​
1515 1.15metropolitan system plans and requirements for local governmental units on and after that​
1616 1.16date.​
1717 1.17 Subd. 2.Metropolitan Council tax levies prohibited.(a) Except as provided in​
1818 1.18paragraph (b), no tax authorized to be levied by the Metropolitan Council under this chapter​
1919 1.19may be levied on property within the boundaries of a local governmental unit that has opted​
2020 1.20out of the regulatory jurisdiction of the Metropolitan Council in accordance with this section.​
2121 1.21 (b) The Metropolitan Council may levy a tax on property within the boundaries of a​
2222 1.22local governmental unit that is designated within the metropolitan transit taxing district​
2323 1.23under section 473.446, subdivision 2, regardless of whether a local governmental unit in​

3131 NINETY-FOURTH SESSION​ 2.1the district has opted out of the council's regulatory jurisdiction, if the council continues to​
3232 2.2offer transit services within the boundaries of the local governmental unit.​
3333 2.3 Subd. 3.Eligibility; agreements.A local governmental unit that has opted out of the​
3434 2.4regulatory jurisdiction of the Metropolitan Council may:​
3535 2.5 (1) apply for grant programs administered by the Metropolitan Council for which it is​
3636 2.6eligible; and​
3737 2.7 (2) enter into a joint powers agreement with the Metropolitan Council, in accordance​
3838 2.8with section 471.59.​
3939 2.9 Subd. 4.Metropolitan Council property; services.The Metropolitan Council may​
4040 2.10continue to operate council-owned property and offer transportation services within the​
4141 2.11boundaries of a local governmental unit that has opted out of the regulatory jurisdiction of​
4242 2.12the council in accordance with this section.​
4343 2.13 Subd. 5.Opt-in authorized.A local governmental unit that opted out of the regulatory​
4444 2.14jurisdiction of the Metropolitan Council may opt in to the council's regulatory jurisdiction​
4545 2.15no earlier than four years from the date of the filing of the opt-out resolution in subdivision​
4646 2.161. The local governmental unit may opt in by filing a resolution by the governing body of​
4747 2.17the local governmental unit with the Metropolitan Council. The resolution must state that​
4848 2.18the local governmental unit determines that being under the regulatory jurisdiction of the​
4949 2.19Metropolitan Council is in the best interest of the local governmental unit. The resolution​
5050 2.20allowing the local governmental unit to opt in to the council's regulatory jurisdiction is​
5151 2.21effective January 1 following the date of the filing of the resolution, and the local​
5252 2.22governmental unit is subject to metropolitan system plans and requirements for local​
5353 2.23governmental units on and after that date.​
5454 2.24 EFFECTIVE DATE; APPLICATION.This section is effective the day following​
5555 2.25final enactment and applies in the counties of Anoka, Carver, Dakota, Hennepin, Ramsey,​
5656 2.26Scott, and Washington.​
