                            1.1	A bill for an act​
1.2 relating to transportation; prohibiting inclusion of highway spending for​
1.3 nonhighway purposes in governor's budget; requiring a report; proposing coding​
1.4 for new law in Minnesota Statutes, chapter 161.​
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
1.6 Section 1. [161.0895] HIGHWAY PURPOSE; REPORT.​
1.7 (a) To ensure compliance with the Minnesota Constitution, article XIV, sections 2, 5,​
1.8and 6, commissioners of state agencies must not include in a biennial budget any expenditures​
1.9from the trunk highway fund or the highway user tax distribution fund for a nonhighway​
1.10purpose or for any purpose prohibited by section 161.045.​
1.11 (b) No later than 45 days following the submission of the governor's biennial budget to​
1.12the legislature under section 16A.11, the commissioner of management and budget and the​
1.13attorney general must jointly submit a report to the chairs and ranking minority members​
1.14of the legislative committees with jurisdiction over transportation policy and finance. The​
1.15report must examine proposed appropriations from the trunk highway fund and the highway​
1.16user tax distribution fund, explain the highway purpose of the proposed appropriations,​
1.17determine if any proposed appropriation is for a nonhighway purpose, and, for nonhighway​
1.18purposes, recommend the fund to be used.​
1.19 (c) For the purposes of this section, an appropriation for a nonhighway purpose is any​
1.20appropriation not for construction, improvement, or maintenance of highways or for any​
1.21purpose prohibited by section 161.045.​
