55 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
66 1.6 Section 1. Minnesota Statutes 2024, section 115A.93, subdivision 3, is amended to read:​
77 1.7 Subd. 3.License requirements; pricing based on volume or weight.(a) A licensing​
88 1.8authority shall require licensees to impose charges for collection of mixed municipal solid​
99 1.9waste that increase with the volume or weight of the waste collected.​
1010 1.10 (b) A licensing authority may impose requirements that are consistent with the county's​
1111 1.11solid waste policies as a condition of receiving and maintaining a license.​
1212 1.12 (c) A licensing authority shall prohibit mixed municipal solid waste collectors from​
1313 1.13imposing a greater charge on residents who recycle than on residents who do not recycle,​
1414 1.14except that a licensing authority shall allow mixed municipal solid waste collectors to impose​
1515 1.15a greater charge on residents who recycle source-separated compostable materials and sole​
1616 1.16source food waste streams that are managed through biodegradative processes than residents​
1717 1.17who do not recycle those materials.​
1818 1.18 (d) The commissioner may exempt a licensing authority from the requirements of​
1919 1.19paragraph (a) if the county within which the authority is located has an approved solid waste​
2020 1.20management plan that concludes that variable rate pricing is not appropriate for that​
2121 1.21jurisdiction because it is inconsistent with other incentives and mechanisms implemented​
2222 1.22within the jurisdiction that are more effective in attaining the goals of this chapter to​
2323 1.23discourage on-site disposal, littering, and illegal dumping.​

3333 The bill was read for the first time and referred to the Committee on Environment and Natural Resources Finance and Policy​ 2.1 (e) In the interim between revisions to the county solid waste management plan, the​
3434 2.2commissioner may exempt a licensing authority from the requirements of paragraph (a) if​
3535 2.3the commissioner makes the determination otherwise made by the plan in paragraph (d)​
3636 2.4and finds that the licensing authority:​
3737 2.5 (1) operates or contracts for the operation of a residential recycling program that collects​
3838 2.6more categories of recyclable materials than required in section 115A.552;​
3939 2.7 (2) has a residential participation rate in its recycling programs of at least 70 percent or​
4040 2.8in excess of the participation rate for the county in which it is located, whichever is greater;​
4141 2.9and​
4242 2.10 (3) is located in a county that has exceeded the recycling goals in section 115A.551.​
4343 2.11An exemption granted by the commissioner in the interim between revisions to the county​
4444 2.12solid waste management plan is only effective until the county solid waste management​
4545 2.13plan is revised.​
