1.1 A bill for an act 1.2 relating to health care; covering traditional health care practices under medical 1.3 assistance. 1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.5 Section 1. MEDICAL ASSISTANCE COVERAGE OF TRADITIONAL HEALTH 1.6CARE PRACTICES. 1.7 Subdivision 1.Waiver request.By October 1, 2025, the commissioner of human services, 1.8in consultation with Tribes, Tribal organizations, and urban Indian organizations, shall apply 1.9to the Centers for Medicare and Medicaid Services for a waiver to allow the state's medical 1.10assistance program to provide coverage for traditional health care practices received through 1.11Indian health service facilities, facilities operated by Tribes or Tribal organizations under 1.12the Indian Self-Determination and Education Assistance Act, or facilities operated by urban 1.13Indian organizations under Title V of the Indian Health Care Improvement Act. 1.14 Subd. 2.Requirements.(a) A qualified provider must determine whether a medical 1.15assistance enrollee is eligible to receive traditional health care practices under this section. 1.16 (b) Traditional health care practices are covered under this section if they are received 1.17from a qualified provider. 1.18 (c) For purposes of this section, a "qualified provider" is a practitioner or provider who 1.19is employed by or under contract with the Indian Health Service, a 638 Tribal clinic, or a 1.20Title V urban Indian organization. Each facility is responsible for ensuring that a qualified 1.21provider has the necessary experience and appropriate training to provide traditional health 1.22care practices. 1Section 1. Reimbursement is limited to one payment per day per medical assistance enrollee 2.5receiving traditional health care practices. 2.6 EFFECTIVE DATE.This section is effective January 1, 2026, or upon federal approval, 2.7whichever is later, except that subdivision 1, is effective the day following final enactment. 2.8The commissioner of human services must notify the revisor of statutes when federal 2.9approval is obtained. 2Section 1.
